RE: Zoning Confirmation Letter for land and improvements commonly known as 22130
Hwy 99, 22211-76`h Ave. W., 22224 Hwy 99, 22304 Hwy 99, 22310 Hwy 99, and 22324 Hwy
99, all in Edmonds, WA 98026 and more particularly described on Exhibit A attached hereto
and made a part hereof (each a "Property" and together, the "Properties").
Dear Mr. Haake,
This Zoning Confirmation Letter is in response to your inquiry for the above -referenced Properties.
The Properties are zoned General Commercial (CG) under the current zoning ordinances within the
City of Edmonds.
The current use of the Properties for auto sales use are permitted by right within the above zoning
classification, and do not require a conditional use permit, and the current buildings (except the
awning of the building located at 22304 Hwy 99), improvements, and use are not considered "legal
non -conforming" or otherwise not conforming to the current zoning classification and regulations.
The aforementioned awning encroaches approximately 2.5 feet into the street setback and is
considered legal non -conforming. Per the City's zoning ordinance, legal non -conforming buildings
may continue; however, the non -conforming aspect of the building may not be expanded.
The Properties comply with all local regulations related to lot area, area of buildings and other
improvements, density, parking, and height; the Properties comply with all development plans issued
at the time the improvements on the land were constructed; and the Properties comprise one or
more legal lots and complies with all subdivision requirements.
As of the date of this letter, there are no uncured code violations with respect to the Property or its
use.

16.60.000 CG zone.
A. This chapter establishes the general commercial zoning district.
B. Definitions. For purposes of this chapter, the following definitions apply:
1. "Amenity space" means outdoor space for uses that are considered to provide an
amenity or benefit to people.
2. "Auto sales use" means facilities for the commercial sale of motor vehicles, including buildings
and areas typically associated with auto sales use, such as areas for the display and storage of
automobiles that are sold or serviced as part of the overall auto sales use.
3. "Frontage" means the front part of a property or building adjacent to a street.
4. "Primary frontage" (or "primary street frontage") means the frontage for a property that is
adjacent to only one street or, for a property that is adjacent to more than one street, the frontage
that is adjacent to the street that is considered primary over any other streets to which the property
is adjacent.
5. "Step -back" means the upper portion of a building that is required to be set (or stepped) further
back than the minimum setback otherwise required by ECDC 1 .020(A).
C. Where this chapter conflicts with any other, this chapter shall prevail for the general commercial
