INTRODUCTION The applicant is proposing to subdivide a 38,594 square foot lot addressed as 9921 Water Street into two lots (Attachment 1). See the Zoning and Vicinity Map for reference (Attachment 2). The site is located in a Single -Family Residential (RS -12) zone that allows lots with a minimum area of 12,000 square feet. The proposed lot layout is shown on the preliminary subdivision map (Attachment 3). The applicant has indicated plans to retain the existing structures on Lot 2 at this time. A. Application 1. Owner: Barbara MacDonald 2. Applicant: Ronald Johnson 3. Site Location: 9921 Water Street 4. RT eguest: To divide one lot with a total area of 38,594 square feet into two lots in a Single -Family Residential (RS -12) zone. 5. Review Process: Short plats are Type 11 permits pursuant to ECDC 20.01.003. Following a public comment period, the Director (or designee) makes an administrative decision. _Major Issues: a. Compliance with Edmonds Community Development Code (ECDC) Section 16.20.030, site development standards for the RS -12 zone. b. Compliance with Edmonds Community Development Code (ECDC) Title 18, public works requirements. c. Compliance with Edmonds Community Development Code (ECDC) Chapter 20.0 1, development permit review requirements. d. Compliance with Edmonds Community Development Code (ECDC) Chapter 20.75, subdivision requirements, e. Compliance with Edmonds Community Development Code (ECDC) Chapters 20.55 and 23. 10, shoreline master program. f. Compliance with Edmonds Community Development Code (ECDC) Chapters 23.40 and 23.80, environmentally critical areas and geologically hazardous areas. Note: All code sections referenced in this report can be viewed via the City's website at www.ci.edmonds.wa,us. B. Decision on Subdivision Based upon the Findings of Fact and Conclusions, and Attachments submitted with the application and during the comment period, the following is the decision of the City of Edmonds Planning Division: The subdivision as proposed is APPROVED with the following conditions: 1. Prior to recording, the applicant must complete the following requirements: a) Civil plans must be approved prior to recording. In completing the civil plans, you must address the following: (1) Complete the Engineering Division conditions listed "Required as a Condition of Subdivision" on Attachment 6. (2) If the cost of the civil improvements within shoreline jurisdiction exceed the threshold established by the Office of Financial Management (currently $5,718), a Shoreline Substantial Development Permit (SSDP) will be required prior to civil approval. Refer to section II.E.1 for further direction. b) A vegetation management plan showing how the 30% native vegetation requirement of ECDC 23.90.040.0 is achieved must be approved prior to recording. For further direction, see section 11.17.2 of this report. Barbara MacDonald File No, PLN20090043 Page 3 of 9 c) Make the following revisions to the plat: (1) Include a statement on the face of the plat stating the following: "The site is subject to the 30% native vegetation requirements of ECDC 23.90.040.C. Lots 1 and 2 shall retain and/or establish native vegetation as detailed in the native vegetation plan approved by the City of Edmonds. This plan may be modified by the property owner(s) with approval by the Planning Division." (2) If setbacks are to be included on the plat, add the following statement to the face of the plat: "Setbacks shown are for reference only and vest no right." (3) Add to the face of the plat: "Conditions of approval must be met and can be found in the final approval for the short subdivision located in File No. PLN20090043 in the City of Edmonds Planning Division." (4) Include on the plat all required information, including owner's certification, hold harmless agreement, and Planning Division and Engineering Division staff's approval blocks. d) Make sure all documents to be recorded meet the Snohomish County Auditor's requirements for recording, including all signatures in black ink. e) Submit an updated copy of the title report (short plat certificate) with the documents proposed to be recorded, The title report must be prepared within 30 days of submittal for final review. f) Submit two copies of the documents to be recorded for the Planning Division and Engineering Division's approval. Once approved, the applicant must record the documents with the Snohomish County Auditor's office. 