Subject: Unauthorized Wetland Alteration

Dear Ms. Felton,
In response to the City of Edmonds' October 3, 2014 request for a wetland report and mitigation plan to
address the unauthorized wetland alteration on your property located at 8415 Talbot road, the City
received a Wetland Determination and Enhancement report from Skillings Connolly Inc. dated December
1, 2014.
For unauthorized alterations of a wetland, a wetland report consistent with the requirements of ECDC
23.50.030 assessing the impact of the clearing activity must be prepared and submitted to the City along
with a restoration plan consistent with the requirements of ECDC 23.40.240.8 and C. The December 1,
2014 Wetland Determination and Enhancement report from Skillings Connolly Inc. does not meet these
requirements. The report also has inconsistencies which must be corrected. Please have the report
updated to address the following:
1. Assessment of clearing activity: The report does not address the impact the clearing activity had
on the wetland. The wetland report only notes the wetland had undergone "aggressive pruning."
The wetland report must specifically describe the activity that occurred (species that were cut,
how many, and to what extent of the wetland) and what impact that had on the structural and
functional values of the wetland.
2. Mitigation Plan: The mitigation plan is not consistent with the requirements of
ECDC 23.40.240.0 (Minimum Performance Standards for Restoration) or ECDC 23.40.130
(Mitigation Plan Requirements).
a. The mitigation plan must note how the structural and functional values, including water
quality and habitat functions, are being restored.
b. Detailed plans are required. The report mentions planting buffers, but does not identify
species quantities, density of plantings or sizes.
i. Provide a planting plan specifying plant species, quantities, locations, size,
spacing, and density.
ii. Provide details on erosion and sediment control features as necessary.
iii. Provide measures to protect and maintain plants until established.
c. Please include a section addressing the Environmental Goals and Objectives as outlined
in ECDC 23.40.130.A.
d. Contingency Plan. Please provide more detail on the correct measures to be taken if
monitoring indicates the performance standards are not being met.
3. Inconsistencies in the report.
a. The report notes monitoring reports will be submitted to Snohomish County and
references "County" code in a few places. Reports must be submitted to the City of
Edmonds and the code references are to the Edmonds Community Development Code
(ECDC).
b. Page 2 of the report and the wetland rating form in Exhibit 3 note that the wetland is a
Category III wetland. The wetland summary on Page 5 indicate the wetland is a
Category IV wetland and buffers described and shown in the report are for Category IV
wetlands. According to the wetland rating form, the wetland is a Category III wetland
which requires 50 -foot buffers pursuant to ECDC 23.50.040.F. Please correct the
wetland category to Category III throughout the report and apply Category III wetland
buffers.
c. Wetland delineation. Please accurately depict the wetland on the subject property. It is
not likely wetland is a perfect oval.
Please submit an updated wetland and mitigation report by December 19, 2014.
