To Whom It May Concern: This letter is in response to your inquiry received on September 22, 2008 regarding Wooday Estates located at 23,000 Edmonds Way in Edmonds, Washington. Please refer to the attached page from the City's address book to ensure that the highlighted property is the site that you are enquiring about. Specific answers to each of your questions follow: 1. What is the current zoning of the property?_ Is it part of a Planned Development? The current zoning of the site is RM 1.5 (Multiple Residential) pursuant to Edmonds Community Development Code {ECDC) Chapter 16.30. Please refer to the attached copy of ECDC Chapter 16.30 for information on the allowable uses and applicable development regulations for the RM 1.5 zone. The City of Edmonds has "Planned Residential Developments," but not "Planned Unit Developments." This property was not a "Planned Residential Development." 2. Are there any overlay districts? The property is not located within any of the City of Edmonds overlay districts. 3. Is this property a permitted use in this district? Please refer to the enclosed ECDC Chapter 16.30 for information on allowable uses for the RM 1.5 zone. ECDC 16.30 requires 1,500 square feet per dwelling unit. According to the Snohomish County website, Woodway Estates are a 34 unit apartment complex. According to the City of Edmonds parcel information, the parcel consists of approximately 68,234 • Incorporated August 11, 1890 • Sister City - Hekinan, Japan square feet. Given the size of the property and the RM 1.5 zone, a 34 unit apartment complex is a permitted use. 4. Did the property receive site plan approval? The property at 23,000 Edmonds Way was annexed into the City in 1997. Based on Snohomish county Assessor records, the building was constructed in 1989. since the building was constructed prior to annexation, any site plans approved for the initial development of the site would be located with the County. The Snohomish County Planning and Development Services Department can be contact at 425-388-3311. 5. What are the abutting zoning districts? Please refer to the enclosed Zoning and Vicinity Map. The adjacent property to the south and west is zoned RS -8 (Single-family Residential). The adjacent property to north is zoned RM 1.5. The property between the subject site on Edmonds Way is zoned RM -EW (Multiple Residential — Edmonds Way). 6. Are there any outstanding building or zoning violations on file? The City's Building Official has indicated that she is not aware of any current building code violations on the subject property. The City's Code Enforcement Officer has indicated that he is not aware of any current zoning violations on the subject property. 7. Were any variances, conditional or special use permits issued? As previously stated, the property was annexed in the City in 1997 and the building was constructed in 1989. Any variances, conditional or special use permits issued with the original building construction would be located with the County. The Snohomish County Planning and Development Services Department can be contact at 425-388-3311. No variances, conditional or special use permits have been issued for the property by the City of Edmonds since it was annexed in 1997. 8. Was a certificate of occupancy issued? As previously stated, the property was annexed in the City in 1997 and the building was constructed in 1989. The building was constructed when it was under Snohomish County jurisdiction. The county would have the certificated of occupancy. 9. Are there any pending or anticipated changes to the zoning ordinance or proposed rezonings that might affect this property in the near future? There does not appear to be any pending or anticipated changes to the zoning ordinance nor any proposed rezones that might affect this property in the near future.
