ORDINANCE NO. 2562
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING SECTION 4.72.101 RELATING
TO THE DEFINITION OF A REGULATED BUSINESS
UNDER THE BUSINESS LICENSING PROVISIONS, TO
EXEMPT DEFINED LESSORS OF ONE RENTAL UNIT AND
FIXING A TIME WHEN THE SAME SHALL BECOME
EFFECTIVE.
WHEREAS, current provisions of Chapter 4.72 express an
intent to cover all businesses of any kind or nature operated for
profit excluding only charitable, religious and other similar
social organizations, and apartment buildings containing one
rental unit, and
WHEREAS, said definitions would by their terms include
boarding houses and bed and breakfasts providing facilities for
one living type unit, and
WHEREAS, for the purposes of consistency, and the
Council deems it appropriate to exclude such small boarding houses
and bed and breakfasts, NOW, THEREFORE
THE CITY COUNCIL OF EDMONDS, WASHINGTON, DO ORDAIN AS
FOLLOWS:
Section 1. Section 4.72.010 DEFINITIONS is hereby
amended to read as follows:
4.72.010 DEFINITIONS
In construing the provisions of this chapter, save when
otherwise declared or clearly apparent from the context,
the following definitions shall be applied:
A. Person. The term "person" shall include one or
more persons of either sex, corporations,
partnerships, associations, or other entity capable
of having an action at law brought against such
entity, but shall not include employees of persons
licensed pursuant to this chapter.
B. Business. The term "business" includes all
services and activities engaged in with the object
of pecuniary gain, benefit or advantage to the
person, or to another person or class, directly or
indirectly, whether part-time or full-time, except
those business activities for which licenses or
franchises are required by the following chapters
of the Edmonds City Code:
4.04
(Advertising License);
4.10
(Tow Truck Operators);
4.11
(Motor vehicle Wreckers);
4.12
(Peddlers and Solicitors);
4.20
( Liquor Licenses) ;
4.48
(Cabaret Dances);
4.50
(Public Massage Parlors and
Public Bathhouses);
4.56
(Sound Trucks);
4.60
(Taxicabs);
4.64
(Garbage Collection);
(Obstructing Public Places);
4.68
(Community Antenna Television
Systems);
or by
4.75 (Pawnbrokers)
And except nonbusiness activities carried on by a
religious, charitable, benevolent, fraternal or
social organization and persons leasing one rental
unit or one private residence.
C. Rental Unit. The term "rental unit" shall mean a
separate room or apartment leased for human
occupancy and contained within a single structure,
and shall include the operations of rooming houses,
boarders within private residences and the
operation of bed and breakfast establishments which
otherwise meet the criteria of the exception
created in the subparagraph above.
D. Private Residence. The term "private residence"
shall mean a separate, free-standing structure
leased for residential purposes and human occupancy
by one "family" as defined by Edmonds Community
Development Code (ECDC) 21.30.010.

Section 2. This ordinance, being an administrative
action, is not subject to referendum and shall take effect five
(5) days after publication of the attached, approved summary.