2. After recording the plat, the applicant must complete the following: a) Provide the City Planning Division with three copies of the recorded plat, with the recording number written on them. The City will not consider the subdivision to have been completed until this is done. b) Complete the Engineering Division conditions listed "Required as a Condition of SFR Building Permit" on Attachment b. II. FINDINGS OF FACT AND CONCLUSIONS A. Compliance with the Subdivision Ordinance 1. Introduction a. Sem: The subject property at 9921 Water Street is located in the Single -Family Residential (RS -12) zone (Attachment 2). The surrounding properties are also zoned RS- 12 and are developed with single family residences, b. Topography and Vegetation: , The subject property is relatively level with a gentle downwards slope from east to west toward Puget Sound. A steep slope is adjacent to the western property line, where the land drops down to the BNSF railroad tracks. The site contains typical residential landscaping, including grass, shrubs, and trees. There are a number of larger deciduous and evergreen trees on the central portion of the site. Several of these trees, however, appear to have been topped in the past. C. Lot Layout: The proposed lot layout is shown on the preliminary subdivision map (Attachment 3). The western approximate two-thirds of the site will comprise Lot 1, and the eastern approximate one-third of the site will comprise Lot 2. The applicant has indicated that the owner plans to retain the existing structures on Lot 2 at this time, but that she plans to replace the existing residence with a new residence in the near future. Lot 2 currently has access from Water Street. Lot 1 will also take individual access directly from Water Street. Barbara MacDonald File No. PLN20090043 Page 4 of 9 2. Environmental Resources a, The subdivision chapter, ECDC 20,75.085, states that a proposed subdivision should be designed to minimize significant adverse impacts where environmental resources exist (such as trees, streams, ravines, or wildlife habitats). The existing trees on the site are considered to be environmental resources. Several of these trees, however, appear to have been topped in the past and may not be in excellent health. ECDC 23.90.040.0 requires all subdividable properties that are zoned RS -12 and RS -20 to retain or create an area of native vegetation equal to 30% of the total area of the site. See Section II.F.2 of this report for further discussion on this topic. b. The site is not located in an identified flood plain nor within the North Edmonds Earth Subsidence and Landslide Hazard Area. A portion of proposed Lot 1 falls within the jurisdiction of the Shoreline Management Act (see Section II.E.1). C. Minimal grading will be necessary because the subject property is relatively level (see Section II.E.2). However, immediately to the west of proposed Lot 1, there is an identified steep slope which has been identified as a possible landslide hazard (see Section ILF,1). d, The proposed development at the site must be designed to meet current code and minimize stormwater impacts. All new impervious surfaces must be connected to an onsite detention system as required by the engineering requirements (Attachment 6). e. There are both local views and views of Puget Sound involved with this project. The construction of a single-family residence on proposed Lot 1 and eventual replacement of the existing residence on proposed Lot 2 may impact Sound views that currently exist from surrounding properties. As with all single-family construction, the maximum height for a new house is 25 feet from average original grade, which serves to minimize the negative impact to existing views in the vicinity. The Edmonds Community Development Code does not contain specific regulations regarding view protection within single-family zones. 3. Lot and Street Layout a. This criteria requires staff to find that the proposed subdivision is consistent with the dimensional requirements of the zoning ordinance and that the lots would ultimately be buildable. Based on a review of the project and the analysis in this section, staff agrees that a two -lot short plat is a reasonable use of the property. b. Both lots meet this requirement. Safe walk provisions: The subject parcel is primarily served by three area schools: Edmonds Elementary, Meadowdale Middle School, and Meadowdale High School, According to information available on the Edmonds School District website (Attachments 8 and 9), nearby bus stops exist for service to both the Middle School and the High School. However, bus service is not available to Edmonds Elementary since the parcel is within one mile of the school. As a result, students would have to walk. There are no existing sidewalks on Water Street, Cherry Street, or on 9'h Avenue south to Puget Drive. There is a sidewalk on the north side of Puget Drive east toward Olympic View Drive where there is a cross walk to Edmonds Elementary. There is also a sidewalk from the corner of Cherry Street and Olympic View Drive south to the cross walk at Puget Drive. Barbara MacDonald File No. PLN20090043 Page 5 of 9 4. Setbacks and Lot Coverage a. In order to approve a subdivision, the proposal must meet all requirements of the zoning ordinance, or a modification must be approved. Based on the development standards for the RS -12 zone, setbacks for the lots should be as follows: Lot 1: Street Setback (25 feet): From the south property line. Side Setbacks (10 feet): From the west and east property lines.