MITIGATED DETERMINATION OF NONSIGNIFICANCE
Description of proposal: The City of Edmonds is proposing to replace Pump Station No. 2 and install
approximately 564 linear feet of water line between an existing water line at Cary Road to an existing
water line located near the western terminus of Melody Lane. Construction of the new Pump Station and
installation of new water and sewer lines will involve both open trench and trenchless construction
techniques resulting in temporary impacts to Shell Creek's associated wetland and permanent impact to
approximately 476 square feet of stream buffer which will be mitigated according to the City's critical area
ordinance. File Number PLN20100078.
Proponent: City of Edmonds
Location of proposal, including street address if any: The project is located in the City of Edmonds in
Township 27 N, Range 3E, Section 23. The existing pump station is located on private property (929 Cary
Road) approximately 400 feet east of Cary Road. The new pump station would be located on the eastern
side of Shell Creek, near the western terminus of Melody Lane. The project is located on several adjacent
parcels including parcel numbers 27032400210800, 27032400210900, and 27032400212000.
Lead agency: City of Edmonds
The lead agency has determined that the requirements for environmental analysis and protection have
been adequately addressed in the development regulations and comprehensive plan adopted under
chapter 36.70A RCW, and in other applicable local, state, or federal laws or rules, as provided by RCW
43.21C.240 and WAC 197-11-158 and/or mitigating measures have been applied that ensure no
significant adverse impacts will be created.
An environmental impact statement is not required under RCW 43.21 C.030(2)(c). This decision was
made after review of a completed environmental checklist and other information on file with the lead
agency. This information is available to the public on request.
There is no comment period for this DNS.
XX This DNS is issued under 197-11-340(2); the lead agency will not act on this proposal for 14
days from the date below. Comments must be submitted by January 25, 2011.

XX MITIGATING MEASURES INCORPORATED INTO THE PROPOSAL:
THE PROJECT MUST COMPLY WITH ALL CITY OF EDMONDS CRITICAL AREAS
REGULATIONS (EDMONDS COMMUNITY DEVELOPMENT CODE TITLE 23
"NATURAL RESOURCES"). SPECIFICALLY, THE MITIGATION MEASURES
IDENTIFIED IN THE AGENCY REVIEW DRAFT CRITICAL AREAS REPORT FOR THE
PUMP STATION NO. 2 REPLACEMENT PROJECT PREPARED BY LANDAU
ASSOCIATES DATED DECEMER 2, 2010 MUST BE IMPLEMENTED. ANY TREES
THAT ARE REMOVED IN CONJUNCTION WITH THE PROJECT MUST BE REPLACED
AT A RATIO OF 2:1. ANY PROPOSED CHANGES TO THE AGENCY REVIEW DRAFT
OF THE CRITICAL AREAS REPORT OR MITIGATION MEASURES MUST BE
APPROVED BY THE CITY OF EDMONDS PLANNING DIVISION.
2. IN THE EVENT THAT ANY GROUND -DISTURBING ACTIVITES DURING THE
PROJECT UNCOVER PROTECTED CULTURAL MATERIALS OR HUMAN REMAINS,
ALL WORK IN THE IMMEDIATE VICINITY SHOULD STOP, THE AREA SHOULD BE
SECURED, AND ANY EQUIPMENT MOVED TO A SAFE DISTANCE. THE
CONTRACTOR SHOULD THEN CONTACT THE APPROPRIATE AGENCY AND TRIBE
AS IDENTIFIED IN THE UNANTICIPATED DISCOVERIES PROTOCOL (UDP)
INCLUDED AS APPENDIX 3 OF THE ARCHAEOLOGICAL INVESTIGATION REPORT
PREPARED FOR THE PROJECT. A COPY OF THE UDP IN APPENDIX 3 SHALL BE
PROVIDED TO THE CONTRACTOR AND THE UDP MUST REMAIN ON SITE AT ALL
TIMES DURING THE IMPLEMENTATION OF THE PROJECT.
3. THE PROJECT MUST COMPLY WITH HYDRAULIC PROJECT APPROVAL (HPA)
FROM THE WASHINGTON STATE DEPARTMENT OF FISH AND WILDLIFE AND ANY
OTHER FEDERAL, STATE, OR LOCAL PERMITS REQUIRED FOR THE PROJECT.
