Dear Mr. Cleary:
The Planning and Engineering Divisionshave reviewed the above draft recording documents,and it was
found that the following information, corrections, or clarifications will need to be addressedbefore review
can continue:
1.Note that the Citycannot sign off on the final recording documents until the civil plans are approved
and either a bond is posted for the required subdivision improvements or the improvements are
completed and the final inspection is conductedapproving the civil improvements.If you have any
questions on this requirement, please contact Jeanie McConnell, Engineering Program Manager,at

2.Your cover letter states that a bond will be posted for the removal of the existing garage, greenhouse,
shed, and concrete/brick walls and that these structures will be removed at the time of site
development. The removal of these structures, however, is not an item that can be bonded for.
Therefore, please submit for a demolition permit as soon as possible in order to ensure that there is
sufficient time toremove these structures and to obtain a final inspection and approval from staff
before the preliminary short plat approval expires.If you have any questions on submittal for a

3.As the above mentionedstructures are required to be removed prior to recording, please remove all
reference to these structures from the recording documents.
4.All pages of the final recording documents must comply with the Snohomish County Auditor’s
recording requirements, which are available for your reference via the following link:
http://www1.co.snohomish.wa.us/Departments/Auditor/Divisions/Recording/.It appears that the draft
recording documents may not meet all of the recording requirements, including the minimum required
margins. It is the applicant’s responsibility to ensure compliance with the Auditor’srecording
requirements in order to avoid issues at the time of recording.
5.Update the statement in the first restriction under the “Declaration of Short Subdivision, Covenants,
Conditions and Restrictions” headingon Sheet 1to read as follows: “This site is subject to the 30%
native vegetation requirements of ECDC 23.90.040.C.ANative Growth Protection Area(N.G.P.A.) is
established over and upon that portion as delineated herein. All persons having any present or
subsequent ownership interest inLots 1 and 2 shall retain, establish, and maintain native vegetation
within the N.G.P.A. as detailed in the provisions of the Vegetation Management Plan approved by the
City of Edmonds. Any modifications to the VegetationManagementPlan must first be reviewed and
approved by the Planning Division for consistency with applicable requirements.No clearing,
grading, or construction of any kind shall occur within the N.G.P.A. except asreviewed and approved
by the City of Edmonds.”
6.Under the “Approvals” heading on Sheet 1, please conduct the following:
a.Replace the statement “Approved and authorized for recording by the City of Edmonds
Engineering Division by:” with the following statement: “The survey date, layout of streets, alleys
and other rights-of-way, design of bridges, sewage and water system and other structures are
approved, and the subject final plat is authorized for recording by the City of Edmonds
Engineering Division by:”
b.Replace the statement “Approved and authorized for recording by the City of Edmonds Planning
Division by:” with the following statement: “The subject final plat conforms to the approved
preliminary plat and all conditions of the preliminary approval and is approved and authorized for
recording by the City of Edmonds Planning Division by:”
7.A “Treasurer’s Certificate” is included on Sheet 1. It was noted by staff that the wording in this
certificate is different than what was included on a recently recorded short plat for a separate project.
Thus, it is suggested that you contact the Snohomish County Treasurer to determine if this statement
includes all required wording in order for the Treasurer to be able to sign off on the recording
documents.
8.Since the NGPA isbeing established through the recording of the final documents, please remove the
word “proposed” from all labels of the NGPA on Sheets 2 and 3.
9.Change the label at the bottom right corner of Sheet 2 from “Proposed Lots” to “LotLayout.”
10.Delineate the boundaries of the NGPA more clearly on Sheet 2.
11.The detailed Notes regarding the sidewalk and water easements should be removed from plan sheet2.
A general note referring to Sheet 3 would be acceptable.
12.Show Utility easement to be located on Lot 1 in benefit of Lot 2.
13.Change the label at the bottom right corner of Sheet 3 from “Proposed Easements” to “Easements.”
14.Provide a legend for the hatching indicated on Sheet 3. Be sure to note that the hatching within the
existing exclusive use easement is to indicate both the presence of the easement and the presence of the
NGPA.
15.All existing and proposed easements must be indicated on Sheet 3. As such, add notes to Sheet 3
describing the two PUD easements that are referenced in the title report. You may retainthe
references to these easements that are currently provided on Sheet 1.
16.The civil construction plans indicate a utility easement will be provided along the north 15-feet of Lot
1in benefit of Lot 2. Please show utility easement consistent with placement of utilities as determined
through the civil construction design process.
17.Revise “Sidewalk Easement” to: “Public PedestrianAccessEasement”
18.Revise “7’ Water Easement” to: “7’ x 10’Public Water Utility Easement”
19.Provide Easement and Maintenance Provisionsfor all proposed easements on Sheet 3. The Easement
Provisions section shall clearly state the purpose of the easement, location and beneficiaries. The
Easement Maintenance Provisions shall clearly state ownership and maintenance responsibilities.
20.The Public Water Utility Easement notes on Sheet 3 shall state: “A permanent Water Utility Easement
is granted to the City of Edmonds for the installation, construction, operation, maintenance, repair,
reconstruction and/or replacement of a Fire Hydrant and necessary appurtenances, over, across,
through, and below the 7-foot by10-foot Public Water Utility Easement as described in Detail A on
this sheet, and the further right to remove trees, bushes, undergrowth and other obstructions thereon
interfering with the location, construction, operation, maintenance, repair, reconstruction and/or
replacement of said Fire Hydrant and necessary appurtenances, together with the right of access to the
easement at any time for the stated purposes.”
21.ThePublic Pedestrian Access Easement noteson Sheet 3shall state: “A permanent Public Pedestrian
Access Easement is granted to the City of Edmonds to provide the public with pedestrian access over
and across the sidewalk located within the easement described in DetailB onthis sheet. The
responsibility and duty to repair, maintain and reconstruct said sidewalk shall be that of the abutting
property owner in accordance with City of Edmonds Code.”
22.Please remove the note stating “Privatewater and sewer easement will be provided across Lot 1 to
benefit Lot 2, if needed, at the time of construction of said facilities, when actual locations are known”.
The utility locations need to be determined during civil improvement design and easement(s) shall be
provided accordingly and shown on the recording documents.
23.Note that all signatures on the final documents must be made in black ink.It is suggested, however,
that you submit the revised recording documents to staff for a second review prior to obtaining all
required signatures.
Please make the above changes and submit your updated recordingdocuments to a Planner, Monday through
Friday between 8:00AMand 4:30PM.Comments on the draft civil plans and vegetation management plan
are provided in a separate letter.
In addressing the comments on the civil plans, vegetation managementplan, and the abovecomments
regarding the draft recording documents, please keep the following in mind:
a.Preliminary short plat approval will expire on July26, 2012 if final approval is not
granted prior to expiration. It is strongly recommended thatyou respond to all comments
no later than July 5, 2012 in order to provide time to review the revisions and complete
any pending requirements.
b.The two easements being granted to theCity of Edmonds need to be approved by the City
Council prior to recording the short plat. Staff will be presenting the easements to the

Planning, Parks and Public Works Committee on July 10and will then place the item on
th
Council consent agenda for approval atthe July 17Council Meeting. The revisions to
Sheet 3 of the recording documents, specifically those items pertaining to the City
nd
easements, shallbe submitted to the City by noon on Monday, July 2in order for staff to
meet the required meeting submittal deadlines.
