the criteria in the zoning ordinance, he could see no hardship in this case and
recommended denial. Mr.. Swanby explained that the property was purchased for the
view and that the grade level varies from north to south. He would like to :build
the south side up to the level of the )forth side so the driveway entrance could
be on the north side of the property.
Mr, John Henry, a next door neighbor, stated that he hadn't had time to review
.the plans or talk with Mr. Chigaras or Mr. Swanby, Until he had seen an elevation
plan he would be opposed to this request. His property is approximately 5' below
the Chigaras property. Mr. Henry was shown the plan and informed that fence height
near the property line would be 9 or 10 feet above the level of the property line
(4' grade plus a 6' fence), He had no further comment.
Mr. Grant moved that clue to lack of hardship this variance be denied. The motion
was seconded by fir. Luschen and carried unanimously.
Conditional_ Use Permits
ACU -28-67, Jerry H. Heiam - Perni.t for sevc;nth apartment unit on Both Ave, W. northerly
of 196th S.I.-I. as permitted under Sec. 12.13,130 (D) of the Zoning Ordinance
(RHL zone) .
Affidavits of publication and poster were presented. Mr.. Heiam was present. Mr.
Logan advised that -the site contains the nrea for 6,6 apartments. Application is
for one additional unit requiring 11 parking spaces, The revised plot plan
provides for 11 spaccc; however, City code on maneuvering area requires 241 maneuvering
space on perpendicular parking. With a 20' setback shown on the plan, the public
sidewalk would be used as part of the maneuvering area, It was also �,oted that the
back parking area requines.a double turning movement, causing inconvenience. The
applicant said that he had talked iith his architect and assumed the problem had
been taken care of through rearrangement of the parking.
It was moved by Mr. Scott and seconded by Mr. Luschen to approve the request for a
7th unit contingent upon redesign of the parking area arrangement as stipulated in
Iche City Code. Hotion carried unanimously.