* Rear Setback (25 feet): From the north property line. Lot 2: Street Setback (25 feet): From the south property line. Side Setbacks (10 feet): From the west and east property lines. Rear Setback (25 feet): From the north property line. *Note: The required buffer and critical area building setback from the top of the steep slope supersede the western side setback unless the buffer and critical area building setback requirements are reduced as allowed by ECDC 23.40 and 23.80. Refer to Section II.F.1 for additional information on critical area requirements. Existing Structures 1 Encroachments: The existing structures are proposed to be retained on Lot 2 at this time. The house, garage and wood shed all appear to be nonconforming with respect to setbacks; however, a determination of nonconforming status has not been made. The survey submitted with the application (Attachment 3) indicates that the house and deck will comply with the minimum required I O -font side setback from the new property line. Thus, the proposed subdivision will not further reduce setback compliance than what is existing. If it can be shown that the existing structures meet the definition of nonconforming structures, then these structures may be retained and maintained according to ECDC 17.40.020 but may not be expanded or altered in any way which increases their nonconformity. The existing house and deck must conform to the required 10' side setback established by the new lot line between Lots I and 2. Any new construction on Lots 1 and 2 must comply with the setbacks in effect at the time of development. Corner Lots: Neither of the lots are considered corner lots. Flag or Interior Lot Determination: Neither of the lots are considered flag lots. e. Lot Coverage of Existing Buildings on Proposed Lots: 35% maximum structural lot coverage is allowed in the RS -12 zone. 2.) According to Snohomish County Assessor's records, the existing house covers 1,425 square feet and the existing garage covers 1,344 square feet. Based on the survey submitted with the application (Attachment 3), the deck covers approximately 325 square feet and the shed covers approximately 285 square feet. This would result in a lot coverage for Lot 2 of approximately 3,379 square feet, which is equivalent to 23% of the proposed area for Lot 2. 'There are no existing structures on Lot 1; therefore, the coverage on Lot 1 would be zero. Pursuant to ECDC 16.20, any future buildings or structures on either of the proposed lots may cover no more than 35% of the net area of each lot. 5. Dedications a. None required, per Engineering Division requirements (Attachment 6). 6. Improvements a. The applicant requested a waiver from constructing sidewalk improvements (Attachment 5). This waiver request was approved by the Engineering Division. Refer to Attachment 6 for the engineering improvement requirements and Attachment 7 for the approval of the sidewalk waiver request, Barbara MacDonald File No. PLN20090043 Page 6 of 9 7. Flood Plain Management a, This project is not in a FEMA -designated flood plain. B. Compliance with the Comprehensive Plan Comprehensive Plan Goals and Policies: The Comprehensive Plan has the following stated goals and policies for Residential Development that apply to this project. Residential Development B. Goal. High quality residential development which is appropriate to the diverse lifestyle of Edmonds residents should be maintained and promoted. The options available to the City to influence the quality of housing for all citizens should be approached realistically in balancing economic and aesthetic consideration, in accordance with the following policies: B.1. Encourage those building custom homes to design and construct homes with architectural lines which enable them to harmonize with the surroundings, adding to the community identity and desirability. B.3. Minimize encroachment on view of existing homes by new construction or additions to existing structures. B.4. Support retention and rehabilitation of older housing within Edmonds whenever it is economically feasible. B.5. Protect residential areas from incompatible land uses through the careful control of other types of development and expansion based upon the following principles: B -5-d, Private property must be protected from adverse environmental impacts of development including noise, drainage, traffic, slides, etc. B.6. Require that new residential development be compatible with the natural constraints of slopes, soils, geology, vegetation and drainage. Compliance with the Residential Development goals and policies: The proposal will retain the existing house that was constructed in 1946 (according to Snohomish County Assessor's records) and would allow for construction of one new residence. The overall proposal should not cause any adverse impacts and appears to be consistent with the residential development goals and policies of the Comprehensive Plan. C. Compliance with the Zoning Code The proposed subdivision complies with the provisions of the Zoning Code, See sections Il.A.3 and I1.AA of this document. D. Compliance with the Flood Plain Management Provisions The proposed project is not located in a Flood Plain. E. Environmental Assessment is this site within a shoreline area (within 200 feet of the ordinary high water mark of the Puget Sound)? Yes, the 200 -foot shoreline jurisdiction limit runs approximately north -south through the middle of proposed Lot 1. According to ECDC 23.10 (Plate 2), the parcel is located within the Suburban Residential II shoreline environment. A Shoreline Substantial Development Permit Barbara MacDonald File No. PLN20090043 Page 7 of 9 (SSDP) will be required if the civil improvements installed or bonded for within the shoreline jurisdiction as part of the subdivision (Attachment 6) exceed a cost threshold established by the Office of Financial Management. The current threshold of $5,718,00 was set in July 2007; this value is adjusted for inflation and is subject to change according to Section 90.58.030(3)(e) RCW. If the portion of the civil improvements required to develop the short plat located within the shoreline jurisdiction exceed the threshold for a SSDP, the applicant will need to obtain approval of a SSDP prior to civil approval. It should be noted that it takes several months to process a SSDP application, so it is recommended that the applicant submit for a SSDP as soon as possible if the applicant feels that the threshold will be exceeded. Is an Environmental Checklist required for this application? Not at this time. If more than 500 cubic yards of grading will be required for the subdivision improvements, an Environmental Checklist is required. At this point, the total amount of grading for the subdivision improvements is not anticipated to exceed 500 cubic yards. If through the review of the civil plans, it is determined that more than 500 cubic yards of grading will be required, the City will require an Environmental Checklist to be submitted and will issue an Environmental Determination. F. Critical Areas Review 1. Critical Areas Review Number: CRA20090046. Results of Critical Areas Review: During review and inspection of the subject site, it was found that the site may contain (or be adjacent to) critical areas, including Geologically Hazardous Areas (Landslide Hazard Area and Erosion Hazard Area), pursuant to ECDC 23.40 and 23.80. There is a steep slope (approximately 71% grade) located immediately west of the site as it slopes down towards the BNSF railroad tracks, The site itself slopes downwards gently from east to west at approximately 10%. Under current critical areas code requirements (ECDC 23.40 and 23.80), projects proposed further than 65 feet from the top of the slope (50' buffer + 15' critical area building setback) do not require a geotechnical report to address critical areas; however, other departments may require a report to address their codes, depending on the scope of work proposed. The applicant has shown the 50 foot buffer and the 15 foot critical area building setback on the preliminary plans (Attachment 3), which demonstrates that there would still be sufficient space on Lot I to construct a residence over 65 feet from the top of the steep slope. Thus, a geotechnical report was not required for the preliminary review and approval of the short plat. If the owner of Lot I wishes to locate any future structures within the minimum 50 foot buffer and 15 foot critical area building setback, then they will need to submit a geotechnical report addressing the requirements of ECDC 23.40 and 23.80 and providing a recommended reduction to the buffer and critical area building setback. 2. ECDC 23.90 )Fish and Wildlife Habitat Conservation Areas: ECDC 23.90.040.0 requires all subdividable properties in the RS -12 and RS -20 zones to retain or create an area of native vegetation equal to 30% of the total area of the lot. The goal of the 30% native vegetation requirement can be met through maintaining existing native vegetation, establishing native vegetation, or a combination of both. This is meant to provide additional protection for fish and wildlife habitat throughout Edmonds; however, the intent is not to set aside areas that cannot be used and enjoyed by the owner. As a condition of approval, the applicant must submit a vegetation management plan showing how the requirements of ECDC 23.90.040C will be met. The vegetation management plan could include a combination of retaining existing native trees and vegetation and/or new landscaping consisting of native plants. Any native species will be acceptable provided that a lawn may not count towards the 30% area. The plan must show where the 30% native vegetation area will be located on the site (it does not need to be provided in one contiguous location), specify the native species that will be retained and/or planted within the area, specify any nonnative vegetation that will be removed, and establish ongoing maintenance activities for the vegetation management area. Note that the plan need not preclude use of the property, such as part of a garden or other landscaped area, but that all vegetation within the 30% area must be of native varieties. The vegetation management plan must be approved by the Planning Division prior to final approval of the subdivision; however, this plan can be modified over time with subsequent approvals by the Planning Division. Departmental Comment: This project was reviewed by the Engineering and Building Divisions as well as the Fire, Parks and