The purpose of this letter is to inform you that the City has received a formal citizen's complaint about
exposed plumbing piping on the north side of the building at 204 6 1h Avenue North owned by Corpus
Christi Chapel. Upon receipt of the complaint I dispatched our City Building Inspector to the site to
perform an..i.rispection. Although no one answered at the door, he was able to view from the City
alleyway, the.. exposed piping which appears to be connected to a groundwater sump pump. The piping
discharges from the sump pump onto. a splashblock in the City alleyway. A plumbing permit is
required for this work and unfortunately, a search of our records did not show a permit issued to this
address. Although you may have relied on your installer to obtain such permit, our State laws hold -the
property owner(s) responsible in such matters.
Please contact the City for the purpose of applying for, and obtaining, the required plumbing permit by
April 29t",' 2004. Be advised, the City shall charge a violation compliance fee since work was
perfon-ned in advance of permit issuance. On a sidenote it is highly likely that an electrical permit
would also be required for this work and I strongly suggest that you verify that such pem-iit was
obtained.
Lastly, because the piping discharges onto the City alleyway review by our City Public Works and
Engineering Division will be performed (at an additional charge) although it is highly unlikely that this
configuration will be approved.
If there are circumstances beyond your control that will prevent you or your installer from meeting this
deadline please contact my office in writing. If you have any other questions please feel free to contact

WHEREAS, the Planning Commission of the City of Edmonds,
pursuant to proper notice and publication, held a public hearing on
a proposal to grant a Conditional Use Permit to the Church of the
Open Bible; and,
'WHEREAS, the proposed use is in harmony and compatible
with the public uses nearby; and
WHEREAS, adjacent property is owned by the Church and no
screening appears necessary; and
WHEREAS, access is readily available for.auto and pedestrian
traffic; and
WHEREAS, there is a finding of no significant adverse
environmental impact on the proposal; and
WHEREAS, such action is consistent with the promotion of

REPORT FROM COUNCIL
Councilman Larry Naughten reported that the City Council last evening had approved
the 1979 Budget and lie had been told that this year's budget process had been one of
the smoothest in recent years.

CU-49-78 CHURCH OF THE OPEN BIBLE - Conditional Use Perini ' t to use parsonage
for Sunday school classes and -for other related youth activities at
210 6th Ave. N. (RMH)
Mrs. Block showed slides of the building proposed to be used for youth
activities. Several months ago the church had requested a Conditional
Use Permit to use the two small adjacent houses for these activities
but they have since changed their plans and now propose to use the
existing parsonage for such purposes. General hours of usage would be
10:00 .- 11:00 a.m. and 6:00 - 7:00 p.m. on Sundays, and 7:00 - 9:00.p.m.
on Wednesdays. The building would also be used for a Sunday school office
at other.times. Mrs. Block indicated that it did not appear necessary
to impose specific hour restrictions because the church had been at
this location for many years with no complaints from neighbors. She
reviewed the Conditional Use Permit criteria, noting that parking
requirements which would be applicable to a new building were not met.
Some parking could be provided at the back of the property and the
Planning Department was recommending that nine parking stalls be required
as a condition of the Permit. Tile site is generally surrounded by public
uses so this activity would be.compatible with those uses. It is bounded
by the church on the south and by an alley on the north. There are no
residential uses immediately adjacent to it, the Civic Center being to
the �%,est and the Junior High School playfield north of the alley. There
should be no significant adverse environmental impact from the g.ranting
of this permit. Mrs. Block recommended approval, subject to providinq
nine parking spaces, because the general use has been existing in this -
location for a number of years with no evidence of any detriment to the
surrounding area; tile proposed Use is compatible with the public uses
nearby; the only property adjacent to the parsonage is owned by the
church and no screening appears necessary; and access is readily avail-
able for auto and pedestrian traffic. The public portion of the hearing

