AN ORDINANCE APPROVING AND CONFIRMING THE
FINAL ASSESSMENT AND ASSESSMENT ROLL OF LOCAL
IMPROVEMENT DISTRICT NO. 173, AS AMENDED,
WHICH HAS BEEN CREATED AND ESTABLISHED FOR
THE PURPOSE OF PAYING THE COST OF IMPROVING
CERTAIN PROPERTY ALL IN THE CITY. OF EDMONDS,
WASHINGTON, BY THE INSTALLATION OF SANITARY
SEWERS AND. ALL NECESSARY APPURTENANCES, IN-
CLUDING PIPE,VALVES, FIT.T.INGS, SURFACE
GRADING AND REPLACEMENT OF PAVEMENT. WHERE.
NECESSARY AND RELATED WORK NECESSARY TO MAKE
A .COMPLETE IMPROVEMENT IN ACCORDANCE .WITH
CITY STANDARDS, PURSUANT TO PETITION AND AS
PROVIDED BY ORDINANCE NO. 1409., AS AMENDED,
AND LEVYING AND ASSESSING THE AMOUNT THEREOF
AGAINST THE .SEVERAL LOTS, TRACTS, PARCELS
OF LAND AND OTHER PROPERTY SHOWN ON SAID ROLL.
WHEREAS, the assessment roll levying the special
assessments against the properties located in Local
Improvement District No.. 173, in the .City of Edmonds,
Washington, created under. Ordinance No. 1409, was
filed with the City Clerk of the City of Edmonds as
provided by law;. and
WHEREAS, notice of the time and place of hearing
thereof and of makingobjections and protests to said
roll was duly published at and for the time and manner
provided by law, fixing the time .and place :of hearing
thereon for the 17th day of March, 1970, at the hour
of 8:00 P.M. o'clock in the council chambers of the
Civic Center of Edmonds, Washington and furthernotice
thereof was duly mailed by. the. City Clerk to each
property owner on said roll; and
WHEREAS, at the time and place .fixed and designated
in said notice,the hearing on said assessment roll was
duly held and all written and oral protests received were
duly considered and all persons appearing at said hearing
were heard, and
WHEREAS, it :appeared that certain property was
not included in the :original assessment which may
have been served by said Local Improvement District
No. 173 and the hearing was continued by the City.
Council from time certain to time certain, and
WHEREAS, Lot 13, Haines Wharf Addition No. 2,•
has been added to: the assessment roll and the owners
of said lot have approved in writing of an assessment
in the sum of $647.57 which costs are based upon the
actual cost of the improvement at the time of completion
and thereby reduced the assessments on the original
assessment roll by said $647.57 pro rata on a zoned -
front -foot basis
now,: theerefore
THE CITY COUNCIL OF THE CITY. OF EDMONDS, WASHINGTON
DO ORDAIN AS FOLLOWS:
Section 1. The assessmentsand assessment roll of
Local Improvement District No. 173, which has been created
and established for th.e purpose of paying the cost of the
installation of sanitary sewers and all necessary
appurtenances, including pipe, valves., fittings, surface
grading and replacement of pavement where necessary and
related work necessary to make.a complete 'improvement in
accordance with City standards on 164th Street Southwest
from 72nd Avenue West a distance of approximately 550 feet.
East;. and 72nd Avenue West from 164th Street Southwest
a distance .approximately 850 feat South. .in the .City of
Edmonds, Washington, pur.suant to. petition, and as provided
by. Ordinance No. 1409.,•as the same now :stands, as amended
including Lot 13, Haines Wharf. Addition No. 2,be and the
same is hereby in all things and respects approved and
confirmed.

Section 2 Each ofthe lots:, tracts , parcels
of land, and other propertyy shown on said roll as amended
is hereby determined and declared to be specially benefited
by said improvement in at least the amount charged against
the :same .and the assessment appearing the same is in
proportion to the several assessments appearing on the said
roll. There is hereby levied and assessed against each lot,
tract, parcel of land and otherproperty appearing upon
said roll as amended the amount finally charged against
the same. thereon.
Section 3. The assessment .roll as approved and
amended and confirmed shall be filed with the City
Treasurerof the City of Edmonds, Washington for collection
and said City Treasurer is herebyy authorized and directed
to publish notice as required by law statingthat the
said roll is in his hands forcollection and that payment
of any assessment thereon or any portion of said assessment
can be made at any time within thirtydays from the date of
the first publication of said notice without penalty,
interest or costs, and that thereafter the sum remaining
unpaid may be paid in ten equal annual installments with
interest thereon hereby fixed at the rate of 6%,per annum.
The first installment of assessmentson said amended
assessment roll shall become due one year after the date
of first publication by the City Treasurer of notice that
the assessment roll is in his hands for collection and
annually thereafter each succeeding installment shall become
due and payable in like manner. If the whole or any portion
of the assessments remains unpaid after. the .first .thirty
day period, interest upon the whole unpaid sum shall be
charged at the rate of 6% per annum and each year there-
after one of said installments, together with interest due
on the whole .of the unpaid balance,shall be .collected.
Any installment not paid prior tothe expiration of
the said thirty day period during which such installment
is. due and payable shall thereupon become delinquent.
All delinquent installments: shall be subject .to a
charge for interest :at.6o'.per annum and for an additional
charge of 5%.penalty levied upon the principal dueupon
such. installment :or installments. The collection of
such delinquent installments will be enforced in the
mannerr provided by law..
Section 4. Exhibit "A" attached to Ordinance
No. 1409. and incorporated into Section :2.as if set forth.
in full is hereby amended to read as follows:
"Beginning at the Northeast Corner of Tract 85
of Meadowdale Beach,as recorded in Volume 5,
page 38 Records of Snohomish County, Washington;
thence South to. the Southeast corner of said.
tract; thence West tothe Southwest corner of
said tract; thence North to a point on the West
line: of tract 69 said plat :at a distance :of 120.
feet North of the S.W. cornerof said tract 69;
thence East to a point 120 .feet West of the East
line of said tract 69;. thence South to the South.
line of Tract 69; thence Southwest to a point on
the North line of Tract 85 at a distance of 131.1
feet West of the Northeast corner of Tract 85;
thence East to Point of Beginning, together with Lot
13, Haines Wharf Addition No. 2, all situate. in
Snohomish .County, Washington.