Recreation, and Public Works Departments. The Engineering Division provided comments in the form of Engineering Requirements (Attachment 6) as well as a sidewalk waiver approval (Attachment 7). The other commenters (Attachments 10 through 13) stated the proposed preliminary short plat does not affect their division/department at this time, but they will review any subsequent building permit applications and provide any applicable comments at that time. 2. Public Comment: ECDC 20.03 provides the City's regulations for public notice of development applications. A "Notice of Development Application and Comment Period" (Attachment 16) was posted at the subject site and published in the Herald Newspaper by the applicant on September 4, 2009. The applicant's affidavits of posting and publication are included as Attachments 17 and 18 respectively. City staff posted the notice at the Public Safety Complex, Development Services Department, and Library on September 4, 2009. This notice was also mailed by the applicant to residents within 300 feet of the site on September 4, 2009 using a mailing list provided by the applicant with the initial submittal of the application (Attachment 19). The applicant's affidavit of mailing is included as Attachment 20, and the U.S. Postal Service Certificates of Mailing are included as Attachment 21. The applicant has complied with the noticing provisions of ECDC 20.03 (Public Notice). One public comment letter was received during review of the proposal and is included as Attachment 14. Bill and Karen Demetre (18922 Sound View Place) had concerns about existing and future stormwater runoff at the site as well as the location of any future structures on Lot 1. Mr. and Mrs. Demetre commented that they were required to construct their home 45 feet back from the railroad right-of-way and that a home built on Lot I closer to the western property line than 45 feet would impact the Demetre's existing views. Staff Response: All new impervious surfaces will be required to connect to an onsite stormwater detention system and then tie into the City's stormwater system as stated in the engineering requirements (Attachment 6). A new catch basin will be added on Water Street with the required road improvements. With respect to the location of future structures on the site, any new structures must meet the minimum setback requirements for the zone in effect at the time of development. The City cannot require a property to comply with previous setback requirements or setbacks above and beyond those required by the zoning code (Title 16) in effect at the time of development. Any new structure on proposed Lot I would have to either comply with the 50 foot buffer and 15 foot critical area building setback requirements from the top of the steep slope adjacent to the western property line or submit a geotechnical report reducing the buffer and critical area building setback requirements pursuant to the regulations of ECDC 23.40 and 23,80. The Edmonds Community Development Code does not contain specific regulations regarding view protection within single-family zones; however, the maximum allowed height of 25 feet is intended to provide some protection to views. III. APPEAL Pursuant to ECDC 20.07.004, a party of record may submit a written appeal of a Type 1I decision within 14 days after the date of issuance of the decision. The appeal would be heard at an open record public hearing before the Hearing Examiner according to the requirements of ECDC Chapter 20.06 and Section 20.07.004. IV. LAPSE OF APPROVAL Section 20.75.100 states, "Approval of a preliminary plat or preliminary short plat shall expire and have no further validity at the end of five years, unless the applicant has acquired final plat or final short plat approval within the five-year period." NOTICE TO COUNTY ASSESSOR The property owner may, as a result of the decision rendered by the staff, request a change in the valuation of the property by the Snohomish County Assessor's Office. VI. Pursuant to ECDC 18.90.030, Table of Sidewalk Standards, RS -12 zoning (which 9921 Water Street is) does not require sidewalks, except as shown in the Comprehensive Sidewalk Plan. It is, however, stated to be City policy that sidewalks will be required on all streets over 300 feet in length (which Water Street is). Neither the latest adopted Transportation Plan nor the draft update to the Transportation Plan indicates sidewalks/walkways required on the portion of Water Street where the property in question is located. The situation at 9921 Water Street does not meet any other criteria requiring construction of sidewalks, as set forth in the 2002 Transporation Element - Sidewalk Construction Policy. There are presently no existing sidewalks on Water Street. Water Street is not designated as a bikeway in the latest City Bikeway Plan. The property in question is not within 1000 feet of a park, school, church, shopping/commercial establishment, or public facility. In this specific situation, at this location, application of the policy that sidewalks be provided on all streets over 300 feet is dearly contrary to the desires