AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 7.30.040 UTILITY CHARGES TO ADD
A NEW SUBSECTION D, ESTABLISHING A PENALTY FOR
THOSE PERSONS FAILING TO CONNECT TO THE SEWER
SYSTEM ESTABLISHED BY LID 210 AND FIXING A TIME
WHEN THE SAME SHALL BECOME EFFECTIVE.
WHEREAS, the City of Edmonds has constructed
comprehensive sanitary and storm sewerage improvements in the
Meadowdale area by LID 210, and
WHEREAS, the City staff has served notice to all
property owners within the area served by LID 210 directing them
to connect their private drains and sewers to the City of Edmonds
sanitary sewer system constructed under said LID, and
WHEREAS, despite such notice certain property owners
have failed to properly connect their private drains and sewers
to the system, and
WHEREAS, the City is authorized by RCW 35.67.190 to
establish a penalty which in the discretion of the legislative
body may "... be an amount equal to the charge that would be made
for sewer service if the property was connected to such system."
NOW, THEREFORE,
FOLLOWS:
THE CITY COUNCIL OF EDMONDS, WASHINGTON, DO ORDAIN AS
Section 1. That section 7.30.040 Utility Charges is
hereby amended by the addition of a new subsection D to read as
follows:
D. All property owners within an area served by a
sanitary sewer system in the City of Edmonds are
hereby directed and compelled to connect their
private drains and sewers to the City system.
Failure to do so within thirty (30) days of
written notice to connect by the City shall
subject the property owner to a monthly penalty
equal to that charge imposed by subsections A, B,
and/or C above. Said penalty shall be billed to
the property owner, and they shall be subject to
payment, collection and enforcement in all
respects as though they were utility customers of
the City. All penalties collected shall be
considered revenues of the sewer utility system.
Section 2. This ordinance, being an exercise of a
power specifically delegated to the City legislative body, is not
subject to referendum and shall take effect five (5) days after
its publication, or publication of a summary thereof consisting
of its title, in the City's official newspaper.