was opened, no one wished to speak, and the public portion was closed.
COMMISSIONER WALKER MOVED, SECONDED BY, COMMISSIONER LaBELLE, TO APPROVE
CU-49-78, SUBJECT TO NINE PARKING SPACES BEING PROVIDED, FOR THE REASONS
STATED BY MRS. BLOCK IN HER RECOMMENDATION. MOTION CARRIED. Commissioner
Hall.suggested that participants in the church activities be apprised of
the limited parking in this area and be asked not to use.the Civic Center
parking lot on Wednesday evenings.
PRD-4-78 "WOODLAKE CONDOS" - Proposal for 8-unit planned residential development
located -on the west side of 83rd Ave.-W., south of 208th St. S.W. (RS-8)
Mrs. Block said the applicant had asked that this item be continued
until further notice as they are working on an alternative plan. She
said the item will be reposted when it is ready to be reviewed. COMMIS-
SIbNER SMITH MOVED, SECONDED BY COMMISSIONER HALL, TO C'ONfINUE PRD-4-78
UNTIL. SUCH TIME AS THE APPLICANT SUBMITS A REVISED APPLICATION. MOTION
CARRIED.
ZO-12-78 Amendment to Section 12.15.100 of the Zoning Code to allow for the
restoration of nonconforming residential buildings damaged in excess
of 50% actual valuation, if such buildings were legal at the �ime of
original construction.
Mr. LaTourelle indicated the proposed amendnient would apply only to
residential structures, both single family and multi -family. It had
been brought to his attention that problems had arisen in financing
reconstruction of multi -family structures because insuran ce proceeds
were required to be used for rebuilding the damaged building but the
City Code required that buildings which had been nonconforming would
have to be reconstructed in conformance with all regulations. In some
cases, because of recent Code cha.nges, where there may have been a multi-
family structure, the number of units permitted under reconstruction
would be reduced. In the case of a condominium there would be the problem
of whose units could not be rebuilt, as well as other unusual problems.
Mr. Larourelle pointed out that the incidence of situations such as these
would be very low. He felt that the remedy currently required if a
nonconforming residential structure were destroyed was unnece55aryoverkill
inthat complete abatement of the building would be'required. The proposal
would not allow any increase in the degree of nonconformity, but would
allow a nonconforming residential building, if conforming at the time of
original construction, to be reconstructed to that nonconforTiling state.
The.public portion of the hearing was opened, no one wished to speak,
and the public portion was closed. Commissioner Smith commented that
this was a long overdue amendment. Commissioner Walker congratulated.
the Staff on this proposal, feeling it reflected progressive thinking. -
Commissioner LaBelle agreed, discussed several of the points, and asked
for reasoning behind the requirement that the reconstruction be commenced
within one year of the date of damage. Mr. LaTOLIrelle noted that in
most cases if the ov.1ner intended to rebuild lie %qoUld do so imi ' iiediately,
but without the time limitation a person could hold a piece of property
for 10-15 years and then decide to rebuild when it.might then clearly
be an affront to the neighborhood. COI-IMISSIONER WALKER MOVED, SECONDED

R-11-78 JAMES GAYLORD - Rezone from R11 to BN the property located at 8301 212th*

Mrs.. Block showed slides of this property. The intent was to modify an
existing single family dwelling and establish an insurance office there
for the applicant and several other professional offices within the
building. The applicant had proposed a contract rezone to BN for office
use as specified by'Section 12.13.150(2) or residential uses as specified
by Section 12.13.150(3). No retail sales would be allowed but mixed
residential/OffiCe USeS could be allowed. The site has no unique
topographic or natural features. The Comprehensive Plan shoas the general
area to be commercial with 11ML around it. A private road has been
developed to the immediate west of this site to serve the R11 property

I have reviewed your account and will allow a credit for the billing period between
May 29, 1998 through September 30, 1998 in accordance with our City policy. The policy
states that the customer will be billed at the retail rate based upon the average water
consumption for the same period during the previous year. In addition, the excess water
lost from the leak will be billed to customer at the City's wholesale rate with a 15%
surcharge added for administrative cost. Only one leak credit will be granted in any three-

Upon discussion with our pastor, Fr. Hunter, I discovered, that about a month ago when he made
his weekly visit to the chapel on a Friday, Father was greeted by a gusher. Apparantly, an air
blowout valve at the sprinklers burst spewing gallons of water for an undermined amount of
time.
In view of this and our previous discussion, we are requesting a retab of our water bill based on a
wholesale price and our previous normal usage. Enclosed is the bill previously sent us by the
city.
