A 14r. Arnold A. Joyce submitted a request for a subdivision. (See Folder #S--24-61). He had petitioned to be allowed to subdivide Lot 28 (W 1/2 of Lot 28, Willowdale Gardens, Division #1) into two residential building lots, each of which would measure 66 x 323 feet. Mr. Hubbard noted that under the present code, the Planning Commission had no authority to grant Mr. Joyce permission to subdivide into that particular lot width. He said that the lot frontage was not adequate since this property is in an R-8 zone, needing 70' 1oti frontage. He suggested that they could have one lot in back of another, instead of the division they submitted in the sketch. Mr. Hubbard stated further that the code did not give the Planning'Commission the right to grant a variance of exception to the width of a lot, and told Mr. Joyce that he believed Mr. Joyce would need a variance from the Board of Adjustment, and that he would have to make application and go through the posting and publishing procedures. He thought it advisable to acquaint the Board of Adjustment members with the above facts in the event Mr. Joyce put in an appearance -at tonight's meeting. Mr. Stringer moved that Mr. Joyce's request for a subdivision of his lots as described in his petition be denied and recommended that he go to the Board of Adjustment, since the minimum width of a lot is 701,frontage and Mr. Joyce can only give 66l. Mr. 5ater seconded the denial of petition. It was moved and seconded that b Mr. Joyce's subdivision be deni6d because it is not within the scope of the Planning Commission to grant a subdivision of sub -standard lots in an R-8 lot zone and it was recommended that he make proper application to the Board of Adjustment explaining to them the hardship in this particular case.
