Description of Proposal The applicant proposes to remove eleven trees. One of the trees is immediately adjacent to the existing house (an oak), while the remainder are located on the western half of the site (Attachment 2). Nine of the trees proposed to be removed are located on a narrow bench between the two rockeries; these trees include four alders, one scotch pine, and four sequoias. These trees have become too large for their tight locations and threaten to negatively impact the applicant's house, rockeries and drainage improvements. An additional flowering cherry is also proposed to be removed. Because the site contains critical areas, replanting is required. II. FINDINGS OF FACT AND CONCLUSIONS A. Site Development, Neighboring Development and Zoning 1. Facts: a. The site is approximately 26,000 square feet and zoned Single -Family Residential (RS - 20). Like the subject lot, the surrounding area is similarly zoned and developed with single family residences (see below — arrows call out areas of proposed removals). b. The entire site was regraded in 1987 as part of short plat improvements undertaken at that time (5-87-18). In 1989, a drainage system and three rockeries were installed on the wester portion of site after blackberri were removed. The easter portion of site is developed with a hou and driveway. Residentiz landscapir and trees were installed throughout the parcel after the site grading and drainage improvements were completed in 1989. Kurosaka Tree Cutting File No. PLN -2010-0057 Page 3 of 6 B. Edmonds Community Development Code (ECDC) Compliance 1. ECDC Section 18.45 (Land Clearing and Tree Cutting) a. Facts: 1) ECDC Section 18.45.030 exempts clearing on an improved single-family lot, except for that portion of the lot that has slopes exceeding 25 percent. 2) The subject parcel has slopes ranging between 15% to greater than 40%, which was confirmed through the submission of a critical areas checklist (CRA -2005- 0111). 3) ECDC 18.45.050.13 states that "trees shall be retained to the maximum extent feasible." b. Conclusions: 1) A permit is required for the work in question since the activity will occur on slopes in excess of 25%. 2. ECDC Sections 23.40 and 23.80 (Environmentally Critical Areas) a. Facts: 1) As identified in CRA -2005-0111, the subject parcel contains slopes of greater than 40%, which indicates the presence of both erosion and landslide hazard areas according to ECDC 23.80. Generally, vegetation in such critical areas is to be retained; however, select vegetation may be removed per ECDC 23.40.220.C.7, and trees may be removed if they are hazardous, pose a threat to public safety, or pose an imminent risk of damage to private property. 2) The applicant's submittal indicates the locations of the subject trees and describes the location and construction of the drainage improvements and western rockeries (Attachment 2). The nine trees to be removed at the western edge of the parcel sit on a bench of land graded out between the two western -most rockeries. 3) Attachments 3 through 5 are photographs showing the trees that are proposed to be removed. Attachment 3 shows the oak on the eastern portion of the site between the house and driveway. Attachment 4 contains two pictures representative of where the alders, scotch pine, and sequoias are located between the western rockeries. Attachment 5 shows the flowering cherry proposed for removal. 4) If trees are to be removed from critical areas, ECDC 23.40.220.C.7.b.iv states: The land owner shall replace any trees that are removed with new trees at a ratio of two replacement trees for each tree removed (two to one) within one year in accordance with an approved restoration plan. Replacement trees may be planted at a different, nearby location if it can be determined that planting in the same location would create a new hazard or potentially damage the critical area. Replacement trees shall be species that are native and indigenous to the site and a minimum of one inch in diameter at breast height (dbh) for deciduous trees and a minimum of six feet in height for evergreen trees as measured from the top of the root ball. The applicant has proposed low -growing ornamental replacements such as rhododendrons and azaleas. Kurosaka Tree Cutting File No. PLN -2010-0057 Page 4 of 6 b. Conclusions: 1) Based on the documentation provided, the oak near the house as well as the sequoias, alders and scotch pine in the rockery area are threatening private property and improvements and are therefore candidates for removal. The flowering cherry has grown too large for its location as an ornamental and may also be replaced. 2) Because the trees proposed to be removed are part of a larger area of residential landscaping, the trees should be flush cut or ground out in order to provide stability on the slope while allowing some room for replanting. 