and intent of the City Walkway Plan and not consistent with the character of the surrounding neighborhood. It is clearly not in the best interest of the City to install a sidewalk at this location. Policy 1.14 Require development to provide sidewalks along local street frontages to complete missing links, increase pedestrian safety, and provide linkages to key destinations. The preferred pedestrian improvements along local streets include curb, gutter and sidewalk, or, alternatively, pedestrian paths where appropriate. Policy 1.15 In new development, the City should encourage developers to construct sidewalks that connect the development to transit routes. Objective 2: Bicycle Facilities. Safe bicycle facilities must be an integral part of the City's street and recreation plans, in accordance with the following policies, and established in the City of Edmonds 2000 Cornprehensive Bicycle Plan, as included as APPENDIX D in this Transportation Plan. Policy 2.1 The City should encourage and promote more bicycling activity. Policy 2:2 Bicycle facilities should be separated from sidewalks in congested areas. Policy 2.3 The City should seek safer opportunities for those who bicycle in Edmonds. Policy 2.4 Improved bicycle facilities should be provided near schools. Policy 2.5 Improved bicycle facilities should be provided near commercial districts_ Policy 2.6 Improved bicycle facilities should be provided for access to and from transit facilities. Policy 2.7 Connections to bicycling opportunities in other jurisdictions should be provided. Policy 2.8 Where possible, bicycle lanes should be provided on arterial streets to encourage the use of bicycles for transportation and recreation purposes. Policy 2.9 Bicycle routes should be indicated by signage. Policy 2.10 Bicycle racks or bicycle lockers should be provided in commercial and recreational areas. Policy 2.11 Provision must be made for,maintenance of City bicycle facilities. Objective 3: Sidewalk Construction Policy. Clarify when sidewalks should be constructed as a condition of development. Policy 3.1 The City Engineer will determine whether sidewalks are required as a condition of approval for development projects. If they are required, the developer shall construct sidewalks along the street(s) fronted by the project, including new streets constructed as part of the development. The City Engineer makes an affirmative determination that none of the above criteria apply to the project, and that sidewalks are not necessary and will not be necessary for the foreseeable future; and/or b. The City Engineer, with the approval of the Planning Manager, determines that, in accordance with ECDC 18.90.030.13, special circumstances exist related to topography, insufficient right-of-way, or other factors making construction of sidewalks economically unfeasible or physically impossible. Policy 3.3 When the City Engineer determines that sidewalks are required as a condition of approval, payment -in -lieu of construction will be allowed only if- a. fa. The plat in question runs the entire length of our lot, east to west. When we built our home in 1972 we had a strict height requirement (Set by the MacDonalds, whom we purchased from) which necessitated excavating below the grade of the MacDonald property. We created additional drainage and added additional drains on our property connected to the current MacDonald residence to handle the MacDonald's roof water run off. This has worked well and presented no problems. However, in the past several years we have had substantial surface water run off onto our property, resulting in at least four inches of water accumulating on our property during substantial rain and snowfall melt. We would like to request that any buildingg proposed for the site (We understand that two potential new homes will be built, one on vacant lot on waterfront and one in approximate current location of the MacDonald residence.) will consider the diversion of surface water towards Water Street to the south away from our property. 2, We have a concern regarding the set back requirements from the railroad right of way. When we and our neighbor to the north built, the city required a set back from the RR right of way of approximately 45 feet. Both homes were built, with the verbal understanding at that time, that the set back would remain in effect along the properties on the waterfront. (Vacated Ocean Avenue is in front of our homes.) Changing the setback, from the current waterside setbacks that are in effect, will adversely effect the view corridors that currently exist to the Southwest. We sincerely hope that the approval of this plat will maintain the original setback requirements that we were required to maintain from the railroad right of way. All homes currently enjoy a quality of life that includes some degree of privacy and unobstructed views, we hope the city will consider the importance of this in approving any building setback requirements for this plat. In addition we have a major sewer line crossing the waterside yards of all our properties and would hope that no building would occur over the line itself.
