INTRODUCTION
ThepurposeoftheLandClearingandTreeCuttingchapter(ECDC18.45)istoprovideregulationsforthe
clearingofandfortheprotectionandpreservationoftreesandassociatedsignificantvegetation.The
siteisforestedwithmatureevergreensalongthewesternhalfwithahandfuloftreesdispersedalong
theeasternhalfwherethehomeanddrivewayhavebeenconstructed(Attachment3).Theownerhas
requestedtoremove12evergreen(mostlyfir)treesthatremainalongtheeasternhalfofhisproperty
(Attachment3).Someareinpoorcondition,oneiscompletelydead,andmosthavesparsefoliageand
arereceivinglittlelight.Thesetreesarelabeledͻ!ͼthroughͻ\[ͼontheenclosedmap(Attachment3)
andarereferencedintheattachedreportbyCertifiedArboristAnthonyMoranofSuperiorNWTreeand
ShrubCare,Inc.(Attachment4).
ThissiteislocatedinasinglefamilyneighborhoodinnortheastEdmonds.Allofthepropertiesinthis
neighborhoodarealsozonedSingleFamilyResidential(RS8),whereasthepropertiesacrossOlympic
ViewDrivearelocatedwithintheLynnwoodcitylimits(Attachment1).Theownerhasindicatedthat
onereasonhewouldliketoremovethesetreesistoeventuallyconstructanaccessorybuildingonthe
flatportionofthepropertynearthehome.Abuildingpermitwillberequiredtobuildanaccessory
building,becausethepropertycontainsandisadjacenttoamoderatelysteepslope(CRA20090092).
Becausetheownerisproposingtoremovetreesonornearaslope,atreecuttingpermitisrequired.

RecreationDepartment,andthePublicWorksDepartment.TheEngineeringDivisionprovided
commentswhichincludetheconditionthatallworktakeplaceonprivateproperty,includingthestaging
ofequipmentfortreeremoval(Attachment5).
3.APPLICATIONANDSTAFFREVIEWCOMPLIANCE(ECDC20.02andECDC18.45)
ThisapplicationisprocessedpursuanttoECDC20.02ΛͻǤƦĻLLͼstaffdecisionwithnoticerequired).A
completeapplicationwasreceivedonMay7,2010andnoticewaspublished/posted/mailedonMay12,
whichsatisfiestherequirementsofECDC20.02.Nowrittenpubliccommentswerereceived.
4.COMPREHENSIVEPLANCOMPLIANCE

Mostofthetreesproposedtoberemovedarenotonthesteepestportionoftheproperty.Allofthe
treesproposedtoberemovedaredamagedordiseasedinsomeway,accordingtothearboristreport.
Nogradingisproposed.Thetreesinthewesternportionoftheproperty,welloutsidethebuilding
footprintandroad,willbepreserved.Theproposalappearstobeincompliancewiththe
ComprehensivePlan.
5.CRITICALAREASCOMPLIANCE(ECDCTitle23)
FileCRA20090092foundthatcriticalareas(geologicallyhazardousareas)existonandadjacenttothe
property.Becausethereareslopesontheproperty,atreecuttingpermitisrequired.ECDC
23.40.220(C)(7)describesallowedactivitiesincriticalareas,suchasselectvegetationremoval.Itsays
that ͻƷƩĻĻcuttingshallbelimitedtopruningandcrownthinning,unlessotherwisejustifiedbyaqualified
professional.Wherepruningorcrownthinningisnotsufficienttoaddressthehazard,treesshouldbe
removedorconvertedtowildlifeƭƓğŭƭ͵ͼ Itgoesontosaythat,ͻƷŷĻlandownershallreplaceanytrees
thatareremovedwithnewtreeswitharatiooftworeplacementtreesforeachtreeremovedwithinone
yearinaccordancewithanapprovedrestorationplan.ͼInthiscase,thearboristsuggesteachtreeis
hazardousinsomeway,andthatreplacementshouldbethroughtransplantingexistingtressthatare
notreceivingenoughlightfromthedensecanopyonthewestsideofthepropertytoavailableroomon
theeastsideoftheproperty.Becausetherearesomanyexistingtreesonsite,thearboristfeelsthatthe
functionsandvaluesofthetreecovercouldbemadeupbytransplantingsomeoftheexistingsaplings.
Inthisway,proposalgenerallycomplieswiththeintentofthecriticalareascode(Title23)inthatit
wouldbealsosavingsaplingsthatarenotreceivingenoughlightandallowingthemtoflourish
elsewhereontheproperty.
6.PROPOSALSUBMITTED
a.Theproposalistoremove12evergreentrees(mostlyfir)thatareinaweakenedconditionor
dying.Mostappeartobestrugglingtosurviveduetolackoflight.Thearboristnotesthatthe
lotisheavilywoodedandthattherearenumerousevergreensaplingsavailableonsitefor
transplant,andthatnoadditionaltreesshouldbebroughtonsiteforreplacementpurposes.
Thisrecommendationwasmadebecausetheexistingmaturetreesaresoplentifulandprovide
toomuchshadefornewtreestogrow.Someexistingsaplingshavebeenrecommendedtobe
transplantedonsitewhichwouldencouragetheirgrowthandhelpmakeupforthetreesthat
willberemoved.
b.ThetreeswillberemovedusingͻƌƚǞimpacthandƷĻĭŷƓźƨǒĻƭͼ(rigging,brushing,andchunking)
andnoheavyequipmentisproposedtobetakenoffofpavedsurfaces.Thiswilllimitany
detrimenttothesiteandadjacentsites.
c.Thebrushisproposedtobechippedandthechipswillbeusedasmulch.Theconsultingarborist
feelsthattheremovaloftheslated12treeswillhaveminimalimpactonthesurrounding
environment,slopestabilityandnodetrimentalimpacttotheimmediatetreecanopy.
d.Treeͻ\[ͼisconsidereddeadandmaythereforeberemovedimmediately.
e.TheapplicanthasrequestedtheremovalbephasedΑsometreesremovedin2010,somein
2011,andtheremainderin2012(Attachment3).Thisapproachisacceptable(aslongasthe
deadtreeisremovedimmediatelysoasnottocauseharmordamageproperty).
f.Treesthatwillbetransplantedonsiteshouldbetransplantedduringeachphaseofremovaland
inspectionsshouldoccuraftereachphaseofremovalandtransplantationtoensurethatthe
transplantedtreesarehealthyandthriving.

