Ordinance 1515ORDINANCE NO. / - — AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON AMENDING THE BUILDING CODE FOR SAID CITY BY THE ADOPTION OF THE 1970 EDITION OF THE UNI- FORM BUILDING CODE, VOLUMES I (SPECIFICALLY EXCLUDING APPENDICEES 13,23 and 48) AND THAT VOLUME ENTITLED "UNIFORM BUILDING CODE, 1970 EDITION, STANDARDS FOR VOLUME I", BY AMENDING CHAPTER 11.02 OF THE EDMONDS CITY CODE: REPEALING SECTIONS 11.02.030, 11.02.040, 11.02. 050 AND 11.02.080 OF SAID CHAPTER; AND AMENDING SECTIONS 11.02.065 AND 11.02.070 RELATING TO PLAN -CHECKING FEES FOR GRADING AND EXCAVATIONS AND RELATING TO PENALTIES. THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The Edmonds City Code, Section 11.02.010, is hereby amended to read as follows: "11.02.010 Uniform building code adopted by reference. That certain printed code, three copies of which are and have been on file in the office of the city clerk, for use and examination of the public, being marked, printed and designated as the Uniform Building Code, 1970 Edition, Volume I (specifically including all Appendices except those to Chapter Nos. 13,23 and 48) and that Volume entitled "Uniform Building Code, 1970 Edition, Standards for Volume I," all copyrighted 1970 by the International Conference of Building Officials, is hereby adopted by reference and incorporated herein as if fully set forth within this chapter, as the building code of the city, subject to the modifications and amendments hereinafter set forth, and the code as adopted shall regulate the erection, construction, enlarge- ment, alteration, repair, moving, removal, conversion, demolition, occupancy, equipment, use, height, area and maintenance of buildings or structures in the city; and further provides for the issuance of permits and collection of fees therefor providing penalties for the violation of such code; and each and all of the regulations, provisions, penalties, conditions and terms of the uniform building code herein mentioned and as amended and on file in the office of the city clerk is hereby established, pursuant to the laws of the State of Washington as set forth under RCW 35.21.180 as the building code in and for the city. Section 2. The Edmonds City Code, Section 11.02.065 is hereby amended to read as follows: "11.02'0-65 Plan -checking fee= -Section 7007 of uniforM code. Section 7007 of the Uniform Building Code as adopted by reference under Section 11.02.010 of this chapter is hereby amended and set forth as follows: (a) Plan -checking fee. The amount of the plan -checking fee for grading, excavation and/or fill plans shall be ten dollars. Before accepting a set of plans and specifications for checking, the building official shall collect a plan - checking fee. Separate permits and fees shall apply to retaining walls or major drainage structures as indicated elsewhere in this code. There shall be no separate charge for standard terrace drains and similar facilities. (b) Grading permit fees. A fee for each grading permit shall be paid to the building official in the sum of ten dollars. Section 3. The Edmonds City Code, Section 11.02.070, is hereby amended to read as follows: "11.02.070 Penalty for violations. Section 205 of the Uniform Building Code as adopted by reference under Section 11.02.010 of this chapter is hereby amended and set forth as follows: "It is unlawful for any person, firm or cor- poration to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure in the city, or cause the same to be done, contrary to or in violation of any of the pro- visions of this cahpter. Any person, firm or corporation violating any of the provisions of the uniform building code as adopted herein, or other provision of this chapter, shall be guilty of a misdemeanor, and each such person shall be deemed guilty of a sepa- rate offense for each and every day or portion thereof during which any violation of any of the provisions of this chapter or the Uniform Building Code adopted herein is committed, continued or permitted, and upon the conviction of such violation, and each violation thereof, such person, firm or corporation, and the officers, directors and managers thereof, shall be punishable by a fine of not more than five hundred dollars, or by imprisonment for not more than ninety days, or by both such fine and imprisonment."
