Ordinance 1433ORD.T.;_:l _NCE NO. /q3 3 AN ORDINANCE or TH" CITY or EDMONDS, WASHINGTON Rt•-IENDING SECTION 5.12.145 OF THE EDi:ONDS CITY CODE TO CONORii ARREST AND CRIMINAL PROCEEDINGS TO THE RULES PRESCRIBED BY THE CRIMINAL RULES FOR JUSTICE COURT AND TILE TRAFFIC RULES FOR JUSTICE COURT AS PROMULGATED BY THE SUPREME COURT OF THE STATE OF WASHINGTON AND PROVIDING FOR ARREST BY A POLICE OFFICER HAVING INFORMATION TO SUPPORT A REASONABLE BELIEF THAT A PERSON HAS COI IIITTED MMISDEiI ANORS INVOLVING PHYSICAL HART. i OR THREATS OF MART TO PERSONS OR PROPERTY, THE UNLAWFUL TAXING OF PROPERTY OR THE USE OR POSSESSION OF CANNIBAS. THE CITY COUNCIL or THE CITY OF EDIIONDS, WASHINGTON DO ORDAIN AS FOLLOWS: The Edmonds City Code, Section 5.12.145 is hereby amended to read as follows: "Section 5.12.145 Warrants, Arrest and Proceedings. The Police Judge shall issue warrants for the arrest of any person or persons accused in a written complaint of vio- lating any of the provisions of the Edmonds City Code or other City ordinances, provided, that police officers may arrest without a warrant any person violating any of the provisions of said Ldmonds City Code or ether ordinances of the City of Edmonds in his or their presence. The pro- ceedings for issuance of warrants, arrests and general criminal proceedings shall be governed by the Criminal Rules for Justice Court and the Traffic Rules for Justice Court as promulgated and adopted by the Supreme Court of the State of Washington. "A. In addition to the powers of arrest provided for herein above and the powers granted by the Legis- lature of the State of Washington governing the laws of arrest, a police officer in the City of Edmonds having information to support a reasonable belief that a person has committed or is committing a misdemeanor or gross mis- demeanor, involving physical harm or threat of harm to any person or property or the unlawful taking of property or involving the use or possession of cannibas shall have the authority to arrest said person as prescribed by Chapter 198, Extraordinary Session, Laws of 1969. Nothing herein shall extend or otherwise affect the powers of arrest described by Chapter 46, the Revised Code of Washington." APPROVED: H .