3) Trees removed from critical areas must be replaced per ECDC 23.40.220.C.7.b.iv. Given the extensive existing landscaping at the site and the narrow planting areas adjacent to the house and between the western rockeries, it is not feasible to replace trees at a 2:1 ratio. Nor does it seem reasonable to install trees such as firs or hemlocks which will eventually impact the house and drainage improvements. Therefore, each of the trees removed must be replaced by one replacement using rhododendron and similar native species such as vine maple, as appropriate. The flowering cherry must be replaced 2:1 using similar native ornamental vegetation. C. Edmonds Comprehensive Plan Compliance 1. Facts: a. The City of Edmonds Comprehensive Plan designates the subject property and those in the immediate vicinity as "Single Family — Resource". b. The Comprehensive Plan has the following stated goals and policies for Residential Development and development within areas of sensitive soils and topography which apply to this project: Soils and Topography C. Goal. Development on steep slopes or hazardous soil conditions should preserve the natural features of the site, in accordance with the following policies: C.3. Erosion Control. C. 3. b. Natural vegetation should be preserved wherever possible to reduce erosion and stabilize slopes, particularly on the downhill property line. C.3.c. Slopes should be stabilized with deep rooted vegetation and mulch, or other materials to prevent erosion and siltation of drainage ways. Vegetation and Wildlife B. Goal. The city should ensure that its woodlands, marshes and other areas containing natural vegetation are preserved, in accordance with the following policies: B.2. The removal of trees should be minimized particularly when they are located on steep slopes or hazardous soils. Subdivision layouts, buildings and roads should be designed so that existing trees are preserved. B.3. Trees that are diseased, damaged, or unstable should be removed. Kurosaka Tree Cutting File No. PLN -2010-0057 Page 5 of 6 8.4. Grading should be restricted to building pads and roads only. Vegetation outside these areas should be preserved. 2. Conclusion: a. The proposed conditions ensure the permit is consistent with the policies of the Comprehensive Plan. D. Technical Committee The proposal has been evaluated by the Engineering and Building Divisions as well as Parks and Recreation, Public Works and Fire District #1 (Attachment 6). The Engineering Division noted that appropriate erosion control measures must be in place during the work. Public Works noted that nothing of a permanent nature may be placed in the sewage easement that runs along the northern property line. E. Public Comment No public comments were received regarding the proposed project. III. DECISION Based on statements of Fact, Conclusions, and Attachments in this report, the application for a Conditional Use Permit for tree cutting at 7529 172°a Street SW is GRANTED, subject to the following conditions: 1. The oak tree on the eastern side of the site between the driveway and the house may be removed. It may be flush cut or ground out. If removed, the tree shall be replanted with at least one native ornamental landscaping replacement such as rhododendron or vine maple. 2. The four alders, four sequoias, and one scotch pine may be removed from the area between the western -most rockeries. The trees may be flush cut or ground out. If removed, each tree removed shall be replaced with one native ornamental landscaping replacement such as rhododendron or vine maple. The flowering cherry tree on the western half of the site may be removed. It may be flush cut or ground out. The tree shall be replanted with two native ornamental landscaping replacements such as rhododendron or vine maple. 4. The following erosion control practices shall be implemented: a. All removal and planting must be done by hand using hand tools. Handheld stump grinders may be used. b. Excess soil exposed during replanting shall be removed from the site. c. Applicable best management practices found in ECDC 18.30 shall be employed. d. All cutting must be removed from the site. 5. A separate right-of-way construction permit shall be obtained from the City prior to any sidewalk or street closures, should closure become necessary. The appeal will be heard at an open record public hearing before the Hearing Examiner according to the requirements of ECDC Chapter 20.06 and Section 20.07.004. V. LAPSE OF APPROVAL Section 18.45.045.C. states "Any permit granted under the provisions of this section shall expire one year from the date of issuance. No work may commence on the permit until the appeal time limit has expired. Upon receipt of a written request, a permit may be extended for six months." VI. ATTACHMENTS 1. Land Use Application 2. We purchased the property in 1987 and our original landscape took place in 1989-1990.Prior to this, the entire backyard was covered by blackberries. As a preparation for this landscaping project, we installed adequate drainage system, built three- tiered rockery structure, and provided land -fill. The project was approved by the City of Edmonds on 12/19/89, and carried out under the supervision of a P.E. , Altinay & Associates. A copy of the approved documents is enclosed as attachment 1. Upon the completion of land preparation, many trees and ornamental plants were densely planted, as can be seen from any available aerial photos. Over twenty- year period, we never encountered any soil / rockery instability problem. Since some trees have now become overgrown, we need to alter the landscape. On the figure next, which is a copy of the original figure 2 submitted in 1989, 1 overlaid the location of the trees (and their information) proposed for removal. All trees are on dry land and except for the flowering cherry tree, all are in flat area.
