INTRODUCTION: The owner is constructing a new home at this address and wishes to include an accessory dwelling unit in the design. B. ANALYSIS: Section 20.21.030 of the Edmonds Community Development Code provides the criteria by which Accessory Dwelling Units are to be reviewed. 1. Number of existing Accessory Dwelling Units on site: The proposal will result in only one ADU. Size: Maximum Allowed Proposed 40% of livable area of the primary dwelling 36 % 2 bedrooms 2 bedroom 800 s . ft. 794 square feet 3. Location and Appearance: The proposed ADU is located within the proposed house on the second floor. The owner has chosen to have a low-level street -front profile, that steps up towards the rear of the property to provide the necessary room, instead of having a more massive two-story front along the street. The accessory dwelling unit is incorporated into the design of the principal dwelling with similar roof pitches and detailing on the trim, as well as materials and color. The home is a slightly unusual design, but essentially maintains a single-family appearance (see Attachment 3). The entrance to the ADU (at the rear) is not visible from the street. The site will be required to have only one water and electric meter. 4. Parking: The site will provide two parking spaces within the garage and one space off of Maple Street in an uncovered driveway (see Attachment 4). 5. Occupancy: The applicant has provided a signed and notarized affidavit stating she will occupy one of the units for a minimum of six months of the year (see Attachment 5). 6. Safety, Light, Ventilation: As a condition of approval, the applicant will be required to apply for a revision to their building permit to ensure the Accessory Dwelling Unit meets the requirements of all life -safety codes and standards. 7. Public Comments: No letters of comment have been received on this request. �Nw' Page 2 Priebe ADU File No. ADU-05-30 C. DECISION: Approved with the followine conditions: 1. This permit shall expire automatically if any of the following issues arise: a. The Accessory Dwelling unit is substantially altered and is thus no longer in conformance with the plans and drawings reviewed and approved by the permitting authority and building official. b. The subject site ceases to maintain the required number of parking spaces. c. The property owner ceases to reside in either the primary residence or the accessory dwelling unit, the owner -occupied unit is rented, or the current (or future) owner fails to file the affidavit required under ECDC 20.21.025.A.1. 2. An approved building permit, and a final inspection through the City Building Division is required prior to occupancy of the Accessory Dwelling Unit. 3. The Accessory Dwelling Unit Covenant requires the following prior to recording: a. Include a legal description of the property on the covenant. If additional pages are needed, the fees to record will increase. b. Make sure the form meets Snohomish County's requirements for recording, including no marks in the margins, and the notary's stamp should not cover other writing. 4. The Accessory Dwelling Unit Covenant must be filed with the Snohomish County Auditor. Prior to occupancy of the accessory dwelling unit the applicant must either: a. Provide the city recording fee charge of $15 plus the County recording fee of $19 for one page, for a total of $34.00, and the City will record the covenant; OR b. Take the covenant to the County and record it, and return a copy of the recorded copy to the Edmonds Planning Division with the Auditor's recording sticker on it. 5. The Accessory Dwelling unit permit is transferable to new owners of the subject property unless there is a violation of any conditions of approval listed above. Meg GruwW, Planning Division -/k/ G Date Request for Reconsideration Section 2095.050.B.2. provides for Staff to reconsider his/her decision or recommendation if a written request for reconsideration is filed by the applicant within ten (10) working days of the date of the initial decision. The reconsideration request must cite specific references to the findings and/or the criteria contained in the ordinances governing the type of application being reviewed, and include the fee. Appeals Section 20.105.010,A describes how appeals of a Staff decision shall be made. The appeal shall be made in writing, and shall include the decision being appealed along with the name of the project applicant and the date of the decision, the name and address of the individual or group appealing the decision, their interest in the matter, and reasons why the appellant believes the decision to be wrong, and the fee. The appeal must be filed with the Development Services Director within fourteen (14) calendar days after the date of the decision being appealed. Appeals are presented to the Hearing Examiner. Timeframes The time limits for Reconsiderations and Appeals run concurrently. If a request for reconsideration is filed before the time limit for filing an appeal has expired, the time "clock" for filing an appeal is stopped until a decision on the reconsideration request is completed. Once the staff has issued their decision on the reconsideration request, the time clock for filing an appeal continues from the point it was stopped.
