RE: COMMENTS ON 1 DRAFT RECORDING DOCUMENTS
FOR CASPERS SHORT PLAT, FILE NO. S-2008-33
Dear Mr. Caspers:
The Engineering Division and I have reviewed the above draft recording documents, and it was
found that the following information, corrections, or clarifications will need to be addressed before
review can continue:
1.Under the “Declaration of Short Plat” heading, correct the statement to be singular instead of
plural since there is one owner (i.e. “…owner of the herein described property does hereby
declare…ashis free and voluntary act and deed in accordance with his desires.”
2.In order to avoid confusion since the subject site originated as two lots, please label the legal
description provided on Page 1 as “Original Legal Descriptions” and add a heading for “New
Legal Descriptions”, including the legal descriptions of the newly created lots as well.
3.Under the “Private Easement Provisions” heading, please conduct the following:
a.Statement #1 should be corrected as follows: “The 15 foot private drainage across
Parcel B, as shown hereon, is hereby reserved for and granted to the owners of
Parcels A and B for the purpose of…”.
b.Statement #2 should be corrected as follows: “The 20 foot private ingress, egress and
utility easement across Parcel B, as shown hereon, is hereby reserved for and granted
to the owners of Parcels A and B for the purposes of operating, maintaining, and
reconstructing any driveway improvements, private utility systems, and
appurtenances, if any, together with the right of ingress and egress for such
purposes.”
c.Include provisions for the following new easements:
i.The road easement on Parcel B granted to the City of Edmonds.
ii.The pedestrian easement on Parcel B granted to the City of Edmonds.
iii.The turnaround easement on Parcel B granted to Parcel A.
4.Under the “Private Maintenance Provisions” heading, please conduct the following:
a.The first sentence of statement #1 should be corrected as follows: “ The 15 foot
private drainage across Parcel B, as shown hereon, is for the benefit of Parcels A and
B…”
b.Statement #2 should be corrected as follows: “The 20 foot private ingress, egress and
utility easement across Parcel B, as shown hereon, is for the benefit of Parcels A and
B. The owners of said parcels shall be jointly and equally responsible for the
maintenance, repair, and/or reconstruction of any private utility systems and
appurtenances and/or any driveway improvements located within said easement.
c.Include maintenance provisions for the following new easements:
i.The road easement on Parcel B granted to the City of Edmonds.
ii.The pedestrian easement on Parcel B granted to the City of Edmonds.
iii.The turnaround easement on Parcel B granted to Parcel A.
5.Under the “Restrictions” heading, conduct the following:
a.Show the location of the easement stated in Restriction #2 (AFN#831030209) on
Page 2.
b.Include a statement regarding the PUD No. 1 easement, AFN #9207080293, which is
shown on Page 2.
c.Add the following restriction: “A separate storm detention system will be required for
any additional impervious areas created on Parcel A or Parcel B once the existing
detention system has reached capacity. Future storm detention systems shall be
designed consistent with codes applicable at the time of building permit submittal.”
6.The first word of the “Hold Harmless Agreement” should be “owner” instead of “owner’s”.
7.On Page 2, correct the labels of the lots from “Lot 1” and “Lot 2” to “Parcel A” and “Parcel B”
in order to be consistent with the approved civil plans (Parcel A is the western lot and Parcel B
is the eastern lot).
8.On Page 2, correct the labels of the road and pedestrian easements to state “Road Easement to
the City of Edmonds” and “Pedestrian Easement to the City of Edmonds.”
9.Correct the width of the private drainage easement along the northern portion of Parcel B from
10 feet to 15 feet on Page 2.
10.Either remove the setbacks from Page 2 or add a statement saying: “Setbacks shown are for
reference only and vest no right.”
11.Please clarify the intent of the 5’ strip of land along the southern side of Parcel B. The
approved civil plans show power and phone at this corner of the lot; therefore, it appears that
this area should be designated as a utility easement. If so, you may either create a 5’ private
utility easement separate from the 20’ private ingress, egress, and utility easement, or you may
create two overlapping easements (a 25’ private utility easement and a 20’ private
ingress/egress easement). All easement provisions and maintenance provisions must be
corrected on Page 1 to reflect the easements shown on Page 2. Therefore, you may need to
modify the easement language on Page 1 to reflect how you choose to designate these
easements.
12.The areas of the 20’ private ingress/egress easement, the private turnaround easement, and the
road easement to the City of Edmonds should all be excluded from the gross area of Parcel B
for the net area. Please confirm that this was done or correct the net area of Parcel B to exclude
the area of all three easements.
13.It is unclear if the turnaround easement and 20’ ingress, egress, and utility easement overlap at
the southwest corner of Parcel B or if there is an error in the delineations of these easements.
Therefore, please clarify the extents of both of these easements.
14.Note that the final plans must be signed by your surveyor. Additionally, all signatures on the
final documents must be made in black ink.
Please make the above changes and submit your updated recording documents to a Planner, Monday
through Friday, excluding Wednesdays, between 8:00 am and 4:30 pm. If you have any questions,
