RE- Request for extension of students' stay
Dear Mr. Sumarli,
I am writing in regards to your request for an extension of stay for the five exchange students
currently living in your home. I am aware that you have applied for a building permit with the aim of
receiving approval from the city to convert your garage into living space that includes several
bedrooms. From the photos that were provided to the City, it appears that the new bedrooms are
currently being occupied. Please be aware that, until such time that the permit is issued and all
required inspections have been completed, including final inspection, the City cannot give approval
for occupancy of these new bedrooms. As such, we advise that the use of the space be
discontinued until City approval is obtained.
As you are aware from previous discussions with Mike Clugston of the Planning Division, the City's
zoning code limits the use of a house in a single family residential zone like yours to one "family"; it
cannot be used as a boarding house or any other form of group living except as allowed by code.
According to Section 21.30.010 of the Edmonds Community Development Code (ECDC), "family"
means:
Family means individuals consisting of two or more persons related by genetics, adoption,
or marriage, or a group of five or fewer persons who are not related by genetics, adoption,
or marriage and none of whom are wards of the court unless such wards are related by
genetics, adoption, or marriage to all of the members of such group living in a dwelling
unit.
There is an exception for foreign exchange students, but only two 2 ex har e students are
allowed in addition to the related family members:
A family unit consisting entirely of persons related by genetics, adoption or marriage may
rent a room to a total of two additional renters, or up to two students as a part of a
recognized foreign exchange program or similar educational, nonprofit program, or a
combination of a renter and such student to a total of two additional persons. The
additional renters and/or foreign exchange students, to a maximum of two, shall not be
considered when calculating the number of unrelated persons residing in a dwelling unit
under subsection (D)(1) of this section. Three or more renters and/or students shall be
considered as unrelated individuals and all persons residing in a dwelling unit, regardless
of whether a portion of them are related by genetics, adoption or marriage, shall be
considered when determining the total unrelated persons residing at a site.

As a result, if your family is living at 803X 238`' Street, you may only have two (2) exchange
students living with you at any one time. The Planning Division will be reviewing the building
permit and will place conditions on approval of that permit which emphasize the one "family" limit
plus up to a maximum of two (2) exchange students.
