The Order to Correct (enclosed) for paving the right-of-way (ROW) without a ROW construction
permit was issued on April 13, 2011 and expired on May 2, 2011. At this point in the
enforcement process, the City is obligated to issue fines of $100.00 per day that the violation
exists.
The City is hesitant to use the Notice of Violation fines in situations where a simple "after the
fact" permit is required. The reasoning being that the City presumes that it makes more sense to
allocate any funds toward violation corrections instead of adding costs to those corrections. In
the majority of cases when a property owner is advised of a required permit, the property owner
will choose the opportunity to comply rather than spend additional time and money in the
enforcement process.
In some cases, property owners will ignore City requests or simply not communicate. In these
cases the City has no other option but to continue the standard enforcement process - 1) request,
2) Order to Correct, 3) Notice of Violation and fines. In these cases property owners find they
owe hundreds, and in some cases, thousands of dollars in fines. Please be advised that once the
Notice of Violation fines are issued I can not withdraw them and they are in effect until the
violation is corrected.
Accordingly, unless a complete ROW construction permit application is received by June 10,
2011, the City would be obligated to issue a Notice of Violation and the property owner will
accumulate fines of $100 per day until the property is in compliance.
