AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE OFFICIAL ZONING
ORDINANCE OF THE CITY OF EDMONDS BY ADDING
A NEW SECTION, SECTION 12. 14. 055 TO THE EDMONDS
CITY CODE REQUIRING A PERFORMANCE BOND TO
GUARANTEE THE INSTALLATION OF REQUIRED SITE
IMPROVEMENTS AND THE MAINTENANCE OF SAID
IMPROVEMENTS FOR A ONE YEAR PERIOD AS A
CONDITION OF ISSUANCE OF A BUILDING PERMIT
ON BUSINESS, COMMERCIAL AND INDUSTRIALLY
ZONED PROPERTY WITHIN SAID CITY.
WHEREAS, the City Council of the City of Edmonds, Washington,
pursuant to Planning Commission Resolution No. 389, called a public
hearing, and having during said hearing determined it to be in the best
interests and the public health, safety and welfare, to amend the
Edmonds Zoning Ordinance as set forth below, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. A new section, Section 12.14. 055 is hereby added
to Chapter 12.14 of the Edmonds City Code as follows:
12.14. 055 Requirement of Performance and Maintenance Bonds.
1. Prior to the issuance of a building permit for any
building on business, commercial and industrially zoned
property within the City of Edmonds, including BN, BC, CG,
CW and IP zones, the developer or owner of the real property
affected shall submit to the Building Department a performance
bond or similar security to guarantee the installation of all the
required site improvements, including storm drainage facilities.
The developer shall prepare a cost estimate of the improvements
based on the approved site plan and submit such estimate to
the building official who shall set the amount of the performance
bond or other security based upon such cost estimate and based
upon current site improvement costs.
2. Upon the satisfactory installation and completion
of the required site improvements, as evidenced by the written
approval of the Building Department, the developer or owner
shall submit a performance bond or similar security to guarantee
the maintenance of the required site improvements for a
period of one year. The amount of the required bond or similar
security shall be 10 % of the amount required under subparagraph
1 hereinabove.
