ORDINANCE NO. 2144
AN ORDINANCE OF THE CITY OF EDMONDS, WASH-
INGTON, ADDING A NEW SECTION 6.12.045 TO
THE EDMONDS CITY CODE PROHIBITING DUMPING
OR DEPOSITING SEWAGE FROM SEPTIC TANKS OR
PORTABLE TOILETS INTO THE CITY'S SANITARY
OR STORM SEWER SYSTEM WITHOUT A PERMIT;
AND ADDING A NEW SECTION 6.12.046 TO THE
EDMONDS CITY CODE SETTING FORTH THE PERMIT
APPLICATION PROCESS; AND ADDING A NEW
SECTION 6.12.047 TO ESTABLISH FEES AND
TERMS; AND PROVIDING FOR PENALTIES.
WHEREAS, at the present time people are pumping
sewage from septic tanks directly into the City's sewer sys-
tem without paying for the full costs of processing said
sewage, and
WHEREAS, such increased sewage creates an addition-
al expense for the citizens of Edmonds and lessens the
capacity of the treatment plant to process the sewage, and
WHEREAS, establishing a system for monitoring the
dumping of sewage from septic tanks into the City sewage
system will allow the City to monitor the amount of sewage
being dumped into the system and will also allow for the
collection of a reasonable fee to treat the additional
sewage, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. A new Section 6.12.045 is hereby added
to the Edmonds City Code to read as follows:

"6.12.045 DUMPING OF SEWAGE - PROHIBITED.
It is unlawful for any person, firm or other organization to
deposit or pump sewage from septic tanks into the City's
sanitary or storm sewer system without first obtaining a
valid permit from the Public Works Department; provided,
however, the requirements of this section shall not apply to
sewage from portable toilets in recreational vehicles,
campers, trailers and boats."
Section 2. A new Section 6.12.046 is hereby added
to the Edmonds City Code to read as follows:
"6.12.046 PERMIT APPLICATION.
A. The permit required by Section 6.12.045 of the Edmonds
City Code shall be issued by the Director of Public
Works or his designee. Applications for the permit
shall be made upon forms furnished by the Public Works
Department and in addition to such other information as
is required, the following information shall be given:
1. The name, address and telephone number of the
person, firm or organization applying for the
permit;
2. The estimated amount of sewage to be dumped on a
monthly basis;
3. The make, model, serial number and vehicle license
of the trucks used to pump the sewage into the
City system;
B. The Director of Public Works or his designee shall set
forth on the Permit the expiration date and the location
in the City where the sewage may be pumped into the
City system.
C. The permit shall be limited to sewage pumped from
septic tanks located within the City of Edmonds.
D. The permit shall be given to the applicant and a copy
retained in City files and shall include such infor-
mation as required by the Director of Public Works,
which may specify places from where pumped within the
City of Edmonds, driver's signature, and such other
information as the Director or his designee may re-
quire. The permit shall be displayed by the applicant
or his employee at the time the sewage is pumped into
the City system."

Section 3. A new Section 6.12.047 is hereby
added to the Edmonds City Code to read as follows:
"6.12.047 TERM/FEE.
Permits shall be valid for a period of three months from
date of issue. The fee for the permit shall be $125.00.
Permits may be renewed by the Public Works Director, or his
designee, upon payment of an additional $125.00 fee."
Section 4. Any person, firm or other organization
violating any provision of this ordinance shall be guilty of
a misdemeanor and, upon conviction thereof, be punished as
set forth in Section 5.45.020 of the Edmonds City Code.
Section 5. If any word, phrase, clause or other
portion of this ordinance is held to be invalid or unconsti-
tutional by a court of competant jurisdiction, the remaining
portions of this ordinance shall not be affected.
Section 6. This ordinance shall be in full force
and effect five (5) days after passage and publication by
posting as provided by law.
