I. SUMMARY
Diamond Parking Services is requesting a conditional use permit to establish commercial
parking at several existing parking lots at 306 Main Street, the Bank of America site. The
sites are zoned Downtown Business (BD1 and BD2). The parking lots are privately
owned and have been managed for private and public use for many years. There will be
no change to access or the parking lots themselves, just the establishment of paid
parking on portions of the lots.
The project appears to be in compliance with the conditional use permit criteria in
Chapter 20.05 of the Edmonds Community Development Code (ECDC); staff
recommends approval with conditions.
II. PROCESS
A conditional use permit for commercial parking in the BD1 and BD2 zones requires a
Type III-B decision pursuant to Section 20.01.003 ECDC. The Hearing Examiner makes
the decision following a public hearing.

IV. FINDINGS OF FACT, ANALYSIS AND CONCLUSIONS
A. Setting
The Bank of America site is at the southeast corner of Main Street and 3rd Avenue
South, two blocks west of the fountain and three blocks east of the Ferry terminal.
Surrounding parcels are developed with a mix of commercial and multiple
residential uses (Attachment 3).
B. Public Notice
The subject application was submitted on June 29, 2020 and determined to be
complete on July 27, 2020. In accordance with ECDC 20.03, a "Notice of Application
and Public Hearing" was posted at the subject site on August 10, 2020 (Attachment
6). The notice was also published in the Herald Newspaper and mailed to property
owners within 300 feet of the site using a mailing list provided by the applicant.
No public comments have been received as of the date of this staff report.
C. Environmental Assessment
1. Critical Areas: The site was reviewed and inspected for critical areas under
CRA2002-0160 and it was determined the site did not contain any critical areas.
Since the original determination is more than five years old, a subsequent critical
area checklist would need to be submitted if any new construction is proposed in
the future.
2. Shoreline: The subject property is not located within the shoreline jurisdiction.
3. SEPA: Conditional use permits and similar land use decisions are categorically
exempt from threshold determination and EIS requirements pursuant WAC 197-
11-800(6).
D. Technical Staff Review
In addition to the Planning Division, staff from the City's Engineering Division
reviewed the proposal and found it to be consistent with the engineering
requirements in Title 18 ECDC (Attachment 7).
E. ECDC 20.05 Conditional Use Permits
ECDC 20.05.010 contains the criteria for conditional use permits and states: "No
Conditional Use Permit may be approved unless all of the findings in this section can
be made." Staff's review of the criteria and findings is below:
1. That the proposed use is consistent with the Comprehensive Plan.

The Comprehensive Plan designation for the Bank of America site and
surrounding properties is Retail Core and Downtown Mixed Commercial
(Attachment 5). The Comp Plan is silent on commercial parking. However, since
commercial parking is a permitted use in the Downtown Business zones through
a conditional use permit, it is assumed to be consistent with the Comprehensive
Plan.
2. That the proposed use, and its location, is consistent with the purposes of the
zoning ordinance and the purposes of the zone district in which the use is to be
located, and that the proposed use will meet all applicable requirements of the
zoning ordinance.
The subject site is zoned Downtown Business - BD1 and BD2 (Attachment 4).
According to the use table in ECDC 16.43-1, off-street parking supporting a
primary permitted use is a permitted secondary use. However, commercial uses
are not required to provide off-street parking in the BD1 and BD2 subdistricts
(ECDC 16.43.030.D.2).
Commercial parking lots, on the other hand, require a conditional use permit.
Commercial parking means "a site where parking spaces are rented or leased to
persons other than those who live or work on the same site." [ECDC 21.15.040]
According to ECDC 16.43.020.A, conditional uses such as commercial parking
may be permitted if the following criteria are met:
Access and Parking. Pedestrian access shall be provided from the
sidewalk. Vehicular access shall only be provided consistent with ECDC
18.80.060. When a curb cut is necessary, it shall be landscaped to be
compatible with the pedestrian streetscape and shall be located and
designed to be as unobtrusive as possible.
Design and Landscaping. The project shall be designed so that it is
oriented to the street and contributes to the pedestrian streetscape
environment. Fences more than four feet in height along street lot lines
shall only be permitted if they are at least 50 percent open, such as a
lattice pattern. Blank walls shall be discouraged, and when unavoidable
due to the nature of the use shall be decorated by a combination of at
least two of the following:
a. Architectural features or details,
b. Artwork,
c. Landscaping.
There will be no change to the existing access to the parking lots or landscaping
at the site.

