Specific answers to each of your site located at 8431 244 questions follow: 1. Zoning designation for subject property and adjacent properties. The current zoning designation of the subject site is General Commercial (CG) pursuant to Edmonds Community Development Code (ECDC) Chapter 16.60. Refer to Attachment 1 for a zoning and vicinity map. The immediately adjacent properties to the north and south and the properties to the east (across Highway 99) are also located within the CG zone. The immediately adjacent properties to the west are located within the Multi-Family Residential (RM-1.5) zone. 2. Is the subject property part of a Planned Unit Development? No. 3. Is the subject property part of an Overlay District? No. 4. The subject property is currently regulated by: The CG zone is regulated by Chapter 16.60 of the Edmonds Community Development Code (ECDC). Refer to the enclosed copy of ECDC 16.60 (Attachment 2) for information on the allowed uses and applicable development regulations for the CG zone. 5. According to the zoning ordinances and regulations for this district, the use of the subject property is: The existing restaurant is a permitted primary use in the CG zone pursuant to ECDC 16.60.010(A). 6. The subject structure(s) was developed: According to Snohomish County Assessor’s records, the existing Denny’s restaurant building was constructed in 1975. The subject site was annexed into the City of Edmonds on October 16, 1995. Therefore, the site was developed prior to annexation into the City of Edmonds. You would need to contact Snohomish County for any records related to permitting and/or zoning requirements that were in place prior to the site’s annexation into the City. Since the site was developed under different regulations than the current CG zoning regulations, it is unknown if there are any nonconforming aspects to the existing development. 7. Information regarding variances, special permits/exceptions, ordinances or conditions: As discussed above, the site was developed prior to its 1995 annexation into the City of Edmonds. It is unknown if any variances, special permits/exceptions, ordinances or conditions were required when the site was developed. You may wish to contact Snohomish County for any information related to such requirements prior to the site’s annexation into the City of Edmonds. 8. Rebuild: In the event of casualty, in whole or in part, the structure located on the subject property: Further study of the site against the provisions of the General Commercial (CG) zone is necessary in order to conclusively determine if any nonconforming issues exist. Any existing nonconforming issues would be subject to the nonconforming regulations and “rebuildability” requirements of ECDC Chapter 17.40 (Attachment 3). 9. Do records show any unresolved zoning code violations? Staff is not aware of any current zoning code violations on the subject site. 10. Site Plan Information: As discussed above, the site was developed prior to its 1995 annexation into the City of Edmonds. You may wish to contact Snohomish County in order to determine if a site plan was required as part of the building permit approval process prior to the site’s annexation into the City of Edmonds. 11. Were Certificates of Occupancy issued? If so, please provide all available copies. Since the site was developed prior to annexation into the City of Edmonds, you may wish to contact Snohomish County to determine whether a certificate of occupancy was issued for the subject development. I hope this addresses your questions. Please note that although the existing building was constructed prior to annexation into the City of Edmonds, various permits have been obtained for the subject site following annexation. These permits mainly include permits for signage, plumbing, design review, and minor interior work. You may access the City’s Online Permit Information by navigating from the City’s homepage (www.edmondswa.gov) to the “Services” tab and then to “Permits/Development.” From the “Online Permit Info” link, you may search for permits by either permit number or address. Please note when typing in the address, it works best to only include the name of the street, but not the St., Ave., etc. after the street name. th St. SW, you would simply type in “8431 Thus, if you wanted to search for permits associated with 8431 244 244.” If you find any permits that you would like to obtain copies of, you may locate the City’s Request for Public Records Form on our website and submit it directly to the City Clerk’s Office. Contact information is included at the top of the form. It would be helpful if you are able to include specific permit numbers in your request in order to assist staff in fulfilling the request.
