Dear Mr. Lybeck:
The Engineering Division and I have reviewed your second draft recording documents submitted on
January 6, 2012, and it was found that the following information, corrections, or clarifications will
need to be addressed before review can continue:
1. The Engineering Division cannot sign off on the final recording documents until either a bond
is posted for the required subdivision improvements or the improvements are completed and
the final inspection is conducted for the civil review. Please refer to the attached comments
from Jeanie McConnell, Engineering Program Manager, dated February 27, 2012, for
additional comments from the Engineering Division related to final review of the subdivision.
2. As stated in my previous comment letter dated May 29, 2009 regarding staffs review of your
first draft recording documents, it was brought to the city's attention that the ownership of the
western 30' of the vacated 81h Ave N right-of-way was possibly not conveyed between the
adjacent property owner to the west and yourself following your lot line adjustment in 2006
(File No. LL -06-32). A recorded lot line adjustment does not convey ownership unless a
conveyance of ownership is recorded in addition to the lot line adjustment. Although the legal
description for the subject site is stated within the title report as including all of the vacated Stn
Ave. N right-of-way, the County Assessor's records for the neighboring property to the west
(owned by Robinson) still includes half of the vacated 8th Ave. N right-of-way. I understand
that you sold your property to Pamela Perkins since the time of my previous comment letter
and this item may have been addressed prior to the sale of the property, but please provide
documentation from the Assessor's Office that the ownership of the western 30' of the vacated
81h Ave. N right-of-way was properly transferred from the adjacent property owner to the west
(Robinson) to the owner of the subject site.
3. The plat certificate submitted with your second draft recording documents was dated
November 29, 2011. This document is required to be prepared within 30 days of submittal.
Therefore, please provide an updated plat certificate from your title company.
4. On Sheet 1, revise the first item under the "Declarations of Short Subdivision" heading to state
the following: "Conditions of approval must be met and can be found in the final approval for
the short subdivision located File S-2008-06 at the City of Edmonds Planning Division."
5. On Sheet 1, revise the years for both the Engineering Division's and Planning Division's
signatures from 2011 to 2012.
6. On Sheet 3, what is the object at the southwest corner of the residence that is indicated by the
solid line with an "X" on each of the three sides? It is unclear if this is something that should
be indicated on the recording documents.
7. A deck is indicated at the southeast corner of the residence on Sheet 3. As stated in my
comments emailed to you on February 23, 2012 regarding your building permit application
(BLD20120093) for deck replacement, it is unclear if the original deck was legally constructed
and can be replaced within the minimum required setback from the rear property line on Lot 2.
Please address my comments related to the building permit application for the deck
(BLD20120093). If the original deck was not legally constructed and needs to be removed, the
outline of the deck cannot be shown on the final documents.
8. On Sheet 3, the 15' critical areas building setback needs to be extended onto the portion of the
southwestern comer of Lot 2 that is impacted by the stream buffer and critical area building
setback.
9. On Sheet 3, please add the following note: "This site contains and/or is adjacent to critical
areas including a landslide hazard area and a stream. Therefore, work on the site is subject to
the applicable critical areas regulations of ECDC 23.40 through 23.90, or as amended."
10. Note that all signatures on the final documents must be made in black ink. It is recommended,
however, that you submit the revised documents for review prior to obtaining the owner's final
signature in case any additional changes or corrections are necessary. Once the city has
initially approved the final documents, you may obtain the owner's signature and then bring
them back to the city for staff's signatures.
Please make the above changes and submit your updated recording documents to a Planner, Monday

During review of the final short plat documents it was found that the following information,
corrections, or clarifications are needed. Please ask the applicant to revise and resubmit plans
addressing each of the comments below.
Sheet 1— Recording Documents
Please add a Stormwater Improvements section and include verbiage similar to the
following: The stormwater manangement detention system installed on Lot 1, as a
condition of short plat approval, was designed to accept stormwater flows from no more
than 2250 square feet of on-site impervious surface area.
2. The latest revision to the recording documents includes a 10 -foot utility and PUD
easement for overhead power lines that crosses through the front corner of Lot 1. Please,
describe the purpose of this easement, to whom it benefits and the maintenance
provisions. All new services are to be placed underground. Is there an intent to abandon
this easement when underground power is provided for the new lot (at which time
underground power could be provided to Lot 2 through the proposed 10 -foot easement
along the frontage of the Lot 1)?
3. Please provide easement and maintenance provisions for the 5 -foot utility and PUD
easement provided along the west property line. Are there currently overhead power lines
through this portion of the property? Is this a new easement or is there a separate
recording document that should be referenced?
Final Site Development Plan/Asbuilt
1. An asbuilt has been received and minor changes are required. The applicant is currently
working on these changes and shall submit a new plan sheet to the City when complete.
City of Edmonds
Performance Bond
All site improvements required as a condition of short plat approval shall be constructed
prior to recording or a performance bond shall be posted for any remaining improvements.
The developer has indicated interest in posting a performance bond for the construction of
the driveway (the last improvement to be constructed) and the City is currently reviewing
the cost estimate in order to determine the required bond amount.
