Dear Mr. Carlo:
I am enclosing a copy of the map submitted to the City of Edmonds
in 1961 for subdivision of the property in question. Also enclosed
is a copy of the assessor's map and copies of building permits
issued on Lots B and C. If you W141 notice, the legal descriptions
given to us closely matched the approved subdivision.
The problem here is primarily Mr. DeNoviIs if he is the owner of
Lot D as no.building permit can be issued until the access easement
is clarified.
If Mr. Carlo deeds to.Mr. DeNovy it creates an,illegal situation.
Our interest is to -have the legal descriptions correspond to the
approved.subdivision-as.al.l lots were represented as legal size
at time of subdivision.
If agreement cannot be reached.between theproperty owners to main-
tain legal lots the three lots in question (B,C,D) must be re-
subdivided...to.meet code requirements. If a variance in'lot size
is requested,.a hearing would be required before the Board of
Adjustment in addition to the short subdivision procedure..
