TO GRANT AGREEMENT NO. G1400022

STATE OF WASHINGTON DEPARTMENT OF ECOLOGY
AND
THE CITY OF EDMONDS
PURPOSE: To amend the above -referenced grant agreement between the Department of
Ecology [ECOLOGY] and THE CITY OF EDMONDS [RECIPIENT] for the project:
PERRINVILLE CREEK STORMWATER FLOW REDUCTION RETROFIT STUDY
AND PRE -DESIGN REPORT
This amendment is needed to change the end date of the agreement, replace the deliverables
table, and add new language to the General Terms and Conditions.
IT IS MUTUALLY AGREED that the grant agreement is amended as follows:
PART I. GENERAL INFORMATION- This section will be modified as follows:
The Expiration Date is changed from June 30, 2014 to June 30, 2015.

ATTACHMENT III. ECOLOGY'S GENERAL TERMS AND CONDITIONS will be
modified as follows:
The following condition is added:
W. FUNDING AVAILABILITY. ECOLOGY's ability to make payments is contingent
on availability of funding. In the event funding from state, federal, or other sources is withdrawn,
reduced, or limited in any way after the effective date and prior to completion or expiration date
of this agreement, ECOLOGY, at its sole discretion, may elect to terminate the agreement, in
whole or part, or renegotiate the agreement, subject to new funding limitations or conditions.
ECOLOGY may also elect to suspend performance of the agreement until ECOLOGY
determines the funding insufficiency is resolved. ECOLOGY may exercise any of these options
with no notification restrictions.
FURTHER, this amendment shall be effective upon signature of ECOLOGY's Shorelands and
Environmental Assistance Program Manager.
Except as expressly provided by this amendment, all other terms and conditions of the original
grant agreement and all amendments remain in full force and effect.
