RE: COMMENTS ON DRAFT RECORDING DOCUMENTS
FOR VASSAR/EDWARDS SHORT PLAT, FILE NO. S-2006-42
Dear Mr. Kerr:
The Engineering Division and I have reviewed the above draft recording documents submitted on
December 5, 2008, and it was found that the following information, corrections, or clarifications
will need to be addressed before review can continue:
1. Ed Sibrel, Engineering Technician, reviewed the draft recording documents on behalf of the
Engineering Division and provided his comments in the attached memorandum dated
December 8, 2008. Please respond to all of the comments addressed in Mr. Sibrel's
memorandum in addition to the comments addressed in this letter.
2. The "Certificate of Existence/Authorization" for Chateau Construction & Development LLC
that you submitted on December 11, 2008 states that Diana L. Clay is the manager of the
LLC and that she is the individual authorized to sign on behalf of Chateau Construction.
Please either confirm that Ms. Clay is going to be the individual signing on behalf of Chateau
Construction or provide evidence that you are authorized to sign on behalf of the LLC.
I Change the "Administrator's Certificate" heading to "Planner's Certificate." In addition,
change the label for the signature under this heading from "Short Plat Administrator or
Planning Director" to "Planner."
4. Change the "Legal Description" heading on sheet 1 to "Original Legal Description".
5. Remove the sections of fence near the northern and eastern property lines from sheet 2 since
these sections of fence no longer exist.
6. Note that all signatures on the final documents must be made in black ink.
Please make the above changes and submit your updated recording documents to a Planner,
Monday through Friday, excluding Wednesdays, between 8:00 am and 4:30 pm. If you have any

Subject: S-06-42, Chateau Short Plat
1. There is a discrepancy between the legal description for Lot 2 and Sheet 2 of the
proposed short plat: the legal description describes the south property line to be
82.08 feet in length; the length as shown on Sheet 2 of the short plat shows the
same line to be 83.08 feet in length.
2. Please include the legal descriptions of the individual lots on Sheet 1 of the Short
Plat.
3. The utilities and maintenance agreement shall be amended as follows: "This short
plat contains a 10 foot wide easement for utilities across lots 1 and 2. Ownership
of lots 1 and 2 includes an equal and undivided responsibility for the maintenance
of said easement as related to utility work benefiting both lots, and individual
responsibility for utility work benefiting an individual lot."
4. The drainage maintenance agreement shall be amended as follows: "This short
plat contains a 12 foot wide easement for a storm drainage system across lot 2 for
the benefit of lots 1 and 2. The cost of operation, repair, maintenance and/or
reconstruction of said system, exclusive of the storm conveyance lines to said
system, shall be shared jointly and equally by the owners, their heirs, successors,
and assignees of said lots 1 and 2. Repair and maintenance of the conveyance
lines to the storm system shall be equally and jointly shared responsibility of the
ownership of lots 1 and 2, where such lines serve both lots, and individually
where said lines serves a lot individually."
