S-2008-06 Dear Mr. Constant: The Planning Division received an application form and payment on September 2, 2008 for a modification request for your application for a short subdivision of the property addressed 808 Daley Street (File No. S-2008-06). However, the following information, corrections, or clarifications will need to be addressed before review can continue: 1.Staff received an application form and payment this morning for your modification request; however, a statement of how your request addresses the review criteria was not submitted. Page 4 of the short plat handout (see enclosed) states that a written response to the variance criteria of ECDC 20.85 is required as part of the application for a modification request. Please contact me if you have any questions on the requirements for the submittal of this statement. 2.ECDC 23.90.040.D.1 states: “Buffers for streams shall be measured on each side of the stream, from the ordinary high water mark.” The 75-foot buffer is indicated on your plans as 75 feet from the centerline of the stream. Therefore, please correct the 75-foot buffer to be from the ordinary high water mark on the side of the stream closest to the subject property. Also, the 15-foot building setback will need to be adjusted as well. Please note that staff will be unable to continue processing your application until responses to the above items are received.
