ORDINANCE NO. 2558
AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
REPEALING SECTIONS 5.50.030 OF THE EDMONDS MUNICIPAL
CODE, ENTITLED "DETENTION ASSESSMENT", AND 2.15.090 OF
THE EDMONDS MUNICIPAL CODE ENTITLED "SENTENCES";
DECLARING AN EMERGENCY REQUIRING THAT THIS ORDINANCE
BECOME EFFECTIVE IMMEDIATELY.
WHEREAS, the Edmonds City Council acknowledges that Edmonds
City Code Section 5.50.030, entitled "Detention Assessment",
conflicts with the Revised Code of Washington Section 7.48.400,
and that Edmonds City Code Section 2.15.090 entitled "Sentences"
is contrary to the City's intention to make certain criminal
offenses non-jailable, and
WHEREAS, the Edmonds City Council finds that repealing
Edmonds City Code Sections 5.50.030 and 2.15.090 are in the
interests of the public health, safety and welfare, now,
therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DOES
ORDAIN AS FOLLOWS:
Section 1. Section 5.50.030 of the Edmonds City Code
entitled "Detention Assessment" and Section 2.15.090 entitled
"Sentences" are hereby repealed.
Section 2. If any section, sentence, clause or phrase
of this ordinance should be held to be invalid or
unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity
or constitutionality of any other section, sentence clause or
phrase of this ordinance.
Section 3. The City Council hereby declares that an
emergency exists necessitating that this ordinance take effect
immediately upon passage by a unanimous vote of the members of
the City Council. This ordinance shall be published in the
official newspaper of the City.
