Ordinance 2073ORDINANCE NO. 2073 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, VACATING A PORTION OF 75TH AVENUE WEST NORTH OF 162ND AVENUE SOUTHWEST, AND A PORTION OF NORTH MEADOWDALE ROAD BETWEEN 75TH AVENUE WEST AND 75TH PLACE WEST. WHEREAS, a petition signed by the owners of more than two-thirds of the property abutting upon property dedicated for street purposes was filed with the City Clerk for vacation of a portion of 75th Avenue West and a portion of North Meadowdale Road between 75th Avenue West and 75th Place West, and WHEREAS, the City Council of the City of Edmonds did by Resolution No. 430 set the 24th day of April, 1979, at the hour of 7:30 p.m. of said day, for the hearing and determination on said vacation, and at said date and time did continue the hearing until May 15, 1979, and WHEREAS, the Edmonds Planning Commission, by Planning Commission Resolution No. 617, recommended vacating said portion of 75th Avenue West north of 162nd Avenue Southwest and said portion of North Meadowdale Road between 75th Avenue West and 75th Place West, and WHEREAS, it appears to the City Council that portions of said streets should be vacated, and the said City Council does hereby determine to vacate the same, as hereinafter set forth, now, therefore., THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That the following described portions of streets in the City of Edmonds, Snohomish County, Washington, being a portion of 75th Avenue West north of 162nd Street South- west, and a portion of North Meadowdale Road between 75th Avenue West and 75th Place West, legally described on Exhibit "A", attached hereto and incorporated by this reference as if set forth in full, be and the same are hereby vacated, provided, that the City of Edmonds does hereby retain an easement and reserves the right to exercise and grant easements in respect to said vacated land for the construction, installation, repair, and maintenance of all public utilities and services. Section 2. There shall be no charge to the abutting owners of the portion of the streets being vacated, provided, however, the abutting owners shall Quitclaim to the City a 40 foot wide portion of their property presently occupied by 75th Place West. Section 3. The City Clerk is hereby instructed to file a certified copy of this Ordinance with the Snohomish County Auditor. Section 4.
