Bradley We have received your letter of February 25, 1971 exnlaininj your difficulty in acquiring the deeded ff.ve foot utility easement. The lack of this five foot utility easement will not invalidate the City's approval of your subdivision. Without the utility easement, however, the development of the remainin,^- 20 foot access easement will be somewhat more complicated because the utility lines will probably have to be installed underneath the t)avement. Seattle, Washington February 25, 1971 City Planner City of Edmonds Edmonds, Washington Re: Subdivision of property File No. S 29 70 Dear Sir: In regard to the subdivision of our two lots, the requirements state a 20 foot easement plus a five foot utility easement. The twenty foot easement is no propblem as our lot is 20 feet wide at that point, but the neighbor (Mr. Reardon) Vhajj� lot joins our property on 78th Ave.West will not give an easement. Since we do not own land on either side of the lot at that point, I hope we will be excused from the five foot utility easement. When we bought the lots twenty feet was all that was required. Will you please give us a written answer as we are anxious to settle this so we can sell our property since we no longer live on 79th Place West. Thanking you in advance. Edmonds Planning Commid— on - Regular Meeting - Decembers 6, 1970 (Page 5) 5-26-70 Earl Smith - 2 -lot subdivision in the vicinity of 184th St. S. W. and 80th Avenue W. A letter was read from 4r. Smith's representative, Mr. Dwight Hume of Meyring E Associates, Inc., asking that the applicatia'be postponed for a period not to ex- tend beyond June 1971. Mr. Logan said the discussion between the City Staff and Mr. Smith had raised the possibility of better coordination of land development after the official establishment of 183rd Place S. W. which is mentioned in the "New Business". That street should officially be established by the City Council in the next four months. A motion was made and seconded that this application be postponed until the official establishment of 183rd Place S. W. or in no case longer than June 1971. On the question, motion passed unanimously. S-27-70 Povneer, Paul - 2 -lot subdivision - 15909 75th Pl. W. (RS -20 Zone) Mr. Dickson v_ave a brief resume of the. application. Mr. Logan showed a map on the projector and said the property contains 34,200 sq. ft. of area. Prior to its annexation in August of 1963, this area of the county was zoned RR -20,500. The City zoning is RS -20 and the proposal asks for two lots of approximately 17,100 sq. ft. He stated the streets and homes of this area in the City overlay a massive clay formation which is gradually sinking downward. The water service system in this area of the City is wholely inadequate. He recommended denial on the basis of substandard lots, inadequate water service system and landslide problems. Mr. Allen presented the engineering requirements. Mr. Dickson called on the appli- cant or his agent. 'fir. Poyneer felt the area was not sliding and said his property was well drained. He felt there was a financial hardship involved, and he read a letter he had sub- mitted with ihis application. There was a question whether Mr. Poyneer could purchase adjoining property belong- ing to '4r. Welch of Bellevue who has a similar problem. This would enable Mr. Poyneer to subdivide into two lots. Mr. Dailey moved that 5-27-70 he denied because there would be two substandard lots, this is a slide area and there was inadequate water service. The motion was seconded by Firs. Shippen and carried unanimously. 5-28-70 Wood, rrederick R. - 2 -lot subdivision - 7003 156th St. S. W. (RS -12 Zone) Mr. Dickson reviewed the file. Mr. Logan said no water service lines have ever been built in 156th St. S. W. or in the north 300 feet of 70th Ave. W. He said the staff recommends denial on the basis of totally inadequate water serviqe systems. mr. Allen stated the enpineerinv, requirements and recommended that if the Commission approves the subdivision, some stipulation be made that a building permit not be issued until after mains were installed in the area. Mr. Wood said this was agree- able to them as they planned to build on the land in the future. Mr. Dickson called on Commission member participation. Hr. Logan said there were administrative problems in approving a subdivision on a condition that a building permit be withheld. Discussion concerned the construc- tion of an adequate water system to the area. Mr. Haves made a motion that 5-20-70 be refected for the reasons stated by the City Planner and the Engineering Department. The motion was seconded by Mr. Dailey and carried unanimously. 5-29-70 Bradley, Oscar - 2 -lot subdivision - a 1/3 acre tract located about I10 ft. west of 78th Ave. W. and 170 ft. north of 240th St. S. W. (RS -8 Zone) Mr. Dickson reviewed the file. Mr. Logan said this proposal meets all planning and zoning standards with the exception of the access easement width which should be 20 feet wide. He recommended approval on the basis that.a standard easement, pave- ment and turn -around be installed. F1r. Allen discussed the drainage problems in the area. "'r. Dailev moved that 5-29-70 be approved, The motion was.seconded by Mr. Haves and carried unanimously. The election of officers for the year was postponed until January, with a motion by Mr. Hayes to start the January meeting with the election. Any drainage problems. -created by change of contour during plat development must be corrected prior to plat approval or release of plat bond. Final approval of plat (or release of plat bond) will be withheld until actual drainage as installed has been inspected by the City Engineer. GENERAL NOTES Underground wiring required per Ordinance $1387 There appears to be no immediate solution to the drainage problem caused by the low, bowl -shaped topography of this property.
