As you are aware, the next public hearing is scheduled for April 20, 2004 where public testimony and comment will be taken. I hope you plan to attend. Regarding the proposed changes to the Meadowdale Map, the additional buffer area that will be considered ,by Council is an approximate number. The purpose of the buffer is to account for original map inaccuracies since no topographic survey was completed to create the first map and also to account for the last twenty years of erosion and slope failures. As you heard last week, staff is recommending the more conservative 200 foot buffer. The City Council will however make the final decision. As you noted in our meeting, a portion of your property on Tract X and Lot 2 is currently designated on the GeoEngineers map as being within the Meadowdale landslide hazard area and thus already subject to Meadowdale (ECDC 19.05) permit review. At the meeting you provided a map of your platted lots, showing an extended buffer of 200 feet; you understood that the remaining platted lots (Lots 3 & 4) would be subject to (at a minimum) preliminary Meadowdale permit applicability review if Council accepts the 200 foot buffer. The concept for reviewing lots located within a mapped buffer area(s) would be to require a geotechnical report and letter detailing geotechnical reasons why the lot development should not be subject to the Meadowdale provisions. Incorporated August 11, 1890 Sister City - Hekinan, Japan • Mr. Lehn March 30, 2004 Page Two Upon receipt of the geotechnical report and letter, the building official reviews the materials and makes a recommendation to the Director for waiver, partial waiver, full implementation or partial implementation of Meadowdale provisions for development. The building official may confer with a City consultant in making this recommendation. The Director then renders a decision which is appealable to Snohomish County Superior Court. As the Director stated, it is possible that one geotechnical report can adequately address individual lots within a development provided enough individual development detail is provided. Since you have indicated you already have a geotechnical report for your plat, the next step is to check the report against the attached geotechnical guidelines to be sure the report is complete based on the individual design of the future houses. If items are missing the engineer will be required to supplement the report. Your engineer could also be considering at this time geotechnical reasons why the upper most eastern lot pads of Lot 3 & 4, may be waived from Meadowdale development provisions (in case the map buffer concept is adopted by Council). Regarding green built dwellings, I have contemplated how your designs should be reviewed subject to current UBC 104.2.8 Alternate Designs and Methods. For each green component (i.e., soil roof, structural panels, etc.) you shall be required to submit a formal request for alternate design. Note, pursuant to the current UBC provisions, you must prove that the alternate is equivalent to that prescribed in the code for suitability, strength, effectiveness, fire resistance, durability, safety and sanitation. Evidence or proof must be submitted to substantiate any. claims made regarding the components' use. The current fee for each alternate design proposal is $180.00 plus cost of City Attorney time (if required). As a reminder, the effective date for adoption of the International Codes is July 1, 2004. Any request for alternate design submitted after July 1, 2004 must adhere to International Building Code Section 104.11 (copy enclosed). As the Director noted, you may submit your requests for alternate design well in advance of permit application submittal in order to expedite the future permit review process. Graf Building Official • GEOTECHNICAL REPORT GUIDELINES MINIMUM GUIDRLINES FOR SITE INVESTIGATION, EVALUATION, ANALYSIS AND RECOMMENDATIONS ONSTABILIZING MEASURES FOR GEOTECHNICAL REPORTS GENERAL PROVISIONS 1. The owner shall be responsible to submit a geotechnical report (herein report) that shallbe prepared, signed and stamped by a Civil Engineer (herein engineer) specializing in Geotechnical Engineering licensed by the State of Washington. The report shall include an evaluation and analysis of soil and groundwater conditions and shall be supported. by field investigations and appropriate subsurface explorations. If the evaluation involves geologic evaluations or interpretations, the report shall be reviewed and signed by a qualified state licensed Geologist. A letter of concurrence from the geologist shall be included in the report. If any requirement of ECDC Chapter 19.05 or Ordinance #2661 is determined to be irrelevant by the engineer, the report shall provide sufficient information to demonstrate why the item is inapplicable. (ECDC 19.05.030B) 2. Reports shall address comments received from governmental agencies, and the public in general, concerning geotechnical and other related aspects of the proposed project, as developed from the Critical Areas Checklist, Environmental Checklist and general permit review process. The City may require such supplements or amendments to the report as are needed to develop a reasonably comprehensive understanding of the site soil and groundwater conditions. (ECDC 19.05.0308#2) 3. Within the mapped limits of the Meadowdale landslide area, a general discussion of the site, based on the Roger Lowe Associates report of 10/16/79, and the 2/28/85 GeoEngineers supplement, without an investigation including site specific explorations, is not sufficient. This requirement is based on the City's understanding that soil and groundwater conditions can vary considerably over short distances within the Meadowdale landslide area, and that these geologic' changes can significantly affect the design of structures. Outside the mapped limits of the Meadowdale. landslide area, the report.must provide subsurface data to support the engineer's conclusions regarding slope stability. In such unmapped Earth Subsidence and Landslide Hazard Areas the engineer must conclude that the site is stable, as defined by Ordinance #2661. 