Dear Mr. Suver,
The City has received a complaint regarding an accessory building constructed into the setbacks of your property. A
building permit is required for accessory structures over 120 square feet. The City shows no records for a building
permit for the accessory structure currently being developed at this address.
The subject property is in the RS-12 Zone which requires a 10 foot side yard setback and a 25 foot street and rear
setback. An accessory structure under 600 square feet may have a reduced setback of 5 feet in the rear yard setback.
Eaves may project into the required setback not more than 30 inches. Height of an accessory building shall be limited
to 15 feet.
Because of the atypical position of your house to the street and easement, it would be necessary for you to visit the

Planning Division on the 2 floor of City Hall to determine which yards would be side, rear or street before
constructing/completing the accessory structure.
Corrective actions required:
Please contact me at your earliest convenience by November 5, 2008 to confirm receipt of this information,

to confirm the size, height and setback of the building and to review the corrective actions. I will be out of
the office from 10/29 through 10/31.
If the building is over 120 square feet, please submit a complete application and fees for a building permit by

November 12, 2008. A handout is enclosed regarding accessory buildings. Or;
If the accessory structure is 120 square feet or less, a building permit is not required. However, the accessory

structure must meet the minimum side, rear and street setbacks regardless of size. A compliance inspection
would be required to confirm the size, height and setbacks of the accessory structure.
