REQUEST: TO RE - ROOF AND CHANGE ROOFLINE OF EXISTING NON-
CONFORMING GARAGE.
1. SPECIAL CIRCUMSTANCES: The house and garage were built in 1951. The
current zoning laws (RS -12) were put in place in 1958. The house and garage
existed seven (7) years before any zone setbacks were in place. The garage is
one foot from the north side of the property ( 9 feet into side setback) and 14.5
feet back from east (front) property line (10.5 feet into front setback). At
present the garage roof (flat) is very poor condition and needs replacing. Since
the structure is non -conforming we must petition for a variance to repair or
replace the roof. We feel the zoning has created this existing situation and
places an unfair burden on the homeowner for property maintenance and
improvement.
2. NOT SPECIAL PRIVILEGE: The garage was built 7 years before current
zoning. The house and garage were not built with these setbacks in mind and
consequently is not in compliance. We feel it is the owner's right and obligation
to maintain structures on their property in good condition. The roof of the
garage is in need of replacement. It is currently a flat roof with drainage
problems. We feel it is a hardship to be required to maintain such a poorly
designed roof. We therefore are seeking a variance to alter the roof structure to
a low pitch gable roof. (see illustration). This will maintain the value of the
property and keep existing buildings in good repair.
3. COMPREHENSIVE PLAN: A new roof does not alter nor interfere with the
Comprehensive Plan. The new roof will improve the property and maintain the
quality of the existing and surrounding properties.
4. ZONING ORDINANCES: Ms. Rock's home is within a single family zone. (RS
-12) She does not wish to tear down the garage nor build a new garage
elsewhere on the property. It is unfair for her to be required to tear down her
garage and build a new one elsewhere on the property or not have a garage in
order to comply with later zoning. It seems reasonable to have an enclosed
space for cars off- street within a single family neighborhood. The proposed new
roof line would not change roof eave overhang nor lot coverage.
5. NOT DETRIMENTAL: Granting this variance would NOT cause any loss of
property value, or scenic views. Nor would it cause any street hazards, access
(foot or vehicular) , line - of- sight problems nor will it diminish the value of any
neighbor's property. It would not obstruct any scenic view nor change the
property to be unusual for the neighborhood. Actually by lowering the carport
roof it would improve any scenic view of the easterly neighbors. To NOT repair
the roof would be detrimental to the property itself and harm the atmosphere of
the neighborhood.
6. MINIMUM VARIANCE: Ms. Rock's request to change the roof of her garage is
the only request in this variance process. Her interest is to repair and rebuild
her failing garage roof. She feels it is within her rights as a property owner to
improve and maintain her home. The new roof overhangs will not be increased.
With her new roof she can enjoy a safe garage for her car like her neighbors.