4. The report shall to UBC Chapter 18 and be site specific, based on the legal description of the permit application, and include a scaled plot plan prepared prior to conducting any soils investigations. The plot plan shall be included in the report and show all existing and proposed structures, utilities, floor grades, excavation levels and grade contour lines. Exploration test pits and/or boring locations shall be clearly identified. The discussion of the site shall include all findings and test data on the existing surface and subsurface conditions, groundwater levels, soil engineering characteristics, capacities and classifications; including geology, soil/bedrock, stratigraphy. The report shall include an analysis of potential impacts on surrounding adjacent properties with respect to these items. The report shall include all findings and test data on site soil and groundwater conditions, including but not limited to: soilstrength characteristics, soil classification and density, unique landfomms or landslide boundaries, and groundwater elevations (referenced to a reproducible datum). 4WmD.bid&/hEWMVMCNbW MC chwi jWtEVIM2 PW 10 5. A vicinity map shall be included and shall show existing sewer and drainage facilities within 50 feet. of the site. The report shall include a discussion of proposed underground utilities, including recommendations -for the possible need of flexible connections at points of entry to the structures. 6. The report shall contain the engineer's opinions, conclusions, and recommendations on the present stability of the site, stability during construction, and the anticipated stability after development is completed. The engineer's opinion shall be stated in terns of degree of risk at each of the above stages of development and the potential of damage to abutting properties. The engineer shall address all forms of earth movement, including but not limited to: slumps, debris avalanches, earth flows, debris falls, mud flows, and/or deep seated rotational or complex landslides. The issue of site stability shall be a focal point during all phases of design and construction. The landslide history of the area and the landslide history and/or probability on the specific site should be discussed. 7. At a minimum, provide one cross-section extending across the site drawn. perpendicular to existing contours. This cross-section shall show soil and groundwater conditions as identified by explorations and shall show proposed .structures(s) including proposed finished floor elevations superimposed on the cross- section. 8. In order to assist the engineer in arriving at valid conclusions, and in order to properly evaluate the site groundwater conditions it may be necessary to install piezometers. The location: and number shall be determined by the engineer or geologist and shall .be installed and abandoned per WAC Chapter 173-160. The readings from regular monitoring of the piezometers shall be plotted showing the groundwater level in comparison to rainfall and also in comparison to density of construction. By measuring, groundwater level information can be developed indicating the impact of wet and dry seasons and the impact of development as it effects the degree of risk for future slide or earth subsidence.: When piezometers are not installed, the engineer or geologist must provide a. description of groundwater conditions based on other criteria or observations such as observed seepages in test pits or natural springs. If unusual odors, soil, surface water, groundwater and/or debris, suspected of being contaminated exists, the City and appropriate statelfederal agencies shall be immediately notified. SPECIFIC PROVISIONS The following specific provisions are also required in the report to address site specific issues and/or constraints. 1. Site preparation, including recommendations for. site clearing,. grubbing and excavation. Provide recommendations for all temporary and permanent cut and fill slopes. Address protection of adjacent properties. 2. For grading and earthwork include procedures for compaction and type of fill material required. 3. Specify the use of site soils for fill or backfill and shoring requirements during construction. Discuss temporary cut slopes greater than 2:1 and excavations greater than eight (8) feet in depth for temporary and permanent slope protection. Specifications must be provided for all types of fill anticipated for use during the project, including but not limited to: general site fill, wall backfill and fill under footings and floor slabs. 4toP:bldVIMWW MCWOW/Md cbwkjlgREV12/02 Pale 11 4. Based on the criteria in UBC Chapter 18 and requirements for Seismic Zone 3, the report shall include recommendations and construction components for a site specific foundation plan. Soil bearing capacities. and soil horizons capable of supporting foundations and/or slabs shall be called out. Recommendations shall be made for provisions to minimize the effects of expansive soils, adjacent loads, and the expected total and differential settlement. Submit calculations on the allowable foundation and lateral pressures to substantiate the classification. For conventional foundations the degree of stiffness or strength of the structural foundation must be called out. This could be provided in terms of the foundation being able to span a given distance between any two support points or by use of other definitive criteria. Comment on the need,` if any, for. tying isolated footings together in two directions to provide additional resistance to displacement in the event of earth movement. 