MITIGATED DETERMINATION OF NONSIGNIFICANCE
Description of proposal:
The building permit application submitted for the property located at 8004
Talbot Road in Edmonds includes work around and over Talbot Park Creek, which runs through the back
yard of this developed site. The applicant proposes to construct a new split-rail fence in the back yard to
more accurately correspond with the property lines – this fence would cross the stream (environmentally
friendly fence material would be used to minimize the impact to fish and wildlife and the split-rail fence
would allow wildlife to move freely). At a later date and under a separate permit, the applicant would like
to do the following: remove all debris (such as old concrete, an old water tank, and fencing); construct a
wooden footbridge over the stream (which would require a building permit); replace the existing man-
made waterfall to restore the creek to it’s original cascading water flow; and, remove existing invasive
plants such as ivy and bamboo and replacing them with native plants (which would require a replanting
plan). Best Management Practices to protect the stream from silt would be installed prior to any work in
the stream or along the banksides. No mechanized equipment would be allowed in the stream bed or on
the banks adjacent to the stream, only hand tools may be used \[File No. BLD-2006-0571\].

The lead agency has determined that the requirements for environmental analysis and protection have
been adequately addressed in the development regulations and comprehensive plan adopted under
chapter 36.70A RCW, and in other applicable local, state, or federal laws or rules, as provided by RCW
43.21C.240 and WAC 197-11-158 and/or mitigating measures have been applied that ensure no
significant adverse impacts will be created.
An environmental impact statement is not required under RCW 43.21.030(2)(c). This decision was made
after review of a completed environmental checklist and other information on file with the lead agency.
This information is available to the public on request.
