trees and replace them with 21 western red cedar trees.

B. Introduction
Rosewood Courte is proposing to remove nine big leaf maple and alder trees and replace them.
with 21 western red cedar trees. The trees are located on the slope behind the facility and are in
various stages of decline. The slope qualifies as a critical pursuant to Edmonds Community
Development Code (ECDC) 23.80, and the trees may only be removed if they .are document by a
certified arborist to pose a threat to public safety or private property. The trees were selected for
removal by a certified arborist because they pose a real threat to life and property if they were to
fail.
C. Findings and Conclusions
L The Rosewood. Courte Edmonds Alzheimer's Community is located at 728 Edmonds Way.
The subject site is zoned BP (Planned Business). Neighboring properties along Edmonds
Way are also zone BP, while the property on top of the slope is zoned RS (Single Family
Residential) (Attachment 1).
2. Rosewood Court was constructed in 2000.and a landscape plan was approved in conjunction
with the original construction, however, the landscape plan only applied to the portions of the
property that was within the development footprint. The trees proposed for removal under
this application are located outside of the development footprint and were not included within
the approved landscape plan.

Geologically Hazardous Areas. Pursuant to ECDC 23.40.220.7.b, trees may be removed
from critical areas and critical area buffers that are hazardous, posing a threat to public safety,
or posing an imminent risk of damage to private property.
4. The report from Jay Maize, a certified arborist with Davey Tree & Lawn, documented the
trees are in various stages of decline, leaning towards Rosewood Courte facilities, and
generally pose a real threat to life and property if they were to fail.
5. Trees cut in a critical area or critical area buffer must be replaced at a ratio of 2:1 according
to ECDC 23.40.220.7.b.iv. Rosewood Courte proposes to replace the nine trees with 21
western red cedar trees, which are two more than required by ECDC 23.40.220.7.b.iv.
Western red cedars are appropriate native trees to use for replacement.
b. Consistent with ECDC 23.40.220.7.b.iii, Rosewood Courte is proposing to as much as the cut
vegetation as possible on the sight. Some branches may be removed to make room for
replanting, but all logs will remain on site.
F. Technical Review
The Public Works Department and Engineering Division have reviewed this application and none
of these Departments/Divisions raised any concerns with the proposal.
G. Decision
Based on the findings, conclusions, and attachments to this report, staff finds that the design
review for file number PLN20090050 is APPROVED with the following conditions:
1. The nine trees approved for cutting are the trees identified on the site plan submitted
November 3, 2009 (Attachment 2).
2. Minimal amounts of branches from the cut trees may be removed from the site to allow
space for replanting. All other vegetation must be left on site.
3. Twenty-one western red cedars must be planted generally consistent with the site plan
submitted November 3, 2009 (Attachment 2). The western red cedars must be a
minimum of six feet in height as measured from the top of the root ball.
4. The replacement trees must be planted by December 1, 2010,

I. Appeals
Staff design review is a Type I decision which pursuant to ECDC 20.01.004.0 is subject to
judicial appeal. Type I decisions may be appealed by a party of record with standing to file a land
use petition in Snohomish County superior couil. Such petition must be filed within 21 days after
issuance fo the decision, as provided in Chapter 36.70C RCW.
