STF20080009 Foster zoning compliance.pdf June 10, 2008 Ernest Foster th 18521 79 Place West Edmonds, WA 98026 Subject: ZONING COMPLIANCE LETTER FOR TAX PARCEL ID# 00434600010706 Dear Mr. Foster: In a cover letter dated June 9, 2008, you asked the City of Edmonds to determine whether your above- referenced parcel is buildable according to current City code requirements. According to the City’s information and that which provided you, the parcel is unaddressed, vacant and approximately 52’ x 173’ (8,996 square feet). The parcel is zoned Single Family Residential (RS-8). You also own a separate th parcel addressed 18521 79 Place West (ID# 00471000002600) which is developed with your single- family residence. The parcel with your residence directly abuts the vacant parcel on the northwest (see enclosed map). For a parcel in the RS-8 zone to be buildable, the lot must be at least 70 feet wide. The vacant parcel is only 52 feet wide. As a result, the vacant lot is nonconforming and controlled by Edmonds Community Development Code (ECDC) Section 17.40.030. ECDC 17.40.030.C indicates: If, since the date on which it became nonconforming due to its failure to meet minimum lot size or width criteria, an undeveloped nonconforming lot has been in the same ownership as a contiguous lot or lots, the nonconforming lot is and shall be deemed to have been combined with such contiguous lot or lots…. In other words, your vacant parcel and the parcel with your residence are considered to function as one lot. Since that is the case, and only one single family residence may be established per lot, staff has determined that the vacant parcel (00434600010706) is not buildable for an additional residence. You need to take no further action to continue the lots as they currently exist. However, it may be in your interest to formally join the parcels through the City’s lot combination process.
