RE: Zoning Confirmation Letter for Pacific Park Apartments, 23231 Highway 99,
Edmonds WA 98026
Dear Mr. Breaux:
This letter is in response to your inquiry received on July 25, 2008 regarding the Pacific
Park Apartments at 23231 Highway 99 in Edmonds. The address book that we typically
use lists the address for this property as 23207 Highway 99; however, our street file for
this property includes the addresses of 23211, 23213, 23215, 23223, 23229 and 23231
Highway 99. The zoning and Comprehensive Plan designations are based on the parcel
addressed 23207 in our address book (see enclosed vicinity map). Specific answers to
your requested information are listed below:
The land which Pacific Park Apartments is constructed is currently zoned CG
("General Commercial") pursuant to Edmonds Community Development Code
(ECDC) Chapter 16.60. Please refer to the attached copy of ECDC Chapter 16.60 for
information on the allowable uses and applicable development regulations. The
property is also located within the "Highway 99 Corridor" Comprehensive Plan
designation. Please refer to the goals of the Highway 99 corridor in the attached
section of the Comprehensive Plan.
The project is currently non -conforming in the following respects. Per ECDC
16.60.010.0.1, residential uses are prohibited from being located within the first or
second story of any structure within the "Highway 99 Corridor" designation. Thus,
the use of apartments within the first two stories on the subject property does not
comply with the current zoning code requirements. The Pacific Park Apartments
were legally constructed and will be allowed to be continued pursuant to ECDC
17.40.010, as a legal nonconforming use (see enclosed copy of ECDC 17.40).
ECDC 17.40.010.G provides the City's current regulations for re-establishing a
nonconforming use. Please note that the City is currently rewriting Chapter 17.40
(Nonconforming Uses, Building, Signs, and Lots). Therefore, the regulations for
continuing and/or re-establishing a nonconforming use may change with the code
rewrite.

2. The parking requirements for multifamily residential units such as the Pacific Park
Apartments depend on the number of bedrooms per dwelling unit pursuant to ECDC
17.50.020.A.1.b (enclosed). 1 was not able to determine the number and.types of
dwelling units from the information available to calculate the parking spaces required
for the site. Please refer to ECDC 17.50.020 for information on City of Edmonds
parking requirements and to calculate how many spaces are required.
3. The City's Code Enforcement Officer and Building Official have both indicated that
there are no current zoning or building code violations on the subject property that
they are aware of.
The Building Official has requested you submit a Request for Public Records in order to
receive copies of Certificates of Occupancy and building permits for the subject site. A
Request for Public Records is enclosed.
