Dear Mr. and Mrs. Von Spreckelsen,
The City received a complaint regarding a fence built in the City right-of-way adjacent to a fire
hydrant. An inspection was made and it was determined that the fence was in violation of ECDC
19.25.070.G. The fence also appears to be over 3 feet within 10 feet of the right-of-way and
located in the right-of-way, initiating permit requirements.
The Edmonds Community Development Code (ECDC) addresses hydrant obstruction as follows:
ECDC 19.25.070 Hydrant specifications.
G, No person shall plant any vegetation, erect any structure or perform any action which results
in the obstruction of afire hydrant for a distance of 50 feet along the immediate route of
approach, The owner -occupant of any area in which a hydrant is located shall be responsible for
removing weed and tree growth from around the hydrant for a distance of not less than five feet.
The purpose of this section is to maintain clear approach and visual area around the hydrant.
Fences over 3 feet in height located within 10 feet of the right-of-way require a fence permit as
follows:
ECDC 17.30.000 General.
A. A fence permit shall be required for any fence over three feet in height which is also within 10
feet of any street right-of-way or access easement or within 30 feet of any corner. Height shall be
measured from the top of the fence to the lowest original grade.

68`h Avenue west has a 50 foot right-of-way. Permanent structures located in the right-of-way
require an encroachment permit as follows:
ECDC 18.70. 000 Permits required.
No person shall use or encroach upon any public place without obtaining a permit from the
development services director or city engineer.
A. Encroachment Permit. An encroachment permit is required to encroach upon any portion of
city public space, right-of-way or easement area with permanent structures. To encroach means
to construct, erect or maintain in, over or under any public place, right-of-way, easement,
roadway, parking strip and/or sidewalk, including the airspace above them, any structures
permanent in nature, including but not limited to, building extension, marquee, fence, retaining
wall or any other building or structure.
Corrective actions required:
• Please contact me at your earliest convenience by June 18, 2010 to review the following
compliance schedule. An Order to Correct is issued if contact is not made.
• Please make a complete application for a fence permit by June 30, 2010. A permit is not
required if the fence is not over 3 feet tall within 10 feet of the right-of-way. A fence
permit application handout is enclosed.
• Please remove the fence to the property line by July 15, 2010. You may choose to apply
for an Encroachment Permit to locate the fence as currently constructed. However, there
is no guarantee a permit would be approved due to the hydrant location and ECDC
19.25.070. If you choose to apply for an Encroachment Permit, please do so by June 30,
2010.