5. For the design of retaining walls, recommend values for passive and active pressures and coefficients of friction. For pile foundations, explorations must extend to. at least the depth. of recommended pile penetration. Allowable axial and lateral loads on piles shall be determined by an accepted method and calculations supporting these loads must be provided. 6. Temporary and permanent erosion control and other measures designed to reduce the risk of slope instability must be addressed. Include the number and placement of drains, mode of construction (including temporary slope angles and/or the need for shoring/trench boxes) and approved discharge locations. Specify permanent site drainage and maintenance requirements. Note: These provisions may require that the engineer restrict construction- during certain times of the year. 7. Address the criteria called out in the critical areas and environmental checklist.. All aspects of both checklists shall be addressed and answered in the report. Discuss the need for the preservation and maintenance or replanting of natural vegetation at the site, including trees and shrubs. 8. Provide recommendations for temporary shoring and/or requirements for obtaining temporary or permanent slope easements on neighboring properties. Include measures for protection of adjacent public and private utilities. Provisions in Chapter 296-155 WAC Part N and Chapter 296-62 WAC Part M must be incorporated where applicable. . ADMINISTRATION be recorded and entered in the files of the department of build- ing safety. 104.11 Alternative materials, design and methods of con- struction and equipment. The provisions of this code are not intended to prevent the installation of any material or to pro- hibit any design or method of construction not specifically pre- scribed by this code, provided that any such alternative has been approved. An alternative material, design or method of construction shall be approved where the building official finds that the proposed design is satisfactory and complies with the intent of the provisions of this code, and that the material, method or work offered is, for the purpose intended, at least the equivalent of that prescribed in this code in quality, strength, ef- fectiveness, fire resistance, durability and safety. 104.11.1 Research reports. Supporting data, where neces- sary to assist in the approval of materials or assemblies not specifically provided for in this code, shall consist of valid research reports from approved sources. 104.11.2 Tests. Whenever there is insufficient evidence of compliance with the provisions of this code, or evidence that a material or method does not conform to the requirements of this code, or in order to substantiate claims for alternative materials or methods, the building official shall have the au- thority to require tests as evidence of compliance to be made at no expense to the jurisdiction. Test methods shall be as specified in this code or by other recognized test standards. In the absence of recognized and accepted test methods, the building official shall approve the testing procedures. Tests shall be performed by an approved agency. Reports of such tests shall be retained by the building official for the period required for retention of public records. SECTION 105 PERMITS 105.1 Required. Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install, en- large, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by this code, or to cause any such work to be done, shall first make application to the building official and obtain the required permit. 105.1.1 Annual permit. In lieu of an individual permit for each alteration to an already approved electrical,, gas, me- chanical or plumbing installation, the building official is au- thorized to issue an annual permit upon application therefor to any person, firm or corporation regularly employing one or more qualified tradepersons in the building, structure or on the premises owned or operated by the applicant for the permit. 105.1.2 Annual permit records. The person to whom an annual permit is issued shall keep a detailed record of alter- ations made under such annual permit. The building official shall have access to such records at all times or such records shall be filed with the building official as designated. 105.2 Work exempt from permit. Exemptions from permit requirements of this code shall not be deemed to grant authori- zation for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Permits shall not be required for the following: Building: 1, One-story detached accessory structures used as tool and storage sheds, playhouses and similar uses, provided the floor area does not exceed 120 square feet (11.15 m2). 2. Fences not over 6 feet (1829 mm) high. 3. Oil derricks. 4. Retaining walls which are not over 4 feet (1219 mm) in height measured from the bottom of the footing to the top of the wall, unless supporting a surcharge or impounding Class I, II or III -A liquids. 5. Water tanks supported directly on grade if the capac- ity does not exceed 5,000 gallons (18 925 Q and the ratio of height to diameter or width does not exceed 2 to 1. 6. Sidewalks and driveways not more than 30 inches (762 mm) above grade and not over any basement or story below and which are not part of an accessible route. 7. Painting, papering, tiling, carpeting, cabinets, coun- ter tops and similar finish work. 8. Temporary motion picture, television and. theater stage sets and scenery. 9. Prefabricated swimming pools accessory to a Group R-3 occupancy, as applicable in Section 101.2, which are less than 24 inches (610 mm) deep, do not exceed 5,000 gallons (18 925 Q and are installed en- tirely above ground. 10. Shade cloth structures constructed for nursery or ag- ricultural purposes and not including service sys- tems. 11. Swings and other playground equipment accessory to detached one- and two-family dwellings. 12.
