AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 12.12.170 OF THE EDMONDS CITY
CODE TO ADD A DEFINITION OF "PETROLEUM PRODUCTS
STORAGE AND DISTRIBUTION"; AMENDING SECTION
12.13.220 OF THE EDMONDS CITY CODE TO PROVIDE
FOR WATER ORIENTED USES IN THE CW ZONE; AMENDING
SECTIO14 12.13.230 OF THE EDMONDS CITY CODE TO
ALLOW AS A PERMITTED USE IN THE CW ZONE PETROLEUM
PRODUCTS STORAGE AND DISTRIBUTION AND ADDING A
NEW SECTION 12.13.250(e) TO ALLOW A 48 FOOT
MAXIMUM HEIGHT FOR PETROLEUM STORAGE TANKS,
PURSUANT TO PLANNING COMMISSION RESOLUTION
NO. 635.
WHEREAS, the Edmonds Planning Commission held a public
hearing and at the conclusion of said hearing recommended that
the following amendments to the Edmonds Zoning Code be adopted
and forwarded its recommendations to the City Council in Planning
Commission Resolution No. 635, and
WHEREAS, the Edmonds City Council finds that the fol-
lowing amendments will be in the best interest of the public
health, safety and general welfare and concurs in the finding of the
City's Responsible Official that there will be no significant
adverse environmental impacts, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 12.12.170 of the Edmonds City Code
is hereby amended to add a definition of petroleum products
storage and distribution and to read as follows:

"12.12.170 PETROLEUM PRODUCTS STORAGE AND DISTRIBUTION.
Petroleum products storage and distribution means the receipt of
petroleum products, generally by pipeline or marine vessels and
the storage and loading of petroleum products for distribution to
petroleum bulk plants and to customers and automotive service
stations; and all related operations, including but not limited
to the operation and maintenance of trucks and equipment, the
handling of products, merchandise and materials, the provision of
customer services related to the petroleum distribution business
and the compounding, blending, packaging and shipping of lube
oils and greases."
Section 2. Section 12.13.220 of the Edmonds City Code
is hereby amended to include water oriented uses in the CW Zone
and to read as follows:
"12.13.220 INTENT IN CW, WATERFRONT COMMERCIAL DISTRICT.
To preserve and enhance the natural features of the waterfront
for the use and enjoyment of the public, the CW Zone provides a
location for water dependent and water oriented uses and for
those which encourage full use of the waterfront by the public.
All activity and development will be evaluated according to the
physical and visual access to the waterfront that is provided to
the public. Uses which are primarily auto oriented are dis-
couraged in the CW Zone because of their conflict with pedestrian
use. To promote coordinated development and high quality design,
development in the CW Zone shall meet the design criteria in
Section 208 of the Policy Plan."
Section 3. Section 12.13.230(e) of the Edmonds City
Code is hereby amended to permit petroleum products storage and
distribution in CW Zones and to read as follows:
"(e) Petroleum products storage and distribution; and"
Section 4. A new Section 12.13.250(e) is hereby added
to the Edmonds City Code to provide a 48 foot high maximum height
for petroleum storage tanks and to read as follows:
"(e) PETROLEUM STORAGE TANK HEIGHT: 48 foot maximum
height is allowed for petroleum storage tanks that
are part of a petroleum products storage and
distribution facility."

Section 5. This Ordinance shall be in full force and
effect five (5) days after passage and publication by posting as
provided by law.