3. That the use, as approved or conditionally approved, will not be significantly
detrimental to the public health, safety and welfare, and to nearby private
property or improvements unless the use is a public necessity.
As conditioned, the proposed commercial parking should not be significantly
detrimental to the public health, safety and welfare and to nearby private
property or improvements.
4. The hearing examiner shall determine whether the conditional use permit shall
run with the land or shall be personal. If it runs with the land and the hearing
examiner finds it in the public interest, the hearing examiner may require that
it be recorded in the form of a covenant with the Snohomish County auditor.
The hearing examiner may also determine whether the conditional use permit
may or may not be used by a subsequent user of the same property.
The applicant has requested that this permit run with the land.
V. STAFF RECOMMENDATION
Based upon the Findings of Fact, Conclusions, and Attachments to this staff report, staff
recommends the Hearing Examiner APPROVE the Diamond Parking Services conditional
use permit in file PLN2020-0037 subject to the following conditions:
1. A building permit is required for improvements to the site including but not limited
to signage, kiosk installation, restriping, updating landscaping, etc.
2. Diamond Parking Services must obtain a City business license.
VI. RECONSIDERATION
According to ECDC 20.06.140, a party of record may submit a request to reconsider a
Type III-B decision to the Development Services Director within 10 days after the date of
issuance of the decision. The request must be made in writing and include all required
information stated in ECDC 20.06.140(D) as well as the applicable fee.
VII. APPEAL
Pursuant to ECDC 20.06.030, a party of record may submit a written appeal of a Type III-
B decision to the Development Services Director within 14 days after the date of
issuance of the decision. The appeal shall be made in writing and shall include all
required information stated in ECDC 20.06.030(D) as well as the applicable fee. The
appeal would be heard at a closed record hearing before the City Council according to
the requirements of ECDC Chapter 20.06.120.
Vlll. TIME LIMIT AND EXTENSION
"Unless the owner obtains a building permit or, if no building permit is required,
substantially commences the use allowed within one year from the date of approval, the

conditional use permit shall expire and be null and void, unless the owner files an
application for an extension of time before the expiration date." [ECDC 20.05.020.C]
"An application for any extension of time shall be reviewed by the community
development director as a Type II decision." [ECDC 20.05.020.D]

Diamond Parking Services LLC ("Diamond Parking") is applying for a Conditional Use Permit on
behalf of the owner for the property located on 306 Main Street, Edmonds, WA 98020.
Diamond Parking will operate the parking facility on the above referenced property 24 hours a
day, 7 days a week as an independent contractor.
The principal duty of the parking operator will be to collect, process and keep accurate records
for parking fees on behalf of the owner. The main source of income will be from the walk-on ferry
customers that leave their vehicle overnight. Diamond Parking will keep the parking facility in a
neat and clean condition and will conduct routine visits to the lot to ensure compliance is met.
See exhibit "A" for specific hours of operation. There will not be any changes proposed to the
current site.
The proposed use and its location for the above referenced property is consistent with the
purposes of the City Of Edmonds Zoning Ordinance and will not be detrimental to the public
health safety and welfare.
If the owner of 306 Main Street, Edmonds, WA 98020 decides to sell the property, the Conditional
Use Permit will be transferable to the new owner if the applicable fee is paid in full to the
applicant (Diamond Parking).
