I. INTRODUCTION
The applicant has applied for a noise variance (Attachment 1) for 3 nights to replace a gas service
serving the Arnie's Restaurant at 300 Admiral Way. The work proposed at this location has been
approved under a separate right-of-way construction permit, ENG20180522, but the applicant has
requested that work at this specific location be approved during the hours 12:00am (midnight) —
7:00am, which is outside the normally approved hours for construction.
The following is staff s analysis and decision on the proposal.
II. FINDINGS AND CONCLUSIONS
A. GENERAL INFORMATION
1. Request: The applicant is requesting a noise variance to replace a gas service.
(Attachment 2)
2. Review Process: A noise variance is a Type I decision pursuant to ECDC 20.01.003. The
director or his/her designee reviews the project and issues an administrative decision
pursuant to ECDC 20.75.050.C.

B. PUBLIC CONVENIENCE — Will the work result in significant delays for transportation,
services, or other customer needs if done only during the day and within the hour restrictions
set out in other parts of ECC Chapter 5.30?
PSE has indicated in their application that there would be significant impact to customers and
deliveries to Arnie's and other businesses at this location should the work be performed
during the day.
C. PUBLIC SAFETY —Does working at night significantly improve safety conditions for the
traveling public and/or construction workers?
PSE has indicated in their application that customers and customer vehicles would be in
direct conflict with their heavy machinery and equipment if work was not performed at night.
In addition, PSE/InfraSource worker safety would be compromised.
D. PUBLIC EXPOSURE — What will be the setting for any proposed work outside of regular
hours? Is it located on an arterial street or in a mostly residential area?
Work will be performed within Admiral Way, under a separate right-of-way construction
permit and will then progress through the parking lot to a meter location on the front of the
building.
E. PUBLIC COSTS —Does a limited amount of authorized work outside of regular hours
established by this chapter save the public significant cost compared to daytime work?
PSE has indicated in their application that night work will save businesses significant cost in
not having to shut down the parking lot, discourage business traffic, and/or be impacted
dining customers with associated construction noise.
F. NOISE REDUCTION MEASURES — Have all reasonable steps been taken to reduce the
impact of any necessary noise outside the standard hours?
PSE will minimize the running of trucks, backhoes, crew trucks, compressors, pumps and
equipment. The area is a commercial business
III. DECISION
Based on the Findings of Fact and Conclusions, the following decision is issued by the City of
Edmonds Development Services Department. The noise variance, is APPROVED with the
following conditions:
1. The noise variance is limited to the hours of 12:00am (midnight) — 7:00am.
2. The noise variance is granted for work between 2/19/2019 — 2/26/2019.
3. Construction activity and associated traffic control shall be performed consistent with
separately approved right-of-way construction permit.
Work performed within the City right-of-way is subject to inspections required under
separate right-of-way construction permit.

4. The grant of a variance shall not relieve any person from the requirements of ECC 5.30.130
relating to public disturbance noises.
IV. APPEALS
Type I permit decisions may be appealed by a party of record to Snohomish County superior
court within 21 days of the date of the decision pursuant to ECDC 20.07.006.

PSE proposes night work at the location of: 300 Admiral Way, Edmonds as this is a busy waterfront
restaurant (Arnie's Restaurant) with preparation and open hours of 6:00 am to 12 am Midnight every
day. This would minimize the noise and traffic disruptions to the business patrons and parking in the
parking lot area. The restaurant has requested that we perform this work at night.
Typical gas equipment/vehicles: Dump truck, trailer, backhoe, 2 Ton Crew Truck, pipe trailer,
compressor, saw cutting equipment, jackhammer, fitting equipment and fitting truck, directional
drilling rig.
Noise mitigation practices will be utilized by the crew such as minimizing the running of trucks,
backhoes, crew trucks when not in use and also minimizing the running of compressors, pumps
and equipment when not in use.
The answers to the 5.30/120 Variances factors are:
1. Public convenience: If done during the day, this will significantly impact Arnie's restaurant
customers & deliveries and other businesses at this location, as we are doing work in the parking
lot and would need to shut down most of the parking for our vehicles/equipment.
2. Public Safety: Night work will avoid any customers and customer vehicles being in direct conflict
with our heavy machinery and equipment, as well as PSE/InfraSource worker safety.
3. Public exposure: The work will be performed in the street directly in front of Arnie's restaurant
for the tie in of the gas service and the cut & cap of the old service. It will then progress through
the parking lot to the meter location on the front of the building. This area is a commercial
business area.
4. Public Cost: The night work will save the business significant cost in not having to shut down the
parking lot or discourage business traffic, as well as noise created for dining customers.
5. Noise reduction measures: Please see attached sheet on equipment and noise mitigation.
