AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON
AMENDING THE SWIMMING POOL CODE OF SAID CITY BY
ADOPTING THE UNIFORM SWIMMING POOL CODE OF THE
INTERNATIONAL ASSOCIATION OF PLUMBING ARID MECH-
ANICAL OFFICIALS, 1970 EDITION, WITH CERTAIN
ADDITIONS AND MODIFICATIONS; REPEALING SECTIONS
11.40.020, 11.40.030, 11.40.050 THROUGH 11.40.120,
AND 11.40.140 OF THE EDMONDS CITY CODE; AMENDING
SECTION 11.40.040 OF THE EDMONDS CITY CODE
REGARDING SETBACKS AND LOCATION; AMENDING SECTION
11.40.130 OF THE EDMONDS CITY CODE REGARDING
COMPLIANCE WITH FENCING REQUIREMENTS; AND AMEND-
ING SEC^lION 11.40.170 OF THE EDMONDS CITY CODE
PROVIDING FOR PENALTIES.
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON
DO ORDAIN AS FOLLOWS:
Section 1. The following sections of the Swimming
Pool Code of the Edmonds City Code are hereby repealed:
Sections 11.40.020, 11.40.030, 11.40.050 through 11.40.120,
and 11.40.140.
Section 2. There is hereby created a new section
to the Swimming Pool Code of the Edmonds City Code which
Section shall read as follows:
"Section 11.40.020. That certain printed code,
three copies of which have been on file in the
Office of the City Clerk, for use and examination
of the public, being marked and printed and desig-
nated as the Uniform Swimming Pool Code, 1970 Edition,
copyrighted in 1970 by the International Association
of Plumbing and Mechanical Officials, is hereby
adopted by reference and incorporated herein as if
set forth in full within this chapter, subject to
such modification and amendments as may hereinafter
or hereafter be provided, and the code as adopted
shall regulate the erection, construction, enlarge-
ment, alteration, repair, moving, removal, conver-
sion, demolition, occupancy, equipment, use, loca-
tion and setback requirements, area and maintenance
of swimming pools and appurtenances thereto within
said city; and further provides for the issuance
of permits and the collection of fees therefor;
providing penalties for the violation of such code;
all pursuant to the laws of the State of Washington
as set forth under RCW 35.21.180."
Section 3. Application of terms. There is hereby
created a new section of the Swimming Pool Code of the
Edmonds City Code which section shall read as follows:
"Section 11.40'.030. The following Sections of
the Uniform Swimming Pool Code as adopted in this
Chapter are hereby applied in the City of Edmonds
as follows:
"'Sec. 1.0 - Administrative Authority and
Assistants. Whenever the term "Administrative
Authority" is used in this Code it shall be con-
strued to mean the Building Official or his
authorized representative."
"'Sec. 1.1 - Department Having Jurisdiction.
Unless otherwise provided for by law, the office
of the Administrative Authority shall be part of the
building department."
Section 4. The Swimming Pool Code of the Edmonds
City Code, Section 11.40.040, is hereby amended to read
as follows:
"11.40.040 Location and Setbacks. Swimming pools
may be located in any use zone in the City of Edmonds.
Minimum setback from property lines to the inside
face of the pool shall be not less than the following:
RS-12 and RS-20 Use Zones: Twenty -Five feet from
front, and five feet from sides and rear;
All other Zones: Twenty feet from front, and
five feet from sides and rear."
Section 5. The Swimming Pool Code of the Edmonds
City Code, Section 11.40.130, is hereby amended to read
as follows:
"11.40.130 Fence and gate. The pool area shall
be completely surrounded by a substantial fence,
being a minimum of four feet high. If.fence is of
wood or wire, no openings shall be greater than two
inches, and a self -closing, self -latching gate must
be provided, with an inside lock inaccessible to
children aged five years or younger. The gate shall be
securely locked when the pool is unattended. Any
pool not presently fenced as required herein must be
so fenced within sixty days of the effective date of
this section as amended."
Section 6. The Swimming Pool Code of the Edmonds
City Code, Section 11.40.170, is hereby amended to read
as follows:

"Section 11.40.170 Violations and Penalties.
Sec. 1.11 of the Uniform Swimming Pool Code, as
herein adopted, is hereby amended to read as follows:
"'Any person, .firm or corporation violating any
of the provisions of this Code shall be deemed guilty
of a misdemeanor and upon conviction thereof shall
be punishable by a fine or by imprisonment, or by
both such fine and imprisonment, as set forth in
Section 5.12.170 of the Edmonds City Code.
The issuance or granting of a permit or approval
of plans and specifications shall not be deemed or
construed to be a permit for, or an approval of,
any violation of any of the provisions of this Code.
No permit presuming to give authority to violate or
cancel the provisions of this Code shall be valid,
except insofar as the work or use which it authorizes
is lawful.
The issuance or granting of a permit or approval
of plans shall not prevent the Administrative Authority
from thereafter requiring the correction of errors in
said plans and specifications or from preventing
construction operations being carried on thereunder when
in violation of this Code or of any other ordinance
or from revoking any Certificate of Approval when
issued in error.
Every permit issued by the Administrative Authority
under the provisions of this Code shall expire by limi-
tation and become null and void, if the work authori-
zed by such permit is not commenced within 60 days
from the date of such permit, or if the work authorized
by such permit is suspended or abandoned at any time
after the work is commenced for a period of 60 days.
Before such work can be recommenced a new permit
shall be first obtained. One hundred twenty (120)
days before such work can be recommenced a new permit
shall be first obtained so to do, and the fee therefor
shall be one-half the amount required for a new permit
for such work provided no changes have been made, or
will be made in the original plans and specifications
for such work; and provided, further, that such
suspension or abandonment has not exceeded one year.'"
