To close the loop so to speak, I will send this email to document WSDOT has
received the plan below and has reviewed and approved it for construction. This
plan does not encroach on the state ROW and has no significant impact to the

I wish to “close the loop” with you on the Scott’s Bar & Grill project. We have
decided to pursue an approach that does not entail any work in the SR104
right-of-way. I’ve attached our new grading plan showing the revised scope of
the project. The walls shown will be installed with temporary shoring on the
restaurant property.

Max
If you still want to take down the SR 104 ROW fence during construction and
have access to the berm for construction purposes, you will need to continue
with the "Temporary Break in Limited Access" approval process. So you can work
from within the state ROW.
If you plan to support the wall with structures under the soil within the state
ROW, we will need to review the plan for the wall. This will not take more than
a week to review.

Do we still need WSDOT approval now that we cannot re-grade in the right-of-way?
It doesn’t sound like any disturbance is possible in the right-of-way since,
according to the decision, we are not to disturb any of the existing vegetation.

Hi Max,
WSDOT will give you a complete set of written review comments next week. For
now, I just want you to know, most of our WSDOT support groups have reviewed
your application including the plan set dated Jan 30, 2009, and have the
following comments you may start working on.
The height of your Modular Block retaining wall is, Max. Height = 3.76' per
note on sheet C2.0 of 9.
In the 4th paragraph of the Project Narrative dated October 29, 2008 you
write, "Initial retaining wall designs include walls up to eight feet (8')
in height." This conflicts with the wall height shown on the plans. Please
clarify where the wall will be 8 feet? Or if it will be over the 3.76'
anywhere along WSDOT right-of-way.
The height of the wall along the SR 104 WSDOT right-of-way line will
determine if tie backs are needed or not. If the wall is to be Max. H =
3.76, we will not have as rigid a requirement for you to follow.
Either way, You will still have to apply for a TEMPORARY Break in Limited
Access as shown in the form I sent you. Please follow the process for Temp.
Break, not for a Perm. Break. See the form attached in this email.
