S-2008-06 Dear Mr. Lybeck: The Engineering Division and I have reviewed the above draft recording documents, and it was found that the following information, corrections, or clarifications will need to be addressed before review can continue: 1.Note that the Engineering Division cannot sign off on the final recording documents until either a bond is posted for the required subdivision improvements or the improvements are completed and the final inspection is conducted for the civil review. If you have any questions on this requirement, please contact Jeanie McConnell, Engineering Program Manager, at 425.771.0220 or mcconnell@ci.edmonds.wa.us. th 2.It has been brought to the city’s attention that the ownership of the western 30’ of the vacated 8 Ave N right-of-way was possibly not conveyed between the adjacent property owner to the west and yourself following your lot line adjustment in 2006 (File No. LL-06-32). The Snohomish th County Assessor’s website currently states that the owners of the western 30’ of the vacated 8 Ave N right-of-way are Roy and Sylvia Robinson, who are also listed as the owners of 756 Daley Street. I spoke with Jennifer Hansen of the Snohomish County Assessor’s Office, and she indicated that the recorded lot line adjustment did not convey ownership, and that in addition to the lot line adjustment, a conveyance of ownership should have been recorded as well. I spoke with Georgia th Martin of Stewart Title Company on May 18 regarding this discrepancy. She was going to look into it and get back to me, but have not yet received a response. Therefore, please contact Stewart Title Company and the Snohomish County Assessor’s Office in order to correct this discrepancy. Documentation from the Assessor’s Office and a current title report reflecting consistent ownership must be provided before staff can approve the subdivision. Note that all property owners need to sign off on the recording documents, so if Mr. and Mrs. Robinson in fact own a portion of the th vacated 8 Ave. N, they will need to sign the recording documents for the subdivision as well, or you will need to have them convey the ownership to you so that you become the sole owner. 3.After correcting the discrepancy in ownership discussed above, please provide sufficient documentation that you are authorized to sign on behalf of the 808 Daley LLC. 4.Under the “Owners of Interest” heading, a signature line is provided for Western Engineers. The title report by Stewart Title Company makes no mention of Western Engineers having an ownership interest in the property. Please clarify, and remove the signature line for Western Engineers from under the “Owners of Interest” heading if appropriate. If the signature line for Western Engineers is removed from the “Owners of Interest” heading, please also remove the notary block for Western Engineers under the “Acknowledgement” heading. 5.Under the “Declarations of Short Subdivision…” heading, correct the auditor’s file number in Item #5 from 200604165009 to 200605165009. 6.On Sheet 3, the access and utility easement at the northeast corner of Lot 2 is labeled as an access easement only. Therefore, correct this label to state that it is an access and utility easement (AFN 200508260830). 7.The area of each lot is stated on Sheet 3 within each lot; however, the area shown for Lot 2 does not match what was provided with the original submittal. Please verify the area of this lot. Also, in addition to the gross area, the net area (gross area excluding vehicular access easements) of each lot must be shown. Therefore, please specify the gross and net areas of each lot on Sheet 3. 8.On Sheet 3, the 15’ critical areas building setback should be extended onto the portion of the southwestern corner of Lot 2 that is impacted by the stream buffer and critical area building setback. 9.Note that all signatures on the final documents must be made in black ink. Please make the above changes and submit your updated recording documents to a Planner, Monday through Friday between 8:00am and 4:30pm.
