ORDINANCE NO. 2563
AN ORDINANCE OF THE CITY OF EDMONDS, WASHING -
TON, ADDING A NEW SECTION 5.40.040 TO THE
EDMONDS CITY CODE ENTITLED "INTERFERENCE AND
ABUSE OF POLICE DOGS PROHIBITED;" AMENDING
SECTION 5.50.020(A) OF THE EDMONDS CITY CODE
TO ESTABLISH A MAXIMUM PENALTY OF $5,000
AND/OR ONE YEAR IN JAIL FOR VIOLATING SECTION
5.40.040; CONTAINING A SEVERABILITY CLAUSE AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the Edmonds City Council finds that an
ordinance prohibiting the interference and abuse of police dogs
is necessary to promote effective law enforcement; and
WHEREAS, this ordinance is in the interests of the
public health, safety and welfare, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. There is hereby added to the Edmonds City
Code a new Section 5.40.040 to read as follows:
5.40.040 Interference and abuse of police
dogs prohibited. It is unlawful for any
person to wilfully or maliciously interfere,
obstruct, torture, beat, kick, strike or in
any way abuse or harass any dog, used by any
police officer in discharging or attempting to
discharge any legal duty or power of his
office, under circumstances not amounting to
"Harming a Police Dog," as defined in RCW
9A.76.200.
Section 2. Section 5.50.020(A)(2) is hereby amended
to read as follows:

2. Any person violating any of the provisions of
Title 5 shall be punished by a fine not to
exceed Five Thousand Dollars ($5,000), except
that the following chapters and sections of
Title 5, shall be punished by a fine not to
exceed Five Thousand Dollars ($5,000) or by
imprisonment in jail for a term not exceeding
one year, or by both such fine and imprison-
ment:
Chapter 5.34 - Persons, Crimes Relating To
Chapter 5.38 - Public Morals, Crimes Relating
To
Chapter 5.14 - Controlled Substances,
Paraphernalia and Toxic Fumes
Chapter 5.24 - Firearms and Dangerous Weapons
Section 5.22.010 - Reckless Burning
Section 5.42.010 - Disorderly Conduct
Section 5.40.010 - Obstructing
Section 5.40.030 - Escape
Section 5.26.220 - Reckless Discharge of
Fireworks
Section 5.10.050 - Reckless Operation of a
Boat
Section 5.05.133 - Cruelty to Animals
Section 5.05.131 - Nuisance
Section 5.40.040 - Interference and Abuse of
Police Dogs
Section 3. If any section, sentence, clause or phrase
of this ordinance should be held to be invalid or unconstitu-
tional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitu-
tionality of any other section, sentence, clause or phrase of
this ordinance.
Section 4. This ordinance or a summary thereof shall
be published in the official newspaper of the City, and shall
take effect and be in full force five (5) days after the date of
publication of the attached approved summary.
