Society, a Washington non-profit corporation, to install an historical plaque on or at our
building and/or premises to signify, locally, the earlier location of some existing or pre-
existing building, business or other point of interest in the City of Edmonds or South
Snohomish County.
The Grantor herein acknowledges that the above mentioned plaque or sign is in
no way connected to or related to the establishing of such site, building, or location with
the State of Washington Heritage Register or any Federal Register. The placement is
simply a local designation and nothing more.
The selection of the site for the placement of the plaque and the plaque's wording
are subject to the approval of the Mayor of the City or his/her designee. The permission

HISTORY AND SUMMARY STATEMENT:
The Engineering staff prepared contract documents for the roof

The engineer's estimate is $15,000. Any required budget
adjustment will be recommended at the time the bids are taken
back to Council for contract award.

HISTORY AND SUMMARY STATEMENT:
The Phase I elements for City Park are scheduled to be completed
in 1994. They include the northwest corner paved parking,
handicapped parking area, handicapped paths and playground
equipment with handicapped elements.
To complete path designs and locations, plus locate placement of
play equipment a survey must be completed and attached to the
Excavation/Grading and Retaining Wall Permits.
The supplemental agreement with Reid Middleton provides for the
completion of the City Park survey which provides a comprehensive
site survey, facilitating the immediate needs for Phase I and the
long term needs for Phase II.
RECOMMENDED ACTION:
Authorize the Mayor to sign a supplemental agreement with Reid
Middleton to provide a survey of City Park at a cost of $4,200.

A. Nyment for work accomplished under the terms of this Agreement shall
be on an hourly tsars as set forth on the fee schedule found in Exhibit B, provided, in no event
shall the payment for all work performed pursuant to this Agreement exceed the sum of Four
Thousand Two Hundred Dollars ($4,200.00) for both phases of the project.
B. All vouchers shall be submitted by the Consultant to the City for payment
pursuant to the terms of this Agreement. The City shall pay the appropriate amount for each
voucher to the Consultant. The Consultant may submit vouchers to the City biweekly during
the progress of the work for payment of completed phases of the project. Billings shall be
reviewed in conjunction with the City's warrant process. No billing shall be considered for
payment which has not been submitted to the engineering department three (3) days prior to the
scheduled cut off date. Such vouchers will be checked by the City and payment will be made
in the amount thereof.
C. The cost records and accounts pertaining to this Agreement are to be kept
available for inspection by reprewntativcs of the City for a period of thrm (3) years after final
payment, Copies shall be made available upon request.
4. Time of Ekfo . The Consultant shall perform the work authorized by this
Agreement promptly in accordance with the receipt of the required governmental approvals.
5. . In performing the work under this contract,
Consultant agrees to protect, indemnify and save the City harmless from and against any and all
injury or damage to the City or its property, and also from said against all claims, demands and
cause of action of every ]rind and character arising directly ur indirectly or in any way incident
to, in connection with, or arising out of work performed under the terms hereof, caused by the
fault of the Consultant, its agents, employees, representatives or subconvactors. Consultant
specifically promises to indemnify the City against claims or suits brought under Title 51 RCW
by its employees or subcontractors and waives any immunity clot the Consultant may have under
that title with respect to, but only to, the City. Consultant further agrees to fully indemnify City
from and against any and all costs of defending any such claim or demand to the end that the
City is held harmless themfrom. This paragraph shall not apply to damages or Claims resulting
fxmn the sole negligence of the City.
6. General and FinfessiorW Liability Insure. ne Consultant sW secure and
maintain in full force and effect during performance. of all work pursuant to this contract a policy
of comprehensive gmersl liability kwmincae providing coverage of at least $500,000 Per
occurrence and $1,000,000 aggregate for pm=ml injury; $500,000 per occurrence and
aggregate for property damage; and professional liability insurance in the amount of $250,000.
Such policies shall name the City as a named insured and shall include a provision prohibiting
cancellation of said policy except upon thirty (30) days' written notice to the City. Certificates
of Coverage shall be delivered to the City within fifteen (15) days of execution of this
Agreement.

Dear Arvilla,
Thank you for considering REID MIDDLETON for survey and snapping at the Edmonds
City Park.
The enclosed sketch, provided by Jim Walker, of the existing conditions at the park depicts
Phases I and 11, and other notations I have made in red. The following is my understanding
of the scope of work for each phase.
A. Phase I (Northerly portion of the park.)
Develop contour lines at two -foot intervals on the portion of Phase I west of
the toe of the slope west of the ball field.
2. Provide spot elevations on the ball field as shown on the sketch.
3. Map all buildings, paved surfaces, catch basins, and curb stops.
4. Show location, size (DBH) and species (deciduous or conifer) of significant
trees or tree groups.
5. Show location of fence line and details of drainage swale along west side of
the site.
6. Map the pathway and significant trees to be marked by the city extending
into the Phase II area.

II. Reimbursable Expense
The following charges shall apply to all agreements unless specifically stated otherwise. For fixed fee agreements,
these charges shall be over and above the stated fixed fee.

Expenses other than REID MIDDLETON's professional services and specific reimbursable expenses which are
directly attributable to such professional services are invoiced at cost plus 15%. These expenses include but are
not limited to actual travel and subsistence by employees when away from the home office, communications/
postage, special instrumentation and field equipment rental, special fees and permits, premiums for additional or
special insurance where required, subconsultant or subcontractor services, special supplies, actual reproduction
cost, and miscellaneous direct costs applicable to the client's work.
A new schedule of charges is issued effective May 1 of each year or when otherwise dictated by inflationary
pressure. Unless other arrangements have been trade, charges for all work, including continuing projects initiated
in the prior year, will be based on the latest schedule of charges.

"GAZEBO" BANDSTAND AT CITY PARK
The Rotary Club has designated a bandstand at City
Park as their 1981 civic project. The Parks and
Recreation and the Public Works Departments feel
this would add a valuable improvement to the park
and have assisted the Rotary Club in the bandstand
site planning.
David Kinderfather will be present to discuss the
design. use, and funding for the bandstand.

Dear Mr. Mayor:
As a community service project, the Edmonds Rotary Club would like
to restore the "Gazebo" style bandstand that existed in the city park
during the 30's.
The proposed design for the bandstand was approved by the ADB
minutes dated December 3, 1980 and the construction site has been estab-
lished by the Public Works Director. This outdoor multi -purpose facility
would be available to all ages of the general public for musical and
dramatic performances.
The design work has been completed by David Kinderf ather and constru-
tion will be accomplished by Robert Pantley. Upon completion this structure
will become city property and will be available to such groups as the
Senior Swingers, scouts, performing arts, and civic celebrations such as
the Old Settlers Picnic, Founders Day Picnic, Fourth of July, and Saint
Patricks day.
We request the approval of the City Council for this community service

dramatic performances, according

After the structure is built, it will

The bandstand will be available for

tion activities, he said. Noise
levels from the park could be con-
trolled through city ordinances and
park regulations, according to City
Attorney Jim Murphy.
The Rotary Club is seeking dona-
tions, building materials and labor
to complete this voluntary project.
Reinforcing steel, cement, concrete
blocks and cedar shakes are needed.
