Edmonds, WA. 98026 Case: # COD20100002 Subject Property: 23806 801h Ave. W., Edmonds, WA. 98026 Dear Asmeron Seyoun, The City received a complaint regarding junk vehicles and nuisance items outside on the property. It was also noted that the garage has been converted to habitable space without a building permit. The subject property was viewed on January 5, 2010. At that time it was noted that junk vehicles and nuisance items were outside the residence. It was also noted that a regular door had replaced one of the garage doors which requires a building permit. Changing the use of a garage to habitable space also requires a change of use permit and inspection. If construction is still going on upon receipt of this letter, please "STOP WORK". The current Junk vehicle criteria (effective 1110/09) is as follows: "Junk vehicles" are defined in ECDC 6.20.020.E as a vehicle meeting any two of the following requirements: "Junk vehicle" means a vehicle meeting any two of the following criteria: 1. Is extensively damaged, including but not limited to any of the following conditions: a broken or missing windshield or missing wheels, tires, motor or transmission; 2. Is apparently inoperable; 3. Is without valid current registration plates. 4. Has an approximate fair market value equal only to the approximate value of the scrap in it. E. "Inoperable" with respect to a vehicle means that the vehicle is incapable of being legally operated on a public roadway due to the condition of the vehicle or the status of the ownership, registration, or license of the vehicle. According to current code, vehicles outside a legal structure are required to be currently licensed or are considered a junk vehicle. A vehicle is not considered junk if it is currently licensed although it may not "run". Nuisances are defined as follows: Edmonds City Code 6.20.041 The following nuisances are aesthetic in nature and can negatively impact neighborhood property values and foster blight. The following actions and/or conditions shall be a public nuisance when located in any front, side or rear yard or vacant lot. A. Any junk, trash, or litter, B. Salvage materials or lumber not neatly stacked. C. Any broken, soiled or discarded furniture, household equipment or furnishings. D. Any vehicle parts or other articles of personal property which are stored, discarded or left in a state of partial construction or repair. E. Any accumulation, stack or pile of'building, landscaping or construction materials which are exposed to the elements or are in disarray and which are not directly associated with a project on the premises for which a current building permit has been obtained; or, with respect to a project which does not require a permit, that is in progress or which is scheduled to begin within ten (10) business days. Construction materials include but are not limited to metal, wood, wire, drywall, electrical components, and any supplies, equipment or other items utilized for painting, landscaping, logging, roofing, masonry or plumbing. Wholly enclosed within a building; or 2. Located in a rear yard and screened from adjacent properties and the public right of way by a six-foot opaque fence or by a vegetative barrier that is between six feet and eight feet in height and provides a visual barrier equivalent to an opaque fence. Corner lots which have no rear yard may establish a screening area which qualifies for this exception in a side yard. 6.20.043 Protective coverings. Except as otherwise expressly provided by applicable city ordinance or a valid regulatory permit, any condition enumerated in ECC 6.20.040 shall constitute a public nuisance irrespective of whether such condition is covered in whole or in part by a tarpaulin, vapor barrier, canvas or plastic sheeting, or other temporary covering. The house was built in 1960 and annexed into Edmonds in 1961. The City has no records for the conversion of the garage into habitable space. A handout is enclosed outlining the application requirements for converting a garage into habitable space. Corrective actions required: • Please contact me by email noted below or at 425-771-0220 x1716 at your earliest convenience by January 13, 2010 to review your compliance plan. An Order to Correct Violation Notice is issued if no contact is made. • Remove all nuisance items from outside the house by January 25, 2010. As noted above, a tarp or cover does not exempt nuisance items from enforcement. • Remove or enclose all vehicles that are not currently licensed (please note that a tarp, cover or pliable tent/canopy is not considered enclosed) by January 31, 2010 or; • Demonstrate operability of the vehicles with the City through an inspection or contact the City once the vehicles are currently licensed by January 31, 2010. The City can verify the license on-line. • Please submit a complete application for construction changing the use of the garage to habitable space by February 1, 2010.