g.Themajorityofthetreesonsitearebeingretained;thetreesproposedtoberemovedare
reasonablynecessarytoachievetheproposedfutureaccessorybuildingwhilemakingroomfor
thetransplantedsaplingstoflourish.Duetothesheervolumeoftreesonsite,thetreesare
beingretainedtothemaximumextentfeasible.
h.Althoughslopesarepresentonsite(2641%),nowetlandsorstreamswereobserved
(CRA20090092).
i.Treesalongthewesternhalfofthepropertywillberetained,whichwillcontributetonoiseand
windprotectionaswellascontinuetoreduceairpollutionbyproducingpureoxygenfrom
carbondioxide.
Theproposal,withconditions,isfoundtobecompliantwithECDCChapters18.45,20.02,20.05,Title23,
andtheComprehensivePlan.
DECISION
BasedontheFindingsofFact,Conclusions,andAttachmentstothisreport,thefollowingdecisionis
issuedbytheCityofEdmondsPlanningDivision.TheTreeCuttingpermitasproposedisAPPROVED
withthefollowingconditions:
1.Allworkshalltakeplaceonprivateproperty,includingthestagingofequipmentfortreeremoval.
2.Lowimpactdevelopmenttechniquesshallbeused:noheavyequipmentshallbetakenoffpaved
surfacesandhandtechniquesshallbeimplemented.
3.TreeremovalshallbepreformedbyaCertifiedArboristandshallfollowtherecommendationsof
thearboristreportsubmittedbySuperiorNWTree&ShrubCare,Inc.(Attachment4).
4.Theevergreensaplingsreferencedinthearboristreportshallbetransplantedonsiteinlieuoftree
replacement(Attachment4).
5.AttheƚǞƓĻƩƭrequest,treeremovalmaybephasedsothattreesA,B,C,andDmayberemoved
in2010,treesL,E,KandHmayberemovedin2011,andtreesJ,I,G,andFmayberemovedin
2012.TreeLshouldberemovedimmediately,however,becausethearboristfeelsitisdead.
6.TheownershallcallthePlanningDivisionat425.771.0220andrequestaninspectiononceeach
phaseofworkhasbeencompleted(includingtransplanting)sothatwemaycloseoutthisfile.
Transplantingreplacementtreesshallbedonewithinoneyearofeachphaseoftreeremoval.
7.Theownershallpaytheremainingbalance($33.88)frompublishingthisŅźƌĻƭnoticeintheEverett
Heraldathisearliestconvenience(Attachment6).
