PLN20060146 Dear Mr. Crispeno: The Planning and Engineering Divisions have reviewed the above draft recording documents, and it was found that the following information, corrections, or clarifications will need to be addressed before review can continue: 1.Note that the City cannot sign off on the final recording documents until final civil construction approval has been given by the Engineering Division. Refer to the attached memorandum and correction notice, both dated July 2, 2012, for additional information. 2.Provide a cover letter addressing how all of the conditions of the preliminary short plat approval have been met. 3.All pages of the final recording documents must comply with the Snohomish County Auditor’s recording requirements, which are available for your reference via the following link: http://www1.co.snohomish.wa.us/Departments/Auditor/Divisions/Recording/. It appears that the draft recording documents may not meet all of the recording requirements, including the minimum required margins. It is the applicant’s responsibility to ensure compliance with the Auditor’s recording requirements in order to avoid issues at the time of recording. 4.Under the “Declaration of Subdivision Covenants” heading on Sheet 1, directly above the line stating “in witness whereof, we set our hands and seals…”, please add the following statement: “We certify that we are the legal owners of interest in the property herein described, and we hereby certify that this subdivision, with the declarations and conditions contained herein, is made of our free consent and according to our desires.” 5.Move the “Acknowledgements” section from Sheet 2 to Sheet 1 so that the notary blocks are on the same page as the signatures. Since the first sheet is tight on space, it is recommended that you move the subdivision map to the second sheet and provide all text (i.e. legal descriptions, declaration, acknowledgements, approvals, hold harmless, easement and maintenance provisions, etc.) on the first sheet. 6.A “Treasurer’s Certificate” is required on the face of the recording documents in order for the Snohomish County Treasurer to confirm that all taxes and delinquent assessments for which the land to be divided may be liable have been paid as of the date of recording. Please contact the Snohomish County Treasurer for the required wording in order for the Treasurer to be able to sign off on the recording documents. 7.Within the “Hold Harmless Agreement” on Sheet 1, change the last word of the third line from “this” to “the” so that it states: “…hereby agree that the City of Edmonds shall be held harmless…” Page 1 of 3 8.Under the “Approvals” heading on Sheet 1, please conduct the following: a.Replace the statement “Approved and authorized for recording by the City of Edmonds Planning Division by:” with the following statement: “The subject final plat conforms to the approved preliminary plat and all conditions of the preliminary approval and is approved and authorized for recording by the City of Edmonds Planning Division by:” b.Replace the statement “Approved and authorized for recording by the City of Edmonds Engineering Division by:” with the following statement: “The survey date, layout of streets, alleys and other rights-of-way, design of bridges, sewage and water system and other structures are approved, and the subject final plat is authorized for recording by the City of Edmonds Engineering Division by:” 9.As requested in Condition 1.c of the short plat preliminary approval, please provide documentation that the 30-foot wide easement shown on the original preliminary short plat plans has been relinquished. 10.All existing and new easements must be indicated on the plans. Please confirm that all existing and new easements have been indicated. When indicating the easements, the existing easements must be delineated on the map in addition to being referenced in the “Notes” section of the recording documents. Since there are overlapping existing and new easements, please utilize varying line styles in order to clearly show the boundaries of each easement. Enlarged details of each easement may also be necessary in order to avoid confusion over the locations of the easements. 11.The civil construction plans indicate that the sewer line serving Lot 2 runs along the southern portion of Lot 1. As such, a sewer easement must be provided along the southern portion of Lot 1 in benefit of Lot 2. Please show a sewer easement consistent with placement of utilities as determined through the civil construction design process. 12.A power easement must be provided near the northeastern corner of Lot 1 / northwestern corner of Lot 2 to provide for the existing power pole. Please determine proper location and provide such easement. 13.On the map, revise the label for the new access and utility easement along the western sides of Lots 1 and 3 to specify that it is a private easement. Is it the intention that one easement be established to include access and utility functions in this location? Or, is the intention to provide two or more separate easements: one for access, one for utilities, etc.? Clearly delineate the boundaries of all new easements and specify easement widths and locations. Additionally, clarify where the boundary of the existing access easement serving the adjacent property to the south (AFN 200112170859) is located in comparison to the new access easement along the western sides of Lots 1 and 3. 14.In addition to indicating all existing and new easements on the map, please also provide Easement and Maintenance Provisions for all new easements. The Easement Provisions section shall clearly state the purpose of the easement, location, and beneficiaries. The Easement Maintenance Provisions shall clearly state ownership and maintenance responsibilities. Refer to the attached example of Easement and Maintenance Provision language. 15.When writing the Easement and Maintenance Provisions for the new easement(s) along the western side of Lots 1 and 3 as discussed above, be sure to clearly identify the lots responsible for maintenance of the separate access and utility functions provided within the easement(s). For example, Lot 2 should only have legal access through a specified portion of the easement and should not have legal access through the entire length of the easement, nor should Lot 2 be responsible for maintaining the entire length of the access road since Lot 2 will only utilize the northeastern portion of the easement for access. 16.As stated in Condition 1.g.2 of the preliminary short plat approval, the gross and net areas of all three lots must be provided on the recording documents. The gross areas of all three lots were provided on the map, but the net areas were not provided. Thus, please provide the net area of each lot on the map. Page 2 of 3 Net area is equivalent to gross area excluding the area of any vehicular access easements. When calculating the net areas for each lot, keep in mind that as required by Condition 1 of the decision on the modification request: “Any alterations made to the existing and/or proposed ingress/egress easements prior to recording may not cause the net area of Lot 1 to fall below 5,688 net square feet as approved in the modification request.” 17.The distances indicated on the map for a few of the line segments of the new property lines are not consistent with the distances indicated within the legal descriptions for the new lots. As such, please confirm all distances and bearings on the map and within the legal descriptions and correct any discrepancies. 18.Condition 2 of the decision on the modification request states the following: “A 6-foot high fence and/or a row of plantings must be established along the western property line of Lots 1 and 3 to act as a screen between these properties and the properties located directly west.” Please indicate what has been done to meet the requirements of this condition. 19.As required by Condition 1.b of preliminary short plat approval, the shed located near the southwestern corner of Lot 3 must be removed prior to recording. Please indicate if this has been done. If it has not yet been done, please remove the shed as soon as possible, keeping in mind that the Building Division must first be contacted to determine if a permit is required for the demolition of the shed. 20.The final recording documents must be signed by your surveyor. 21.Note that all signatures on the final documents must be made in black ink. It is suggested, however, that you submit the revised recording documents to staff for a second review prior to obtaining all required signatures. Please make the above changes and submit your updated recording documents to a Planner, Monday through Friday between 8:00 AM and 4:30 PM. In addressing the above comments please keep in mind that preliminary short plat approval will expire on August 17, 2012 (five years from date of decision on motion for reconsideration) if final approval is not granted prior to expiration. It is strongly recommended that you respond to all comments no later than July 16, 2012 in order to provide time to review the revisions and complete any pending requirements.
