On behalf of the owner of both legal lots, Bruce Lingle, we request application of International
Building Code (IBC) section 104.11, Alternative Design, in regards to this permit, Under that
provision we request to employ an alternate means to provide the required fire separation distance
listed in Table 602 (Fire rating requirements for exterior wails based on fire separation distances) and
Table 704.8 (Maximum area of exterior wall openings based on fire separation distance) which for
this application requires.a fire separation to the lot line of greater than10 to a lot line.
The purposed alternate means is consists of the recording of the easement that would establish the
equivalent of and alley at the common lot line.
Section 702 of the International Building Code defines "Fite Separation distance" as the distance
from the building face to one of the following:
1. The closest interior lot line;
2. To the centerline of a street, an alley; or public way; or
3. To an imaginary line between two buildings on the same property.
To satisfy the requirement of section 702, provision 2, the property owners propose a driveway
easement be placed on the eastern lot to the benefit of the western lot on which the Collision Clinic is
located. This would result in establishing the equivalent of an alley, which would act in the same
manor as public way, and create a through the recording of the easement a perminate open space,
By granting the use of the alternate means it would allow the fire rating of the existing east building
wall to be one hour, 45% of the openings in the existing wall to be unprotected since the distance
from the building wall to the center line of easement would be 14 feet.
We respectfully request that the alternate means be approved and the permit be issued with the
condition that a new certificate of occupancy for the additional work area not Is issued until the
easement Is recorded.
